1956 06 28 CC Minutesy3Z 1 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL. OF THE CITY OF BAYTOWN, TEXAS June 26. 1956 The City Council of the City of Baytown, Texas, met in regular session on Thurs- day, June 28, 1956 at 7:00 o'clock p.m. in the Council Room of the Baytown City Hall with the following members in attendance: Councilman Lusk, chairman of the Committee appointed to study the hospitaliza- tion bids for the city employees and their dependents, reported that an extensive study had been made of the bids; had several meetings with the committee and cond- ucted a poll of the city employees and it was the recommendation of the Committee that the bid of Western Indemnity Life Insurance Company be accepted for the fol- lowing fiscal year beginning July 1, 1956. Councilman Clayton:.moved to accept the recommendation of the committee and the bid of Western Indemnity Company be accepted and approved for the July 1, 1956 through June 30th, 1957 fiscal year. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call; Ayes: Councilman Mears Nays: None Swain Clayton " Lusk Mayor pro tem Bergeron Ordinance - Waste oil - Sanitary Sewers At the request of Director of Public Works Grantham, City Attorney Chandler introduced and read an ordinance prohibiting any person, firm, association, or corporation from discharging any petroleum and /or volatile matter whatsoever into the sanitary sewer system of the City of Baytown. Councilman Clayton moved to adopt the ordinance as read. Councilman Lusk seconded the motion. McNabb- Optimist Club- Plavaround C. R. McNabb, Chairman of the Baytown Optimist Club, came before the Council with a proposal to convert a B to 10 acre plat of ground, now under lease to the Club, into a playground for children living north of East Fayle at 3rd, and the outlying area. fie recommended that two baseball diamonds be laid out and if possible backstops be installed and any other equipment furnished which would provide recreational facilities for children in the area. Councilmen Bergeron moved to accept the tract and proceed immediately with plans to convert it into a playground; the City Engineer and Director of Public Works be appointed to cooperate with the Optimist Club in staking and clearing the playground site. Councilman Clayton seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears MAYS: None " Bergeron " Swain Clayton Lusk Mayor Pruett Dommert - Electrical Installation Violations Earl Dommert, business manager of the Baytown International Brotherhood of Electri- cal Workers, met with the Council and asked that a system of requirements be set up which would control "outside" Electricians and electrical contractors now operating within the city limits of Baytown. He stated that much of the work is done at night, no permit is obtained, no inspection requested. The request was discussed at length, after which Mayor Pruett appointed a Committee composed of Councilmen Swain, Lusk, and Electrical Inspector C. C. Redd to make a study of a proposed Electrical Ordinance and submit recommendations to the Council. Councilman Swain will be chairman of the Committee. Ordinance - Appropriation Extension Doc Pound Councilman Lusk moved to adopt an appropriation ordinance which will provide funds for fencing, minor tools, gasoline and salaries for the Humane Officer. The fencing will be used in the extension of the pen now housing dogs picked up by the Dog Catcher. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mayor Mears Nays: None Bergeron Swain Clayton Lusk Pruett The caption of the ordinance follows: ORDINANCE N'0. 392 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE FOURTEEN HUNDRED SEVENTY -FIVE ($1,975, 00) DOLLARS FROM THE UNAPPROPRIATED SURPLUS GENERAL FUND TO CLASSIFICATIONS 501 A -3, 501 B -6, 501 B -7, 501 E -d AND 501 Y -10 Refund - 1956 Don Tax Since the New Dog Ordinance, which became the running at large of any and all dogs within Clayton moved to refund the 1956 $1.00 dog tax the receipt to be retained in the city files. Nays: None W Resolution The City Manager introduced and read the following resolution: A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO TRANSFER FOURTEEN HUNDRED EIGHTY -THREE DOLLARS AND TEN CENTS ($1,903.10) FROM CLASSIFICATIONS 201 A -3, AND 201 B -5 TO CLASSIFICATIONS 501 A -3 AND 501 B -5, RESPECTIVELY. Councilman Swain seconded the motion. Councilman Bergeron moved to adopt an appropriation ordinance in the amnunt of $385.00 for repair of the City Attorney's automobile. Councilman Lusk seconded the motion. Curb and Gutter - Edison Street - Lee Heights Councilman Clayton moved to approve an assessment of $0.6:; per lineal foot for curb and gutter and $0.20 per square foot for driveways for residents along Edison Street who petitioned the Council, at the regular meeting of May 24th, for curb and gutter installation in order to obtain drainage in the area. Councilman Lusk seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None " Bergeron Swain Clayton Lusk Mayor Pruett Drainage - Ditch Morgan Road Councilman Claytonireported that V. D. Ashley, Morgan Road, had contracted him and no additional land will be dedicated for easement purposes along Morgan Road as was proposed at the time of his meeting with the Council in January, 1956, however, the need for drainage is still as essential, Councilman Clayton moved to instruct the city engineer to set grades along Morgan Road to Cedar Bayou Road; the Director of Public Works be instructed to move the gradall in and have the ditches deepened and cleaned out according to the grades set by the engineer along Morgan Road to Cedar Bayou Road, at Highway 146. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Bergeron " Swain Clayton " Lusk Mayor Pruett Miscellaneous Due to a conflict in the meeting of Mayor and Councilman Association and the City Council it was agreed that the next regular meeting of the City Council will be held Wednesday, July 11th. Councilman Mears was named as a member of the Progress Committee to replace former Councilman 51. L. Campbell. The request for a vapor mercury street light to be installed aththe intersection of New Jersey and West Main was referred to the Street Lighting Committee for study. The City Manager was instructed to notify Commissioner Ramsey to complete the installation of catch basins along the Martin Ditch Extension project, as agreed. 9A Street 'Topping - Richardson Place, Section 2 Councilman Clayton reminded the Council that the developer of Richardson Place had not completed the streets in the subdivision as prescribed in the existing subdivision ordinance of the City of Baytown. Even though the City had been assured that the streets would be topped at such time as requested by the City no attempt had been made on the part of the subdivider to complete the project. The City Manager was instructed to notify the developer that legal steps would be taken, if necessary, to compel the developer to fulfill his obligation to the City of Baytown. Widen Eiloore Road Councilman Swain asked that Kilgore Road be widened approximately one and one - half feet from Bayou Drive to Cedar Bayou School in order to provide adequate space for cars to pass without having to hit the shoulders of the road. It was agreed that the road would be repaired in the same manner as was East James, Adiournment Councilman Lusk moved for the meeting to adjourn. Councilman Swain seconded the motion.
