MINUTES OF THE REGULAR MEETING OF THE
_ CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS
August 12, 1954
The City Council of the City of Baytown met in regular session on
Thursday, August 12, 1954 at 7:30 p. m. in the Council Room of the Baytown
City Hall with the following members in attendance:

The Mayor called the meeting to order. Councilman Mears moved to approve
the minutes of the regular meeting of July 22, 1954. Councilman H. M Campbell
seconded the motion. The roll call vote was as follows:

Theo Wilburn - Pronosed Widening Highway 146
Theo Wilburn, President of t1B Baytown Chamber of Commerce, and other mem
bers presented copies of a resolution adopted by the Board of Directors of the
Baytown Chamber of Commerce beseeching ghe Baytown City Council to initiate pro-
ceedings for the City of Bajctown to receive the benefit of a major improvement
of Highway 146 inside the city limits. This can only be done by resolution. The
City will bear its portion of thecost of construction by granting the right -of-
way, installing curb and gutter and storm sewers. Councilman Bergeron moved to
instruct the City Attorney to prepare a resolution requesting that steps be taken
by the Highway Department to improve and widen Highway 146 at this point, by
having the Highway Department 'ngineers prepare an estimate on the cost of such
a major project and presenting to the City Council for final action or rejection.
Councilman Lusk seconded the motion. The roll cell vote was as follows:

DEPARTMENT OF THE STATE OF TEXAS TO TAKE ANY AND
ALL STEPS IT DEF.MS EXPEDIENT FOR THE PURPOSE OF
ENABLING IT AND THE CITY OF RAYTOWN, JOINTLY, TO
IMPROVE AND WIDEN SPATE HIGHWAY 146 BETWEEN
SOUTH ALEXANDER DRIVE AND A POINT OF SAID HIGH-

" WHERFAS, the State Highway Department is pursuing the uiti:hete completion
of United States Highway 73 between Houston and Port Arthur, and
"WHEREAS, that section of said highway between the San Jacinto Ordnance
Depot and the San Jacinto River will be 1st for construction within four (4)
months, and

Cedar Bayou will be let within one (11 year,.and
"WHEREAS, the 'State Highway Department has agreed to furnish an alternate
route of this United States Highway through the City of Baytown, and

and improving of that portion of Highway 146 within the City Limits. -of
Baytown, and
"WHEREAS, the City Council of the City of Baytown is anxious to 000perate
with the State Highway Department in a program of improving and widening said
portion of State Highway 146, NOW THEREFORE.,
"BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
"THAT the Highway Department of the State of Texas is hereby respectfully
requested to take an9 and all steps it deems expedient, including preliminary -
plans, surveys and other studies for the purpose.of.enabling it and the City of
Baytown, jointly, to improve and widen that portion of State Highway 146 be-
tween-South Alexander Drive and a point on said Highway at or near Prince's
Drive -In.
"BE IT.FURTHER RESOLVED that the City of Baytown is willing to assume its
proportionate cost of such construction as set forth in the policy of the
Highway Department of the State of Texas.

The,City Council also accepted a petition bearing the names of twenty -
three (23) property owners along the proposed route of improvement protesting
the installation of a twelve (121) foot esplanade onsaid road, for the
reasons that it will confiscate the frontage, be dangerous to vehicle traffic
and necessitate the traveling of customers the distance of a mile or more un-
less openings are properly spaced. The petition was presented by E. H. Rheaume.
Budget Review
The Council set the nights of Monday and Tuesday, August 16th and 17th
to review the proposed budget for the fiscal year of 1954Q55:. The place will
the the city hall and the time 6:30 p. M.
Amendment 'Section 93 - Civil Service Rules
Councilman M. L. Campbell moved to amend Section 93 of the Rules of
Civil SE vice. The amendment reads ,--as follows:
Section 93: ELigi Uity for anointment to DMartment Head. No person
shall be appointed as Chief of the ire Department who has had less than five (5)
years actual service in some Fire Department nor shall any person be appointed
as Chief of the Police Department who has had less than five (5) years actual
service in a Police Department with the State of Texas. The Department heads
of the Fire Department and'tke Police Department shall be appointed by the
City Manager of the City, and shall be confirmed by the City Council.

Proposed Classification Ordinance Amendments
No action was taken on the proposed Classification Ordinance for the Police
and Fire Departments under Civil Service. After some study; Councilman M. L.
Campbell moved to refer the ordinance to the Civil Service Commission for
study; he further requested that it be presented at the next regular meeting
of the Council in a form to meet the requirements of the present situation
presented by the Police Department personnel. Councilmen Clayton seconded the
motion. The roll call vote was as follows:

Proposed Change Drainage — Minnesota Street
Councilman Bergeron asked the Council to consider a change in tle drainage
construction on Minnesota Street in order to relieve some of the burden carried
by Huggins, Michigan and Louisiana Streets during the rainy season. If the
present construction should stop on Minnesota the area would drain sufficiently
to eliminate a 'Rake" of water, however, approximately a foot or a foot and one —
half of water would stand for a few hours if any degree of rain should fall.
After a lengthy discussion, Councilman Bergeron moved to end the present con-
struction at the intersection of Minnedots and Oklahoma Street; continue
installation of a 36" line off Oklahoma Street down Indiana to its intersection
with Louisian a Street. Councilmen Mears seconded the motion. The roll call
vote was as follows:

The Mayor declared the motion failed to carry; present construction to
continue as per schedule.
Fst_ate Chicago Pump Comnanv
Councilman H. M. Campbell moved to approve Eetimate No. 2 for the Chicago
Pump Company in the count of $$6,244.00. Councilman Bergeron seconded the motion.

Councilman H. M. Campbell moved to repay the government $1,406.96 which is
a proportionate refund of government loans advanced for projects Nos. 41 —P -1046
and Tax 41 —P -102, these being storm sewer projects. Oouneilman Lusk seconded

Lowell Lnmmers, Architect, informed the council that he and the Fire Station
Committee,had met and made a few changes inihe materials that were stipulated

in the original plans and specifications for the Fire Station and Drill Tower
At No. 2 location. He stated that the revised material requirements would not
affect the buildings in any manner and the low bidder, M. F. Ward & Company,
had been '�-,ontacted concerning the changes. Mr. Ward had met with Mr. Lammers
and agreed to accept the job for $49,766.00. Mr. Lammers recommended that
this bid beNaccepted. Councilman Clayton moved to accept the recommendation
of Mr. fiammers and the Mayor be instructed to enter into a contract tith
M. F. Ward & Company for the construction of a Fire Stationa and Drill-Tower
at a stipulated price of $499766.00. Counc.man Bergeron seconded the motion.

Abolish Eligibility List - Patrolmen
Councilman M. L. Campbell moved to abolish the present eligibility list
of the patrolmen of the Cityof Baytown and ordered the Director of Civil Service
to conduct a new examination and prepare a new eligibility list. Councilman Mears
seconded the motion. The roll call vote was as follows

Resoltition - Transfer of Fonda
The City Manager introduced and read the following resolution:
A RESOLUTION BY THE CITY COUNCIL OF THE CITYOF
BAYTOWN AUTHORIZING THE CITY MANAGER TM TRANSFER
ELEVEN THOUSAND FIVE. HUNDRED SIXTY-EIGHT DOLLARS
AND SIXTEEN CENTS ($11,568.16) FROM THE COUNCIL
CONTINGENT FUNT TO CLASSIFICATION 103 -Y -1, 106 -B-1,
106 -F -6, 301 -D-8 AND 401 -Y -6.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITYOF BAYTCWN:

Appropriation Ordinance
The City Manager introduced and read an ordinance authorizing the transfer
of One Thousand Six Hundred Ninety -Four Dollars and Fifty -Six cents ($1,964.56)
from the Water Fund Unappropriated Surplus to pay for approved water meters,
settings, etc. Councilmen Mears moved to adopt the ordinance as read. Council-

ALSO SIX HUNDRED ($600) DOLLARS FROM THE WATER FUND

Tentative Anoroval — Fair Park Subdivision-- Section
Councilman M. L. Campbell moved to give tentative approval of Fair Park
Section 2, as presented by the developers. Councilman Clayton seconded the
motion. The roll call vote was as follows:

The Council agreed to consider the request of a 40-jrour work week for
the Police Department. This will be done at the budget meeting.
The Mayor appointed a Committee composed of Councilmen Clayton, Mears
and Lusk to check the needs of the Corporation Court, and to make any and
all recommendations deeded advantageous to the operations of a more efficient
department.

Councilman M. L. Campbell moved for the meeting to adjourn. Councilman
Lusk seconded the motion. The ayes were unanimous and the Mayor declared
the meeting adjourned.
