1956 07 11 CC Minutes137 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN July 11, 1956 The City Council of the City of Baytown, Texas met in regular session on Wed- nesday. July 11. 1956 at 7 :00 o'clock p.m. in the City Manager's office at the City Hall with the following members in attandance: P. H. Mears W. C. Swain Al Clayton R. H. Pruett A. V. Middleton Councilman Councilman Councilman Mayor Acting City Manager City Attorney City Clerk Councilman Councilman Councilman City Manager The Mayor called the meeting to order. Councilman Clayton moved to dispense with the reading of the minutes of the regular meeting of June 28th and they be approved. Councilman Swain seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Swain Clayton Mayor Pruett Streets - Richardson Place - Topping Ted Lyman,11704 Olive Street, met with the Council relative to the topping of streets in Richardson's Place. The Mayor informed Mr. Lyman and the Council that the City manager had contacted Mr. M. C. Kelly, Vice President of Citizens National Bank 6 Trust Co., as instructed and had been assured, by letter, that funds would be made available for the project as agreed. After some discussion, Councilman Clayton moved to instruct the City Attorney to notify F. A. Richardson and the developers of Carolyn Meadows to start the completion of the streets within these subdivisions on or before August 1st, 1956, and that the construction must be com- pleted within thirty (30) working days. Should the developers fail to meet the terms the City will hire a contractor and bill the developers for the cost. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: -None " Swain " Clayton Mayor Pruett Appropriation Ordinances Councilman Clayton moved to adopt an appropriation ordinance appropriating funds for repair costs, new water lines, water meters and settings in the Water Department. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None to Swain " Clayton Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 346 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE SIXTEEN THOUSAND SIX HUNDRED ($16,600) DOLLARS FROM THE UNAPPROPRIATED SURPLUS WATER FUND TO CLASSIFICATIONS 1002 E -9. 1002 Z -9 and 1002 Z -10 Councilman Mears moved to adopt an ordinance appropriating $65.00 to Budget Item 105 F -5 for payment of advertising. Councilman Clayton seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears to Swain of Clayton Mayor Pruett The caption of the ordinance follows: ORDINANCE N0, 347 Nays: None AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE SIXTY -FIVE ($65.00) DOLLARS FROM THE UNAPPROPRIATED SURPLUS GENERAL FOND TO CLASSIFICATION 105 F -5. Councilman Clayton moved to adopt an ordinance appropriating $9,000.00 to classification 301 D -8, for repair of streets. Councilman Swain seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Swain " Clayton Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 348 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN'TO­ APPROPRIATE NINE THOUSAND ($9,000) DOLLARS FROM THE UNAPPROPRIATED' SURPLUS TRAFFIC IMPROVEMENT FUND TO GENERAL FUND. CLASSIFICATION 301 D -8. N. M. Driskell - Reappointment - Civil Service Commission. Upon the recommendation of the Mayor, Councilman Swain moved to reappointment N. M. Driskell to the Civil Service Commission Board for a period of three years. His appointment to become effective as of July 1, 1956, and will end June 31, 1959. Councilman Clayton seconded the motion. The roll call vote was as followsr, Roll Call: Ayes: Councilman Mears Nays: None " Swain " Clayton Mayor Pruett Street Alignment - Cuba Greer Subdivision A plat was presented of the proposed Cuba Greer Subdivision and the Council was asked for preliminary approval of the street alignment. The only outlet shown on the plat was Davis Road with the proposed street making a dead -end street alignment. provided 50 -foot right -of -way is dedicated to extend from Davis Road to Highway 146 and improvements made thereon which will conform with the city's subdivision ordinance. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None " Swain It Clayton Mayor Pruett Council Ask Traffic Count - East Fayle and Highway 146 Councilman Clayton moved to instruct Acting City Manager Barber to notify the State Highway Department to conduct a traffic count at the intersection of East Fayle Street and Highway 146 for the purpose of determining the need for additional traffic control measures. Councilman Swain seconded the motion. The roll-call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Swain " Clayton Mayor Pruett Proposed Optimist Club Park Report P91 The Council received a report from the City Engineer and City Attorney relative to the proposed Optimist Club park site off East Fayle at Third. The tract of land is a recorded cemetery being known as Magnolia Cemetery and upon inspection of the grounds, scattered graves were found throughout the tract of land. The City Attorney Informed the Council that development of the tract for playground purposed would be prohibitive since the law is forceful in the protection of the dead. Acting City Manager Barber was instructed to notify Mr. McNabb of the findings of the City Engineer and City Attorney, however. the Council will consider a similar agree- ment should the Club find a different location as a proposed park site. Permission Serve Warrants - Out of Town Traffic Violators - Off -Duty Officers Police Chief Montgomery asked permission from the Council to permit off -duty officers to serve out -of -town traffic violation warrants and pay them the $5.00 fee which is authorized for serving of a warrant. He explained that many of the warrants are not being served as the traffic warrants are being mailed to the police department where the person lives and not direct by the Baytown Police Department. Councilman Swain moved to authorize the Chief of Police to permit off -duty officers to serve warrants on traffic violators who live out of town and the officer be paid the $5.00 fee authorized for serving the warrant. Councilman Clayton seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None of Swain it Clayton Mayor Pruett Mayor Pruett asked Chief Montgomery to supervise the delegating of officers to serve the warrants; the service be rotated to keep harmony in the department. Resignation of Humane Officer - Hire Jerry Sloan The Council accepted the resignation of Humane Officer R. H. Erwin effective as of July 15th. 1956. A letter of application was read from Jerry B. Sloan, who asked to be considered as a replacement in the Humane Department. The application was 1! approved by the council and the applicant was asked to report for work as of July 16th, 1956. Miscellaneous The Council discussed the drainage of Schilling Street ditch. In inate "holes" at both ends of the existing culverts. the City Engineer recommendations, namely: 1. Install a storm sewer the entire length of Schilling Street. 2. Raise all of the existing culverts to the old ditch grade and 3. Dig the existing ditch to storm sewer grade the entire length order to elim- made three fill in depressions. of Schilling St. It was agreed thatstudy would be made and the present "holes" eliminated the oheapest and easiest way possible. Adiournment Councilman Swain moved for the meeting to adjourn. Councilman Clayton seconded the motion. The Ayes were unamous and the Mayor declared the meeting adjourned.
