MINUTES OF THE REGULAR MEETING OF
THE CITY COUNCIL OF THE CITY OF BAYTO1,010 TEXAS
April 9, 1.958
The City Council of the City of Baytown, Texas met in regular session. on Wed -
nesiay, April 9th, 1958 at 7:00 o'clock p.m. in the Council Room of the Baytown
City Hall with the following members in attendance:

The Mayor called the meeting to order, afterwhich, Councilman Mears moved to
dispense with the reading of the minutes of the regular meeting of March 27th and
they be approved. Councilman Swain seconded the motion. The roll call vote was as
follows:

Canvass Election Returns - Resolution
The regular municipal election returns were canvassed afterwhich, Councilman
Garrison moved to adopt the following resolution:
A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION
HELD WITHIN'-THE CITY OF BAYTOWN ON THE 1ST DAY FO APRIL, 1958, FOR THE
PURPOSE OF ELECTING THREE COUNCILMEN FROM THE RESSPECTIVE DISTRICTS
NO. 1, 4 AND 5; DECLARING TIE; RESULTS OF SAID ELECTION; FII,IDING THAT
NOTICE OF SAID ELECTION WAS DULY AND PROPERLY HELD AND THE RETURNS
THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE ,dITH THE LAWS
OF THE STATE OF TEXAS.
WHEREAS, pursuant to Section 96, Article IX of the Charter of the City
of Baytown, the City Council of said City at a special meeting held on this the
9th day of April, 1958, proceeded as required by law to canvass the returns of
the Regular Municipal Election_ helf in the City of Baytown on the lst day of April,
1958, for the purpose of electing three (3) Councilmen from the respective Districts
I'o. 1, 4 and 5; said Election having been held under and pursuant to the provisions
of the Charter of said City and an Ordinance duly passed on the 23rd day of
January, 1958, calling said Election, and
iiFREAS, said Election having been duly and regularly held and had as called
in said Ordinance and according to law and the returns thereof having been duly
made and the Election Judges having certified the results of said Election as here-
inafter set:)out, and the City Council having duly and regularly canvassed the ,
returns of said Election and finding that the total votes cast at said election
were as follows, to -wit:

WHEREAS, the City Council of the City of Baytown finds the Election roturns as
set out above to be accurate and corrset and no election protest or contest having
been filed with said Council or instituted in connection with said election;

Section 1: That as shown above no candidate received a majority of the votes
cast at said election for the office of Councilman. from District No. 1, and
accordingly it is necessary that a Rim -Off Election be held to elect a Councilman
from said District No.l, and it appearing that Paul ?.ears and Don Evans are
the names of the two candidates receiving the highest number of votes at said Election
for the office of Councilman from that District, it is therefore ordered that a
Special Run -Off Election be held for the purpose of electing one of these candidates
for said office.
Section 2: That as shown above no candidate received a majority of the votes
cast at said Election for the office of Councilman from District No. 4, and
accordingly it is necessary that a Run -Off Election be held to elect a Councilman
from said District No. 4, and it appearing that W. D. Hollaway and W. C. Swain
are the names of the two candidates receiving the highest number of votes at
said election for the dffice of Councilman from that District, it ie therefore
ordered that a Special Run -Off Eelction be held for the purpose of electing one
of these candi3ates for said office.
Section 3: that as sho%r above no candidate received a majority of the votes
cast at said Eloction for the office of Councilman from District No. 5, and
accordingly it is necessary that a Run -Off Election be hold to elect a Councilman
from said District No. 5, and it appearing that Al Clayton and S. C. Huron are
the names of the two candidates receiving the highest number of votes at said
Election for the office of Councilman from that District, it is therefore ordered
■ that a Special Run -Off Election he held for the purpose of electing one of these
' candidates for said office.
Section 4: That the City Council of the City of Baytown .further finds that the
.notice of said Election was duly and properly given as require,] by law and as
provided in the Crdinance calling said ^ lection and that _ =aid Election was duly and
regularly held and the returns thereof duly and regularly made by the proper
officials of said Election, and in all things according to law.
INTRODUCED., READ and PASSED by the affirmative vote of the majority of the
City Council of the City of Baytown, this 9th day of April, 1958.

Study Proposed. Zn +Trine City Fall - Office Space
!i. J. R. Vsnderheider, Member of the Baytown Planning Commission, presented
a sketch of a study which had been made by the Commission relative to the
enlarging of the City Hall in order to provide more space for the overcrowded
conditions nresently existing in the downstairs offices of the City Hall. The Dro-
posal included new. addition 1£' west side of present City Hall 12' or. the front
which could be used By -,the water department and the snace currently used by the
water department ray be delegated to the use of other offices now being
operatei within the City Hall. This addition would provide 165C square feet at
a cost of approximately ,25,000. The Council accepted the proposed sketch and
estimate date, however, a study will be made of the feasibility of the proposed
expenditure before further action is taken by the Council.

Clayton moved to accent the bid of Hobbs Manufacturing Company and the three (3)

Dr. Bridges - Health L =_aLue
Dr. _ °ridges net with the Council relative to a deficit which will be suffered
by the baytown Health League in the operations for the calendar year of 1958.
At the present the City is making a donation of ;'5,000.00 annually to the fund
and the Community Chest is supplying :'.8,058.0' -0. He proposed that the Council
approve an increase of ';3,OCC.CC gratuity in order .or the Health Center to
continue in its present schoduls o£ services to the underprivileged. Since the
City has completed its budget for the 1957 -58 budget year, it was sug.,ested that
the request be held in abeyance until the new fiscal year of 1958 -59. After the
beginning of the new fiscal year funds cam be supplied by the city which will
maintain the continued operation of the Health League; the Council accepting
the Petition of Dr. Bridges as a formal request f_r an increase of „3,CCC.CO
annually in the annual donation allocated to the Baytown Health Center by the
City for operational expenses.

Annroved 50' street - East James Improvement
Due to the possiblity of future developement of Jones - Laughlin along Cedar
Bayou, it was proposed that East James be widened to the greatest possible width
during the street improvement project. The street has a 60' right -of -way dedicated

easement, and since it will be a feeder thorou_hfare, Councilman Swain roved
to approve dna designate a 50' street for Bast James. Councilran gars seconded

Replacement - J. T. Peacock - Buildine Inspector
Ln order to make a replacement in the Building Inspector's office due to the
death of J. T. Peacock, the Council awed to meet Thursday, April 1Cth for an
interview with the applicants. The time of the meeting to be 5 o'clock p.m.

Councilman Clayton to instruct the City Clerk to advertise for bids on
the storm sewer pipe required to complete the jail ditch project. Councilman Mears

The Mayor informed the Council that County Commissioner Ramsey had offered

r!b-n- power. This would be the county's share of the cost according to ,ii. Ramsey.

The Council will hold a special meeting. to interview apnlicants for the position

it was agreed to contact Congressman Albert Thomas concerning availability
c' to clean. out Goose Creek Stream and reclain adjacent land.
A study will be made on the need of a 'work room and ware house for the
Electrical department where testing equipment can be set up for use and any'repairs
tot lights may be done by personnel of the department.
