MINUTES OF THE REGULAR MEETING OF
THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS
September 12, 1957
The City Council of the City of Baytown, Texas met in regular session
on Thursday, September 12, 1957 at 7:00 o'clock p. m. in the Council Room of the

Mayor Pro Tam Lusk celled the meeting to order. Councilman Clayton moved
to dispense with the reading of the minutes of the regular meeting of August 22nd,
the special meeting of September 3rd and they be approved. Councilman lohars seconded
the motion. The roll can vote was as follows:

The budget for the ensuing fiscal year 1957 -58 was intruduced and read
by the City Manager. Councilmen Mears moved to adopt the ordinance as read.

ORDINANCE NO. 441 —A
AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR BEGINNING
OCTOBER 1, 1957, AND ENDING SEPTEMBER 30, 1956, IN ACCORDANCE WITH
THE: CHARTER AND ORDINANCES OF THE CITY OF BAYTOWN; AND PROVIDING
FOR THE PUBLICATION OF THIS ORDINANCE.
The City Manager introduced and read an ordinance fixing the tax rate
and tax levy for the City of Baytown for the fiscal year beginning October 1, 1957,
and ending September 30, 1955. Councilmen Clayton moved to adopt the ordinance as
reed. Councilman Swain seconded the motion. The roll call vote was as follows:

ORDINANCE NO. "2
AN ORDINANCE FIXING THE RATE AND TAX LEVY FOR THE CITY OF BAYTOWN,
=ASTFOR TAE FISCAL YEAR FINDING SEPMMM 30, 1958; UPON ALL
TAXABLE PROPERTY IN SAID CITY OF BAYTOWN.9 TEXAS, IN HONFORMITY
WITH THE LAWS OF TEXAS AND THE CHARTER PROVISIONS AND THE ORDINANCES
OF SAID CITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH.
Councilman Ward introduced Mr. Morris, who was recommended by the Tree
Committee, to hire W. Morris to treat the diseased trees at Roseland Park.
Mr. Morris stated that in treating the diseased trees he would train a city
employee, who, in the future would know the prooddure used in treating the trees-
Councilman Clayton moved to accept the recommendation of theTree Connittee and
approve hiring Mr. Morris. Councilman Mears seconded the motion. The roll call

Mr. Strickland and W. Ramsey, Attorney, on behalf of W. Wilkenfeld,
appealed to the City Council regarding a building owned by Yr. Wilkenfeld, located
on West Main Street, which has been declared unsafe by Mr. T. J. Bounds, Fire
Marshal. W. Bounds stated that, in hid• .,opinion, a violation of theCity Ordinance
exists in the building operation carried on by W. Wilkenfeld and further repair-
ing has been ordered stopped. The final decision to determine the legality of the
intent of Ordinance No. 197 in regard to the safe condition of this building will
be studied by a Committee namely: C• C• Redd, T.H. Bounds, Al Clayton and Mayor
Pruett. This Committee will present the result of their study at the next
regular meeting of the Council.
A petition of property owners and business operators along Alexander
Drive and citizens living on street entering Alexander Drive stated their plea
that they did not want an espanade on Alexander Drive, was presented to the
Council by W. E. H. Rheaume. After much discussion, the Council advised Mr.
Rheaume that this matter would be brought to W. Carmichael's attention and
further study would be made by the Council prior to any decision.

City Manager Middleton, one of the Committee Members appointed to
meet with the Commissioners Court of Chambers County regarding the Abbe'
Subdivision located in Chambers County, and sitpated within a 5-mile radius of
Baytown, stated that he had received a telephone call from Jund Hand and was
informed that the only restriction regarding subdivisions that Chambers County
has is that a 601 right -of -'way is required. Judge Hand stated further that if the
City of Baytown so desired, to proceed with their restrictions regarding this
subdivision.
Mr. Jim Baldridge, representing residents of Morrell Street, came before
the Council stating that the property owners and residents of Morrell Street
objected to that street being designated a main thoroughfare. *. Knowles of the
Planning Commission explained to Mr. Baldridge that the property owners on Morrell
Street would be given an opportunity to state whether or not they approved of that
street being considered a main thoroughfare; and that a certain percentage of
the property owners must appamove before any construction.

City Attorney Chandler stated that the City Count could make good use
of a limited number of Legal Reference Volumes and asked that the Corporation
Court Committee study this matter, and state their decision at a later date.

Councilman Mears moved to accept the lowest bid of Thad Felton, and to
authorize purchasr of six (6) one half ton pickup truck trucks at a price of
$7,847.00. Councilman Clayton seconded the motion. The roll call vote was as

Mr.• Bill Knowles, Chairman of the Street Committee, read a twenty -
five minutes speech prepared by the Planning Commission and asked the Coun6ills
endorsement of same. After mach discussion regarding several issues, it was
suggested that the Council and Planning Commission meet again for further discussion,
Tuesday, September 17, 1957, at 6 :30 p•m• in the Council Room of the Baytown
City Hall.
An estimate of the material cost for the storm sewer from Carnegie to
the ditch which lies between Lee Heights and Oakwood Additionn near the Eastern
termimus of Edison Street, amounts to $501.60 and the material cost for regrading
the street will be approximately $3,000.00• It is assumed that the property owners
wi12. bear the cost of the curb and gutter and the City will regrade the street.
Councilman Mears made the motion that the Council approve this regrading. Council-
man Clayton seconded the motion. The roll call vote was as follows:

City Manager Middleton introduced and read the following resolutions
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAY7014N
OFFICIALLY ADOPTING A POLICY OF MAKING IMPROVEMENTS IN AND
TO CERTAIN HEREINAFTER DESIGNATED STREETS IN SAID CITY WHEREIN
THE PROPERTY OWNERS ADJACENT TO SUCH STREETS SHALL PARTICIPATE
IN SUCH IMPROVEMENM TO THE MUTUAL BENEFIT AND ENHANCEMENT OF
TAE 0='AND SUCH ADJACENT PROPERTY OWNERS; AUTHORIZING AND DIRECT-
ING THAT THE PROPER DEPARTMENT HEADS UNDERTAKE ANY STUDIES AND
TASKS THAT MAY BE REQUIRED TO EFFECTUATE THIS POLICY; AUTHORIZIM
TAE MAYOR TO APPOINT A COA4SITTEE FOR THE PURPOSE OF FURTHERING
COOPERATION BETWEEN SUCH COUNCIL, THE ADMINISTRATIVE STAFF OF
THE CITY AND THE BAYTOWN PLANNING COMMISSION.
Whereas, many streets in the City of Baytown are in dire need of
improvement; and
WHEREAS, it is finacially improssible for the City to complete these
Improvements at its sole expense; and
WHEREAS, the financial undertaking would be less burdensome if adjacent
I owners participated in such project with the City of Baytown; and
WHEREAS, such participation by adjacent property owners mould greatly
enhance the utility and value of ouch property to the property owner in particular
and the City in general; and
WHEREAS, such joint participation will enable the City to improve a
much greater number of streets than it could if it had to bear the sole expense
thereof; and
WHEREAS, such adjacent property owners can participate with the City
over a period of time so as to make annual payments for the improvements so
small as to be almost negligible; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY 001UNCIL OF THE CITY OF BAYTOWN:
THAT the City Council of the City of Baytown hereby adopts a policy of
making improvements in and to certain hereinafter designated streets in said City
wherein the property owners adjacent to such streets shall participate in such
improvements to themutual benefit and ehhancement of theCity and such adjacent
property owners; authorizing and directing that the City Manager shall see to it
that the department heads shall undertake any studies and tasks that may be re-
quired to effectuate this policy; authorizing the Mayor to appoint a Committee for
the purpose of furthering cooperation between such Council, the Administrative
Staff of the City and the Baytown Planning Commission.
INTRODUCED, READ and PASSED by the City Council of theCity of Baytown,

Street Lights Recommended and Aut_hoxtzed for Ins .a't'lation
Councilman Mears moved to accept the recommendation of the Street Light-
ing Committee and authorize the installation of one (1) 2000 lumen incandescent
street light, mounted on standard brackets at a cost of $30.00 per year, to be
located at:
Davis Road, at the Coutheast corner of the intersection of Davis
Road and Strickland Street.
One (1) 15,000 lumen muecury vapor light, mounted on suspension brackets
at a cost of $64.00 per year, to be located at:
Davis Road at the west property line of the City of Baytown's Fire
Station No. 4

Assistant Chief of Police, H. F. Freeman, Jr., Presented a petition
signed by the entire Police Force, requesting Sergeant Cleve Dickens Appointment

this appointments with approval of theCivil Service. Councilman Mears seconded

Councilman Clayton made a motion to write a letter to Mr. W. A. Parish
protesting further installation of demand meters. Councilman Meats seconded the
motion, and W. Middleton was authorizdd to write the letter of protest to Mr.
W. A. Parish, President, Houston Lighting and Power Company. The roll call vote
was as follows:

Councilman Ward moved to give final approval of Graywood Subdivision
provided the developer's furhish the City of Baytown with a bond of security in
the amount of $35,000.009 made payable to the City, guaranteeing the completion
of Graywood Subdivision for all water lines, sewage system fire hydrants, street
paving, curbs, gutters and all other requirements according to the subdivision
ordinance ; plans and specifications to be approved by the City Engineer. Councilman
Clayton seconded the motion. The roll call vote was as follows:

Councilman Ward moved that purchase of a new automobile for the City
Attorney be approved during the fiscal year 1957 -58• Councilman Mears seconded

Councilman Clayton requested, and the request was approved, that
Councilman Mears be added to the members of the Street Lighting Committee;
relieving Councilman Clayton as a member of that Committee.
Councilman Ward moved to accept the recommendation of the City
Hall Committee and approve the salary increases of the following: Floyd Adcox-
$35.00; George Chandler 435900 and Jean L. Gagnon - $25.00. Councilman Stain
seconded the motion. The roll call vote was as follows:
