Councilman with the reading of the minutes of the regular meeting proved. Councilman Bergeron seconded the motion. The Roll Call: Ayes: Councilman Clayton Councilman Bergeron Councilman Campbell Councilman Swain Councilman Mears Councilman Lusk Mayor Pruett Resolution - Canyall Election Returns - Special Councilman Councilman Councilman Councilman Councilman Councilman Councilman Councilman Mayor City Manager City Attorney City Clerk Campbell moved to dispense of April 25th and they be ap- roll call vote was as follows: Nays: None le 3i The Council canvassed the election returns of the special run -off election held April 27, 1957, afterwhich the City Manager introduced and read the following resolution: A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 27TH DAY OF APRIL, A.D. , 1957, FOR THE PURPOSE OF ELECTING A COUNC11" FROM DISTRICTS NOS. 2 AND 3; DECLARING THE RESULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS DULY AND PROPERLY HELD AMID THE RE- TURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS: WHEREAS, pursuant to Section 96, Article IX.of the Charter of the City of Baytown, the City Council of said City at a special meeting held on this the 8th day of May, 1957, proceed as required by law to canvass the returns of the special municipal elec- tion held in the City of Baytown on the 27th day of April, 1957, for the purpose of electing a Councilman from Districts Nos. 2 and 3; said election having been held under and pursuant to the provisions of the Charter of said City and an Ordinance duly passed on the 10th day of April, 1957, calling said election, and WHEREAS, said.election having been duly and regularly had and held as called in said Ordinance and according to law and the returns thereof having been duly made and the election judges having certified the results of said election as hereinafter set out and the City Council having duly and regularly canvassed the returns of said elec- tion and finding that the total votes cast at said election ware as follows, to -wit: For Councilman from District No. 2: W. L. (Dub) Ward 793 Votes J. E. (Gene) Langham 650 Votes For Councilman from District No. 3: Milton L. Campbell 540 Votes James C. Garrison 753 Votes and WHEREAS, the City Council of the City of Baytown finds the election returns as set out above to be aocurate and correct and no election protest or contest having been filed with said Council or instituted in connection with said election, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That {V. L. (Dub) tVard received a majority of the votes cast at said election for the office of Councilman from District No. 2, and accordingly the said W. L. (Dub) Ward is hereby declared elected to the office of Councilman from District Number 2 of the City of Baytown. Section 2: That James C. Garrison received a majority of the votes cast at said election for the office of Councilman from District No. 3, and accordingly the said James C. Garrison is hereby declared elected to the office of Councilman From District Number 3 of the City of Baytown. Section 3: That the City Council of the City of Baytown further finds that the notice of said election was duly and properly given as required by law and as provided in the Ordinance calling said election and that said election was duly and regularly held and the returns thereof duly and regularly made by the proper officials of said election and in all things according to law. INTRODUCED, READ and PASSED by the affirmative vote of a majority 'of the members of the City Council of the City of Baytown, on this the 8th day of May, A.D., 1957. _ /s/ R. H. L. Garrison as Councilman from Districts Nos. 2 and 3 respectively, ensuing years. Name - New Members - City Planning Commission Ward and James C. for the two (2) Upon the recommendation of Mayor Pruett, Councilman Clayton moved to approve.the appointment of E. C. Kimmons and J. R. Venderheider as new members . of the Baytown Plan - npug Commission to replace Milton'L. Campbell and John W. Sylvester whose terms expired April 30th, the appointments to be for a three -year term. Councilman Swain•seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Councilman Ward Councilman Garrison Councilman Swain Councilman Mears Councilman Lusk Mayor Pruett Nays: None Broyles - Street Alignment - Elmer Gray Subdivision - Section u38 -P 7 Messrs. Broyles and Bynum, consulting Engineers, came before the Council with a plat map of the proposed Elmer Gray Subdivision Section 438 -P and asked Council for preliminary approval of the street alignment as set forth in the plat map. After con- sulting the City Engineer and Director of:L"Public Works, Councilman Clayton moved to give preliminary approval of the street alignment of the proposed Elmer Gray Subdivision, Section 938 -P. Councilman Mears seconded the motion. The roll call vote was as follows: Roll-Call: Ayes: Councilman Clayton Councilman Ward Councilman Garrison Councilman Swain Councilman Mears Councilman Lusk Mayor Pruett Dinner - Honoring Councilmen and WiVes Nays: None io 3� Councilman Lusk moved to designate Thursday, May 9th, 6 :30 P.M., Rebel Inn, as the time and place for a dinner honoring the old and new councilmen, their wives, City Manager and Wife, City Attorney and Wife and City Clerk and Husband. Councilman Clayton seconded the motion. Planning Commission - City Council The Mayor, in behalf of the City Council, accepted the offer of the Baytown Chamber of Commerce to join the Council and Planning Commission in working to make our community a better place in which to live. Mr. H. F. Massey, President of the Chamber of Commerce, introduced his Public•Improvements Committee, and assured the Council that the Committee stands-ready to cooperate in any way possible to assist in making Baytown a better com- munity. Open Car Bids The bids on the 4 -door sedan for the Department of Public Works were opended and are tabulated as follows: Buck' Turner Chevrolet Higginbotham Motor Plymouth Thad Felton Ford $1,863987 $2,057.00 $1,917.00 Councilman Swain moved to aocept the bid of Buck Turner Chevrolet Company for the 1957 Fordor Chevrolet at a price of $1,863.87. Councilman Clayton seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Appropriation Ordinance Councilman Clayton Nays: None Councilman Ward Councilman Garrison Councilman Swain Councilman Mears Councilman Lusk Mayor Pruett The City Manager introduced and read an Ordinance appropriating Two Thousand Six Hundred Seventeen and 57/100 ($2,617.57) Dollars for the payment of $450.00 light plant, $952.57, Mann Estate and $1,215.00 for Sanitary Sewers Highway 146. Councilman Lusk moved to adopt the Ordinance as read. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Clayton Councilman Ward Councilman Garrison Councilman Swain Councilman Mears Councilman Lusk Mayor Pruett The Caption of the ordinance follows: Nays: None AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE TWENTY -SIX HUNDRED SEVENTEEN AND 57/100 ($2,617.57) DOLLARS FROM THE ANTICIPATED UNAPPROPRIATED SURPLUS GENERAL FUND TO CLASSIFICA- TIONS 202 2 -2. 401 G-8 and 401 Y -4. ra3 4 New Member - Light Committee Councilman Swain was appointed as a member of the Street Lighting Committee to replace out -going Councilman R. B. Bergeron. Other members of the Committee are Councilman Lusk and Clayton. The request for a street light at the CatholiE Church on Beach Street was referred to the Committee for study, also. Grover Edge - Veteran's Service Center - Report The Council heard a partial activity report of what has been done at the Veteran's Service Center since it was reactivated on October 1, 1456. The office is.now located at 3308 Minnesota Street. The Council thanked Mr. Edge for the clear and concise report and commanded him for the good work being done by the Service Center. W. D.. Broyles - Turner Building - No. 1 Fire Zone W. D. Broyles, Engineer, asked Council interpretation of the City's Building Code in reference:to load bearing vs. non - bearing masonary walls in the No. 1 Fire Zone. Our Present City Ordinance requires a 12 -inch wall in the No. 1 Fire Zone, however, Mr. Broyles pointed out that the proposed 8 -inch wall would serve as a cur- tain wall only as the building was to be supported by a steel structure. The two (2) street walls will be approximately 15- inches. The Mayor informed Mr. Broyles that the State Fire Insurance Commissioner had informed the City Council that no exceptions will be made on the 12 -inch wall requirement for all buildings erected in a No. 1 Fire Zone and should the bode be violated the city will be subject to a penalty. Mr. Broyles accepted the interpretation and thanked the Council for clarification of the question. Ernest L. Brown. Jr. - Bonds The Council set the date of Monday, May 13th, at 7 :00 o'clock p.m. as the time for a meeting with Mr. Ernest L. Brown, Jr. on the City's Bond Refunding 8rbject. Jasper - Sanitary Sewer - Ora Glenn Subdivision Messrs. Jasper and Bounds asked the Council for Sanitary Sewer Service Lines to homes located in the Ora Glenn Subdivision lying West of Highway 146. The Mayor informed them that the streets had never been dedicated to the City by the'Subdivider; " at one time a dedication had been presented to the Council for acceptance, however, the owner wanted-to retain all mineral rights and the Council would not accept the street dedication instrument. If the property owners within the subdivision can persuade Mrs. Ilfrey-to make the proper dedication with no strings attached sewer connection extension can be made from the sewer line now being installed,along Highway 146 toward Cedar Bayou. Clean Out Drainage Didch - Beaumont:Road The Director of Public Works was instructed to have the drainage ditch along Beaumont Street cleaned out. Urged the necessity of a street maintenance program, also. Committee - Easement Albright Brothers A Committee pomposed of A. J. Busch, C. D. Middleton and George Chandler was ap- pointed to draw_up an instrument for the cancellation of a portion of a street crossing easement which has been dedicated to the City of Baytown by the Albright Brothers. Railroad - Street Crossings The City Manager was instructed to contact management of the railroad companies relative to repair of crossing throughout the City, especially East Sterling, South Pruett and Lee Drive. Study - Insurance City Schedules of insurance payments made by the City of Baytown on buildings, land, equipment, etc were presented to the Council for study and Councilman Clayton urged that this cost be thoroughly discussed and a more feasible route taken after the study has been made. City Manager - Meeting The Council gavie City Manager Middleton permission to attend the City Manager's meeting at New Orleans, May 19th through 22nd. Committee - Water Collection Office - West Baytown. A Committee composed of Councilmen Mears, Lusk and Clayton was appointed to make a study of the possibility of eliminating the Water Office, 3308 Minnesota Street, and C :ad> placing the collection office in same business establishment now operating within the vicinity, Adjournment Councilman Clayton moved for the meeting to adjourn.
