1956 06 14 CC MinutesW MINUTES OF THE REGULAR MEETING GF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TUAS June 14, 1956 The City Council of the City of Baytown, Texas met in regular session on Thursday, June 14, 1956 at 7:00 o'clock p.m. in the Council Room of the Baytown City Hall with the following members in attendance: P. H. Mears Councilman ,R. B. Bergeron Councilman 11. M. Campbell Councilman W. C. Swain Councilman ' Al Clayton Councilman Lacy Lusk Councilman R. H. Pruett Mayor C. D. Middleton City Manager George Chandler City Attorney Edna Cliver City Clerk The Mayor called the meeting to order, Councilman Clayton moved to dispense with the reading of the minutes of the regular meeting of May 24th and_.the special. meeting of May 31st and they be approved. Councilman Lusk seconded the motion. Tle roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Bergeron Campbell " Swain " Clayton " Lusk Mayor Pruett Group Hospitalization - City Employees - Bids Opened The bids, as presented, for Hospitalization coverage on City Employees and their dependents were opened. The names of the Companies presenting bids follows: The Travelers Mutual of New York Blue -Cross -Blue Shield American Indemnity Co. Republic National Life Northwestern National Life Western Indemnity Life Crown Life Insurance Life G Casualty of Tenn. Councilman Campbell moved to accept the bids as presented, however, no further action be taken on them at this time; the bids be referred to the Insurance Committee and Department Heads for tabulation, study and recommendations. Councilman Bergeron seconded the motinn. The roll call vote follows: Roll Call: Ayes: Councilman Mears Nays: None " Bergeron Campbell " Swain Clayton " Lusk Mayor Pruett Oath of Office - Plannino Commission City Attorney Chandler administered the Oath of Office to Milton L. Campbell, James E. Sherwood, Harry F. (Massey, Steele M. McDonald, Jolly Lynn Woods, Bohn N. Sylvester, Billy M. Knowles and Lynn A. Seaman as Commissioners of the Planning Commission of the City of Baytown, as named and approved by the Mayor and City Council at the special meeting of May 31st. Policy - Curb and Gutter Installation - City of Baytown The Council heard a report from the Curb and Gutter Committee on further curb and gutter projects by the City of Baytown. The Mayor explained that contractors en- gaging in cement work within the City had been contacted relative to their feelings toward the City doing such improvements and the majority were opposed to it. The opposition was based on the fact that it was impossible for the work to be done as cheap as the City has been doing it, even though the City was eliminating a drainage problem in the installation of curb and gutter, and the competition was unfair to contractors. The Committee made recommendation that the City discontinue the curb C gutter program. Councilman Campbell asked the Council to forestall action at this A r time in order to give some consideration and study to the overall program during the budget review, however, Councilman Bergeron moved to accept the recommendation of the Committee; the Council go on record as doing no more curb and gutter work unless the widening of a street demanded the replacement of it. Councilman Lusk seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Bergeron Swain Clayton " Lusk Mayor Pruett Landfill Dumping Ground - Budget - Bull Clam Dozer Nays: Councilman Campbell Councilman Clayton moved to instruct the City Manager to incorporate in the 1956 -57 budget sufficient monies to provide land for a landfill garbage disposal ground and a bull clam dozer to be used at the jobsite. Councilman Mears Seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman 1. Mayor Waste Oil - Sanitary Sewer Mears Nuys: None Bergeron Campbell Swain Clayton Lusk Pruett A memorandum was presented to the Council by Director of Public Works Grantham relative to the evidence of waste oil and other petroleum products at the sewage treatment plants, especially the new plant on West Main Street. fie explained that these products destroyed the bacteria and the hazzards of a sewer explosion cannot be overlooked either. He presented a tabulation as to the results of a survey recently made to determine the source of the petroleum products and urged some action in the matter.. Councilman Clayton moved to instruct the City Attorney to draw up an ordinance prohibiting the dumping of petroleum products into the sani- tary sewers of the City of Baytown, requiring a regulation trap, etc. Councilman Lusk seconded the motion. The roll call vote was as, follows: Roll Call: Ayes: Councilman Mears Nays: None " Bergeron " Campbell Swain Clayton " Lusk Mayor Pruett Dog Ordinance - Committee Councilman Campbell, as Chairman of a Committee appointed by Mayor Pruett, pre- sented an ordinance prohibiting dogs from running at large within the corporate limits of Baytown, requiring quarantining of exposednanimals, regulating vicious dogs and setting a pound fee. After the reading of the ordinance the Mayor opened the meet- ing for further discussion from the floor. Most of the persons heard favored the strict ordinance and a petition was presented with thirty -eight (38) additional signers favoring it also. After much discussion Councilman Campbell moved the adoption of the ordinance as read. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: Councilman Clayton Bergeron " Lusk Campbell Mayor Pruett Swain The caption of the Ordinance follows: CRDINANCE W. 338 AN ORDINANCE PROHIBITING DOGS FROM RUNNING AT LARGE WITHIN THE CCRPORATE LIMITS OF BAYTOWN, QUARANTINING OF EXPOSED ANIMALS; REGULATING OF VICIOUS DOGS; SETTING A POUND FEE; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY AND THE EFFECTIVE DATE HEREOF. 9-z 4 930 Baytown Health League - _Budget Presentation Bill Henson, Baytown Health League, presented the Council a copy of the pro- posed 1957 budget together with data of the operation schedule of the League. The 1957 budget was in the amount of $23,016.88 and he asked the Council to consider assuming one -third support of the overall budget. The Council made no comaittments, however, Mr. Henson was asked to have a representative present during the 1956 -57 budget review in August. Water Line - Darrell Nickerson Darrell Nickerson asked the Council for extension of a water line to service his home which he proposes to construct on the east side of the Southern Pacific Railroad opposite Stewart Heights Subdivision. City Manager Middleton informed the Council that the Railroad Company had granted an easement for waterline .extension purposes to service the homes of the Albright Brothers, but, no installation has started pending approval by the Council. Councilman Lusk moved to approve and auth- orize the installation of a 2 -inch water line across the Railroad property at Hines Street; said installation to extend to the east right -of -way property line of South- ern - Facifice Railroad Company. Councilman Mears seconded the motion. The roll call vote ms as follows: Roll Call: Ayes: Councilman Mears Nays: None " Bergeron Campbell " Swain " Clayton Lusk Mayor Pruett Appropriation Ordinance Councilman Swain moved to adopt an ordinance authorizing the City Manager to appropriate $359.95 from the Unappropriated Surplus General Fund to pay for lights and power at garage, additional automotive insurance and medical insurance. Council- man Clayton seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Bergeron " Campbell Swain Clayton " Lusk Mayor Pruett The caption of the ordinance follows: ORDINANCE W. 339 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE THREE HUNDRED FIFTY -NINE DOLLARS AND FORTY -FIVE CENTS ($359.95) FROM THE UNAPPROPRIATED SURPLUS GENERAL FUND TO CLASSIFICATIONS 701 F -11, 702 F -3A and 702 G -0 Water Fountain - Police Station - Appropriation Councilman Campbell moved to approve the purchase of a water fountain for the Police Station and adoption of an ordinance appropriating $199.00 for purchase of same. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Bergeron Campbell " Swain Clayton " Lusk Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 390 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO APPROPRIATE ONE HUNDRED NINETY -NINE ($199.00) DOLLARS FROM THE UNAPPROPRIATED SURPLUS GENERAL FUND TO CLASSIFICATION 201 Z -1 9dt Salary Increase - Corporation Court Clerk Upon the recommendation of the Corporation Court Committee, Councilman Clayton moved to increase the salary of the Corporation Court Clerk to $190.00 per month effective as of June 15th. Councilman Campbell seconded the motion. The roll call vote vas as follows: Roll Call: Ayes: Councilman Mears Nays: None " Bergeron " Campbell Swain " Clayton Lusk r Mayor Pruett Purchase Monitor Radios - Fire Department The City Manager reported that funds were available to purchase thirty (3) monitor radios which will be used by the volunteer firemen in their homes as receiver sets to assist in reaching fires faster. Stations 1, 2 and 3 will each have nine (9) sets and Cedar Bayou will receive three (3) sets. Councilman Mears moved to approve the purchase of thirty (3) Monitor Radio receiver sets; the City Manager be authorized to transfer necessary funds to make such purchase possible. Councilman Bergeron seconded the motion. The roll call vote wasras follows: Roll Call: Ayes: Councilman Mayor Mears Nays: None Bergeron Campbell Swain Clayton Lusk Pruett Acreage - Fire Station - Cedar Bayou Councilman Swain moved to approve the purchase of a one -half acre triangle tract, located at the corner of Ward and Davis Roads at Gillette, as a fire station site for Station No. 4. The purchase price was $360.00. Councilman Clayton seconded the motion. The Roll Call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Bergeron " Campbell Swain Clayton " Lusk -Mayor Pruett Plans were submitted to the Fire Station Committee on a proposed Fire Station which will be located on the above site. The building will be brick veneer and the cost estimate is $9,700. After the Committee has had time to make a thorough study of the plans the Council will receive recommendations and proceed with plans for the construction. Adiournment Councilman Mears moved for the meeting to adjourn. Councilman Lusk seconded the motion. The ayes were unanimous and the Mayor declared the meeting adjourned.
