1958 02 18 CC Minutes, Specialr r i/z N M11iUTES OF THE SPECIAL MELTING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN February 18, 1958 The City Council of the City of Baytown, Texas met in special session on Tuesday, February 18, 1958 at 6:00o'clock p.m. in the Council Room of the Baytown City Hall with the following members in attendance: P. H. Mears Councilman W. L. Ward Councilman J. C. Harrison Councilman n W. C. Swain Councilman Al Clayton Councilman Lacy Lusk Councilman R. H. Pruett Mayor George Chandler City Attorney Eina Oliver City Clerk The Mayor called the meeting to order, afterwhich, the proposed subdivision ordinance was presented for review and discussion. Prior to the review of the proposed Subdivision Ordinance, the Council opened discussion on the status of the Baytown Planning Commission, rumors of its abolition or changing of name, etc since the City Attorney's report to the Council of the State Statute regarding the final approval of proposed sub- division plats by a City's Planning Commission,rather than the City Council or Qdverning Body, if a city has a Planning Commission. The Council expressed its appreciation of the work done by the Planning Commission; its untiring and valuable contribution to the City of Baytown in the past and Councilman Ward moved to give the Planning Commission a vote of confidence; the Commission to remain in its present status of name, duties, etc and the Council employ no subterfuge to evade the State Law relating to the Planning Commission approving any and all proposed subdivision developments. Councilman Swain seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Nays: None " Ward " Garrison " Swain " Mears " Lusk Mayor Pruett PM. H. F. Massey, Chairman of the Planning Commission thanked the Council for the vote of confidence and pledged the service of the Flanging Commission in the same manner as has been done in the past. He also expressed the Commission's desire for the Council to endorse any and all subdivision plats and to make any recommendations prior to the Commission's approval. • Councilman Swain excused from the meeting. Subdivision Ordinance The Council reviewed the proposed subdivision ordinance with the City Fagineer and City Attorney clarifying any and all proposed amendments, afterwhich, Councilmen Ward moved to adopt the ordinance as presented. Councilman Lusk seconded the motion. The roll call vote was as follows: Roll Call:Ayes: Councilman Clayton Nays: Prone " Ward " Garrison " Nears " Lusk Mayor Pruett The caption of the ordinance follows: a.,W ORDINANCE No. 465 AN ORDINANCE PROMULGATING GENERAL RULES AND REGULATIONS GOVERNING THE PLATTING AND SUBDIVIDING OF LAND WITHIN THE CORPORATE LIMQTS OF THE CITY OF BAYTOWN, TEXAS, AND WITHIN FIVE (5) MILES THEREOF, WITH REGARDS TO RULES AND REQUIREMENTS FOR APPROVAL OF THE INITIAL PLAT; FOR SUBDIVISION NAME AND STREET NAMES; FOR LOT SIZES; FOR STREET I34FROVEMENTS, ALLEYS OR EASEMENTS; WATER AND SEWER UTILITY MAIN SERVICE LINES THEM; ALL OF SAID RULES AND REGULATIONS ARE FOR THE PORPOSE OF PROMOTING THE HEALTH, SAFETY, MORAL AND GENERAL WELFARE OF THE COMMUNITY, AND THE SAFE, ORDERLY AND HEALTHFUL DEVELOPMENT OF SAID OOMMHHNITY; CONTAINING A REPEALING. CLAUSE; PRO- VIDING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND THE EFFECTIVE DATE THEREOF. The City Attorney introduced and read an ordinance regulating itinerant merchants, vendors, peddlers and persons selling or taking orders for goods, or wares within the City of Baytown. Councilman Lusk moved to adopt the ordinance as read. Councilmen Ward seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Nays: None " Ward " Garrison " Mears " LusM Mayor Pruett The caption of the ordinance follows: ORDINANCE N0. 466 AN ORDINANCE DEFINING AND REGULATING ITINERANT MERCHANTS, ITINERANT VENDORS, PEDDLERS, AND PERSONS BELLING OR TAKING ORDERS FOR GOODS, WARES, MERCHANDISE, SERVICES, PHOTOGRAPHS, NEWSPAPERS, OR MAGAZINES; PROVIDING FOR A LICENSE AND A LICENSE FEE; REQUIRING A BOND; REQUIRING PERSONS TO REGISTER WITH THE BAYTOWN POLICE DEPARTMENT AND THE CITY CLERK; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; INCLUDING A FINE OF NOT LESS THAN TEN ($+10.00) DOLLARS NOR MORE THAN TWO HUNDRED (0200.00) DOLLARS; REPM31IG ORDINANCES INCONSISTENT HEREWITH; CON - TAINII ?G A SAVINGS CLAUSE AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEFMOF. Audit Books — Pcotection Middleton The Council ordered a complete audit of the city's records for the protection of the former City Manager, C. D. Middleton. Adiournment Councilman Clayton moved for the meeting to adjourn. Councilman Lusk seconded the motion. The ayes were unanimous and the Mayor declared the meeting adjourned. (y� R. H.
