N[NUTES OF THE REGULAR. MEETING OF
THE CITY COUNCIL OF THE :CITY OF BAYTOWN.. TEKAS
February 13, 1958
The City Council of the City of Baytown, Texas met in regular session on
Thursday, February 13, 1958 --at 7:00.o'clock.p.m• in the Council Room of the
Baytown City Hall with the following members in attendance:

-The Mayor called the meeting t6 order.- Councilman Mears moved to dis-
pense with the reading of • the minutes of the regular meeting. of January 23rd
and the special meeting of February 6th and they be approved. Councilman
Garrison seconded the motion. The roll call vote was as follows:

Councilman' Clayton moved to authorize the Mayor to execute a letter to
the American National Bank, Austin, Texas relative to the $1,0001000 City
of Baytown Street and Drainage Improvement Bonds and the $1,000,000 Water
and Sewer System Revenue Bonds, Series 1958, naming the purchas'ereoB each
issue and asking that proceeds of sale be forwarded to-the Citizens.National
Bank of Baytown — Councilman Mears seconded• the -•motion• The roll call vote

The Council took no action on the.request:of:Mr.• .'Bartlett for_-•permission
to remove pipe from non - producing oil wells. He was informed that the
ordinance under which the City is'now.opsrating-was written for-.the:l:zro- '
tection of the water sands and the Council :irould -not favor any violation
which would endanger the water sands.
Resolution. -- Highway 146
The- Council a report from the Mayor on the meeting held with Mr-• Car-
michael relative to the iiidening. of Highway 146; • the former action of the
Council on the edpanade and Mr. Carmichael's refusal to:consider.:the-
construction without a median. He gave others in the audience an opportunity
to express themselves, afterbhich, he urged that the former action'-of the
council be rescinded in order for the City of Baytown to enjoy the benefits
of the $750,000 allocated to this area-in Highway improvements. Councilman
Ward moved to adopt the following resolution:
A RESOLUTION ADOPTED BY THE CITY CCU NCIL OF THE CITY OF BAYTOWN
RELATIVE TO THE WIDENING OF STATE HIGHWAY 146, EXTENDING FROM
ALEXANDER. DRIVE, NORTHEAST TO EAST CITY LIMITS•:..
BE IT RESOLVED BY THE CITY COUNCIL OF THE- CITY OF BAYTOWN.. TEgAS:
Sectioh- 1:_That the City Council-of the City of Baytown-requests that
the State Highway Department proceed with plans and design-of State":Highway
146, within the city limits of the City of Baytown, Texa s accoiding to
the policy and.standards'of the State Highway Department•.
Section 2:: AND, be- it further resolved, 'that the -. State Highway. Depart-
ment give consideration to the property owners along said Highway 14&,by .
furnishing as many openings in the median as practical.
Section.-3:- AND, that the plans and :design: shall be reviewed by-the City
Council before final approval is made by the State Highway Department.

Mr. Gore, representing the residents along Maryland Street in the request
for curb and gutter, met with the Council on the proposed joint participation project.
The City Engineer presented an estimate showing excavation, shell, asphalt, storm
sewer, ate in the amount of $11,677.60. This project was estimated to extend from
Missouri to West Main. Since the Council knew it was impossible to approvesuch
a major projoct without funds, the group was asked to met with the Council at
the regular meeting of February 27th and an estimate would be presented with surface
drainage provisions. The two estimates will then be compered and, if possible, a
decision will be reached relative to the project.

The Council reviewed a cost estimate for materials and excavation of Carnegie
Street from Lindberg to Pershing, in the amount of $3,816.00. Since the Council
had promised excavation to any contractor, this being done at a previous meeting,
on the proposed curb and gutter project, it was agreed to hold the working mechanics
of the project up until the weather cleared.: completely, Mr. Nichols, who was re-
presenting the residents along Carnegie, asked if the curb and gutter construction,
street excavation and street base could be extended on streets at its intersection
with 8arnegie. Councilmen Ward moved to instruct the Director of Public Works
and City Engineer to proceed.with the work as soon as practical, completing a
10 -Root radius on all corner,lots abutting street intersections; furthermore, it
be agreed that no more curb and gutter and/or drainage projects be approved by
the Council until those preseAtly Council committed be completed. Councilmen Mears
seconded the motion. The roll call vote was as follows:

Mr. J. C. Bevers presented several members of the Be Molay Chapterfor boys
in Baytown and asked Council Approval and endorsement of a 3-5 day conclave which
will be held in Baytown in the summer. The Council commended the Chapter for its
contribution in the youth of Baytown and pledged support in any manner to assist
in making the Conclave a success.

'The City Manager presented the need of an additional building for the repair
of city owned vehicles. He suggested that it be situated near the city's field
office and recomffinded a 60 x 40 building of metal construction with a concrete
floor. The approximate cost was $3,000.00. Councilman Mears moved to instruct the
City Manager to proceed with the investigation of the cost of constructing such
type building. Councilman Swain seconded the motion. The roll call vote was
as follows:

Subdivision and Baddlerta Ordinances - Sneci=i lbetine
The Council agreed to meet at 6:00 o'clock p.m., Tuesday: February 18th to
review and dispose of the Subdivision and Peddler is Ordinances which were
scheduled to be reviewed at this meeting.
Street Lichte — Authorized
Councilman Clayton moved to authorize the installation of two (2) 2,500
lumen incandescent street lights at the following locations, to -wit:
1- East Jack and 5th
1 - East Jack and 6th

ORDINANCE I10. 464
AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN
TO APHiOPRIATE FIVE HUNDRED FIFTY DOLLARS ($550) FROM THE ANTI -
CIPATED UNAPMOPRIATED SURPLUS GENERAL FUND TO CLASSIFICATION 101 G-1.
The status of Jack Mills, a Houston Attorney who was hired to assist the
City Attorney in filing delinquent tea suits in district court, was presented
for discussion by the Mayor. City Attorney Chandler asked that the matter not be
discussed openly but in the office of the City Manager since he did not feel
that this was the place and he did not want Mr. Mills to be ostracized in the
newspapers, however, the Mayor refused a closed meeting and asked that it be
presented over the table. The City Attorney said that he had been told by the
City Manager that some of the councilmen were complaining about Mr. Mills being
on the payroll for such a length of time and I&. Chandler had agreed to have Yr.
Mills taken from the payroll effective February 1st. Mr. Middleton had not agreed
to this procedure and Mr. Chandler stated that he thought the matter was cleared.
The question was discussed at length andfinally recommended that Ma. Middleton
and Mr. Chandler meet together and sicuss the needs of his office in order for a
proper settlement to be reached. lhI . Chandler contended that the issue was
closed or "dead" and Mr- Mills was no longer on the cityts payroll insofar as he
was - concerned.

Councilman Ward moved for the meeting to adjourn. Councilman Garrison
seconded the motion. The ayes were unanimous and the Mayor declared the meeting.
