1958 03 27 CC Minutesii/3 MSNL'TES OF TFIE ?LGULAR TCETING OF THE CITY COUNCIL, OF THE CITY OF BAYTO'WN Marc:n. 27, 1958 The City council of the City of Baytown, Texas met in regular session on Thurs- :lay, 11arch 27, 1956, at 7:CC o'clock p.m. in the Council Room of the Raytown City Fall with the following nembers in attendance: F.H. Pruett Mayor George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order. Councilman Swain moved to dispense with the reading of the minutes of the Regular meeting of March 13th and the special meeting of March 19th and they be approved. Councilman Garrison seconded the motion. The roll call vote was as follows: Roll Cell: .ayes: Councilman Clayton Nays: 11,ne 51ard Garrison Swain Lusk Mayor Pruett Committee Report A Committee report was given on the recent study made relative to the locating of the proposed water well, reservoir included in the approved bond issue of November 1957. A4 -acre tract of land had been found which would be. purchased for k2,5CG. per acre; the acreage being located on the east side of Tiorth Main at its intersection with Hob Smith Road,, The Committee reported that the land was outside the city limits, however, City Attorney Chandler informed the Council that this would have no effect upon the locating of the improvements on this site if the Council so desired. The Council approved the purchase proposal, however, the City Charter required any purchase made by the city to be approved after there has been an opportunity for competitive bidding. A purchase of c2,50C.CC or more must be published in the newspaper once a week for two consecutive weeks prior to the time for making such purchase. The Council instructed the City Attorney to contact the owner of the acreage, Mr. B. T.Mc Kinney, immediately and negtiate t an agreement with him.., if possible, in order to allow the advertising requirement without forfeiting the possibility of purchase through the approved procedure. After telephoning,'.s.Chandler reported that '[r. Ycfinney agreed to a ?3CC.CC earnest money contract, provided, bids were asked for at the earliest possible '3ate. Councilman. Garrison moved to authorize the City Attorney to enter into a n earnest money contract with M$. McKinney; the amount of the contract to be 3CC.CC for a time limit of 45 days with the understanding that if the City does not pur- chase the 4 -acre site it forfeits the $3CC.00earnest money. Councilman Clayton seconded the motion. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Nays: none " 'Ward " Garrison Swain " Fears Lusk a Mayor Pruett Ordinance - Regulating Steed of Emergencv Vehicles Upon the recommendation of the Chief of Police, the Council instructed the City Attorney to prepare an ordinance regulating the speed of any emergency vehicle, including ambulances, wreckers, fire trucks and police patrol cars, operating in Baytown. The only exception to be made is a police car in pursuit of a vi.6lator of the law, otherwise, the speed will be restricted to 10 or 15 miles above the speed regulation. Traffic Light - West Lobit and North Pruett Upon the recommendation of Councilman Lusk, Councilman Swain moved to authorize the removal of the regular traffic light "at'the intersection of North Main and East Sterling and the installation of same at the intersection of tdest Lobit and North Pruett-near the Lamar School. Councilman Lusk seconded the motion. The members of the Committee are Councilmen : -;ard, `wain and Garrison. This Committee will matte a stud.- of street lights along the extension of 'Jest Texan Avenue, the need of a repair job on Laredo Street in the Lerner Nedroid Subdivision and a possible shift in the opening of the esplanade on Highway, 146 from.. Pleasant Drive to Fortune Drive. Lerner - North Leon Mr. Ike Lerner, local developer, asked the Council to give some assistance, if possible in establishing the set back lines on the proposed North Loop route which will be routed through his tract of land, in order for him to continue with his subdivision development contract. The Mayor explained that the Council did not have a plat of the proposed route and nothing could be done by the city, however, City Attorney Chandler suggested that Mr. Lerner have his attorney register a letter to. ?,tr. Ramsey and N. E. Carmichael with a request for immediate fiction to be taken 6h the litr6hise of the land for the "North Loop in order for the development of the subdivision to continue. L. E. Gray - Esplanade Onenin, L. E. Gray petitioned the Council to consider the feasibility of making a request to the State Highway Depart^_ert for an additional opening on the proposed esplanade on Highway 146 at the East Lobit Street intersection as this is the only through street and he felt the need would warrant such a request. No action was taken by the Council since it was felt that it was too difficult to please all the property owners along the proposed Improvement project and should such a need arise in the future the Highway Department would cooperate in making such an opening. Grantham - Accumulated Sick Time Pav Public 'docks Director Grantham presented the following letter to the Council: "Honorable Yayor and Members of the City Council, Baytown, Texas Gentlemen: On February 12th, M's. Middleton presented a memoranda to the Council relative to accumulated sick leave pay on termination for city employees not under civil. service. Recently I have been approached several times concerning the rocemnendation male by 1&$. 'tiddleton and the action of the Council toward the program. I io feel that this added benefit would tend to increase the moral of the employees not new under Civil Service and I would personally urge the Council to sniorse the program if at all possible. Respectfully submitted, /s/ C. W. Grantham Director of Public :brks" The council agreed to place this request in the ton bracket of its list of proposed projects. After some study has been giveito the proposal a report will be made to the City 2:_ployees concerning the Council's decision. "; scellaneous :$. Barber was requested to 'ouy two (2) waste baskets which will be placed in the Council Chamber, for circulars and other matters of advertising which the Council receive through the mail. Mr. Grantham was instructed to clean the septic tank drainage area on Avenue J. in Busch Terrace. It was as-reed that the recently installed traffic lights on North Yain at Park and Cedar Bayou Road will be covered and remain inactive until the North Main paving project is completed. The Council agreed to ask bL,. "Jack" Kiernns to appear before the Council at its next reg=ular meeting and give an explanation of the City of Baytown - nouston Lighting and Power Comnaoy Street Lighting Contract.
