1958 12 30 CC Minutes, Special1261 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS December 30, 1958 The City Council of the City of Baytown, Texas met in special session on Tuesday, December 30, 1958 at 5:CC o'clock P.M. in the Council Room of the Baytown City Hall with the following members in attendance: P.H. Mears Councilman W. L. Ward Councilman J. C. Garrison Councilman W. H. Hollaway Councilman Al Clayton Councilman Lacy Lusk Councilman R. H. Pruett Mayor J. •W. Harrison City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, afterwhich, the follwing business was transacted: Report - Mayor Pruett - Drainage Ditch Easement Mayor Pruett reported that he and other members of a Committee appoint- ed to meet with Mr. and Mrs. Troxell relative to an easement dedication on a drainage ditch, had visited with the Troxells and discussed the easement dedication. The meeting was termed successful as both Mr. and Mrs. Troxell had agreed to discuss the proposal with their lawyer and get his viewpoint on such a dedication. The Mayor assured the Council that he proposed to cover only that portion of the ditch effecting the Housing Authority 3 -acre tract during this fiscal year. As the funds are made available, the remain- ing section of the easement can be completed with storm sewer installation. Such an improvement will be costly and the City may be required to spread the improvement asr a two or three year period. The Committee will keep the Council informed of the progress made in the negotiation. Ordinance 501 -A - Amended - Annexing Creekwood Subdivision Tract The City Manager introduced and read an ordinance extending the City Limits of the City of Baytown to include a 39.99 acre tract of land which will be known as the Creekwood Subdivision to the City of Baytown. This acreage was presented, as a preliminary plan, to the Cotintil for its Approv- al at the last regular meeting of the City Council on December 18th. At the time of the presentation of the Plat, the owner and developer, Mr. Leroy Walker, made formal request for the City to extend its City Limits to include his proposed subdivision. Councilman Clayton moved to adopt the ordinance annexing the 39.99 acre tract of land as requested by the develop- er, Leroy Walker. Councilman Garrison seconded the motion. TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY OF SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE1PUBLICATION AND PASSAGE OF THIS ORDINANCE IN THE MANNER PROVIDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN; PROVIDING FRO THE AMENDMENT OF SAID ORDINANCE NO. 501 WITH RESPECT TO THE TERRITORY TO BE ANNEXED AND FOR THE FINAL PASSAGE OF SAID ORDINANCE IN AMENDED FORM PURSUANT TO SECTION 91, ARTICLE I. OF THE CHARTER OF THE CITY OF BAYTOWN. Annexation - First Reading - Highway 73 Councilman Mears moved to adopt an ordinance for its first reading extending the City Limits to include Wooster, Lakewood, C. A. Fortner Tract, Armory Tract, Busch Estate, etc. Councilman Ward seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Nays: None " Ward " Garrison " Hollaway Mears " Lusk Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 517 AN ORDINANCE kNLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY OF SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND PASSAGE OF THIS ORDINANCE IN THE MANNER PROVIDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN. Report - Water Well The City Manager reported that tests had been made on the Water Well and in each instance met the specifications set forth in the bid adver- tisement. The City Engineer and Director of Public Works each verified the report; City Engineer Busch stated that a payment is due the con- tractor and an estimate will be presented at the next regular meeting setting forth the percentage of work completed, the total work com- pleted in dollars and cents, the retainage and amount due as of the estimate presentation. Discussion - Strest'Improvement Projects The City Manager gave a report on the projects completed by the City's workers in their relationship to the various street improvement contracts. Each project is progressing favorably; the City crew '2111 be through with its portion of the improvements before the contractor is ready to move in with a possible exception of the Denubina Street area project. It is possible the City may need assistance in completing its portion of work. Councilman Clayton suggested that the City Manager check the proposal of a Mr. Allen, or any other reliable contractor who has the equipment and know how to perform such improvement. Should weather conditions prevent steady progress on the installation of the storm sewer, the contractor may be retained on a daily basis to give assistance and prevent any unnecessary delay in the completion of the overall improvement program. The City Manager also gave a report on the progress being made relative to the improvement of North and South Main Street. A letter has been mailed to each property owner on North and South Main, explaining the mechanics of the program and soliciting their signature, if the program' is favored. He explained this project will be given priority in an effort to obtain the 70% signers. Councilman Ward asked an explanation of his statement, in the November Nunthly Activities Report, relative to his intent to slow down on the beginning dates of our bond Program. He stated that he Vill not promote any ddditional street improvement projects until all the contrafts, which have been accepted, and the improvements authorized, have been partially completed. His one aim is to have Main Street improved from end to and and will exert every effort to get the required number of signers to go forward with such improvement. Alley - East Baytown Councilman Ward stated that he had checked the conditions of alleys in East Baytown Subdivision since the last regular meeting and had found the condition of the alley between Carolina and New Jersey streets to be in a worse condition, by far, than all other alleys within the subdivi- sion. Mr. Grantham was instructed to check the alley and see if it is possible to remove a hum p which prevents drainage. This work should be done immediately. A program of permanent improvement will be adopted later. Adjournment Councilman Ward moved for the meeting to adjourn. Councilman Lusk seconded the motion.
