Reverend Graham, afterwhich, Councilman Ward moved to dispense with the reading of the minutes of the regular meeting of August 28, and they be approved. Councilman Clayton seconded the motion. Base - $300868.50 Alt. - $320823.00 Brown & Root Inc. Base - 840,439.39 Alt. - $420279.59 Baloo Inc. Base - $42,836.50 Alt. - $449613.50 City Manager Harrison asked the Council to consider the bids tery carefully as they seemed quite complicated. Councilman Mears made a motion that the bids be studied and tabled until the next tegular meeting of the Council..Councilman Ward seconded the motion. The roll call vote qas as follows: Roll Call: Ayes: Councilman Clayton Nays: None a Ward " Garrison a Mears Mayor Pruett :1 g&en Arbor Interceptor Sewer - 2pen and Tabulate Bids The bids on construction of Glen Arbor Interceptor Sewer were opened and tabulated as follows: Century Construction Co. $189233.80 Brown & Root, Inc. $309431.30 Balco, Inc. $270362.95 /any Councilman Ward made a motion that-the City Engineer study the bids and they be tabled until the next regular meeting of the Council. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call : Ayes: Councilman Clayton Nays: None " Ward " Garrison " Mears Mayor Pruett _Shell For Street Adjacent to Trinity Tabernacle Church Reverend Graham of the Trinity Tabernacle Church attended the Council meeting to request shell for Eleventh Street, which is a new, undedicated and recently eanoavated street. Mayor Pruett made a suggestion that since the street was in bad condition, for the present time a bar ditch be cut from Eleventh St. to Danubina, which would keep the water from bottling up. Reverend Graham stated tbAtthe Church was out of money and the Mayor asked if the Lutheran Church, which fs also adjacent to this street, could help. Reverend Graham said they eventually intedded to curb and gutter, but the street must have repairs immediately. Councilman Ward made a motion to table the discussion for shall on Eleventh St. untill the next regular Council meeting. Councilman Clayton seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Nays: None Ward " Garrison " Mears Mayor Pruett The Mayor instructed the City Manager to have Hunicutt graded and shelled from 10th St. to Danubina immediatbly so the members of Trinity Tabernacle Church might be able to reach their parking lot. Councilman Clayton moved to adopt an ordinance appropriating 813,490.00 to Pay back billing of light company bills, plus balance of street lighting bill - to October 1, 1958, for Sewer Plants, for Police Dept., for Fire Dept. and to pay Baytown Sun for advertising during July, August and September, 1958. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Nays: None " Ward " Garrison " Mears Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 506 AN ORDINANCE AUTHORI ZMG 3 THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE THIRTEEN THOUSAND FOUR HUNDRED AND NINETY AND N0 1100 (013,49C.00) DOLLARS FROM THE COUNCIL IMPROVEMENT FUND TO CLASS- IFICATIONS 302F -119 401F-110 201F -11 AND 105F -5. Councilman Clayton moved to adopt an ordinance appropriating 81,150.00 for Power, because of increased power cost. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Nays:None Ward " Garrison " Mears Mayor Pruett The caption of the ordinance follows: 12 �o ORDINANCE NO. 507 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE ELEVEN HUNDRED AND FIFTY AND N0 1100 (0 1,150.00) DOLLARS FROM THE UNAP- PROPRIATED WATER SURPLUS FUND TO CLASSIFICATION 1001 F -11 - WATER. City Manager Harrison read a legal opinion from City Attorney Chandler stating the Law Pertaining to Private Subdivisions with questions, therein, to be answered by City Attorney Chandler. First: Must the 6ity of Baytown honor a plat which has been previously approved and filed by hnd with the Harris County Commissioners Court and the Clerk of Harris County, respectively? The answer to this question is that the City must respect such plats. Secondly:If property owner has a County - approved plat, but the pro- perty owner later makes changes in such plat, is the City re- quired to honor such original plat? In this situation the City need not honor the original plat because when the propebty owner made changes in the original plat it amounted to a vacation of the original plat, after which the property owner would have to deal solely with the City City Manager Harrison advised the City Council that they must act on the re- quest of Mr. Kelley for preliminary approval of Brownwood IL at this meeting as the thirty (30) days allowed for legal consideration would be up on September 16th and by inaction the Council would automatically give its approval. Council- man Ward made a motion to reject preliminary approval. .Councilman Mars seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Nays:None Ward " Garrison " Mears Mayor Pruett . ; :..W a City Manager Harriion stated that a memo had been received from Mr. Grantham, Director of Public Works and City Engineer, Jon Busch, concerning installation of a By -Pass in the Roseland Oak Sanitary Sewer System because of atom water infil- taation. Mr. Grantham is now preparing to install a by -Aass which is not guarantedd to correctithis, but will improve sertice to the residents. This project is to start the week of September 15th. Councilman Mears made the motion that construction on this By -Pass go ahead with an urgent priority and the residents should advise if operation is satisfactory. Councilman Clayton seconded the motion. The roll call vote was as follows: Roll Call: Ayes: W- scellansous Councilman Clayton " Ward " Garrison " Mears Mayor Pruett. Nays: None City Manager Harrison received a letter asking permission to install a Train for Kiddie rides in Municipal Park. Mr. Harrison suggested that any request of this sort be rejected. The City Council unanimously agreed. Final Approval, - Glen Arbor Subdivision, Section #5 The Council gave final approval on Section 5, Glen Arbor Subdivision subject to the presentation of bond sufficient to cover remaining cost to complete developement. As to the discussion of the traffic survey at Main and Durain, City Manager Harrison asked that this be considered at the next Council meeting, when diagrams and charts would be available. Councilman Clayton stated that it had been brought to his attention by a member of the group who sing at the City Hall that the lights in the assembly were too dim for them to read their song books. City Manager Harrison said the lights were to be replaced at a later date, possibly by December. Councilman Mears asked about the paving of Clayton Drive. City Manager Harrison said the school will sign a petition and Mr. Hatchell will present the petition when signed. A resident had asked Councilman Clayton if the Council would grant permission for him to tie -in to City sewer lines because of bad drainage on the lot on which he was to construct a building. Mayor Pruett suggested that resident elevate his foundation when constructing building, as he would get better drainage and author- ized City Engineer Busch to sot suggested foundationreXevation stakes. Joe Ware, District Manager of the General Telephone Co. of the Southwest, who is being transferred to San Angelo, Texas, extended his appreciation to the Council for considerations and courtesies extended him in behalf of his business association while in the City of Baytown. Adjournment. -Councilman Clayton moved for the meeting to adjourn. Councilman Mears seconded the motion. The ayes were unanimous and the Mayor declared the meeting adjourned. R. H.
