1954 05 05 CC Minutes6641, MINUTES OF THE REGUTAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS May 5, 1954 The City Council of the City of Baytown, Texas met in regular session on Wednesday, May 5, 1954 at 7 :30 P. m. in the Council Room of the Baytown City Hall with the following members in attendance: R. H. Pruett Mayor R. B. Bergeron Councilman W. E. Lawless Councilman P. H. Mears Councilman *Milton L. Campbell Councilman Lacy Lusk Councilman W. D. Reeves Councilman Al Clayton Councilman H. M. Campbell Councilman C. D. Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order and the minutes of the regular meeting of April 29, 1954 were read and approved, whereupon, the following business was transacted: Canvass Election Returns - Resolution The City Council canvassed the election returns of the special election held on April 27, 1954, of terr+hich, the City Manager introduced and read the following resolution: A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 27th DAY OF APRIL, 19521, FOR THE PURPOSE OF EIF,CTING A COUNCILMAN FROM EACH OF THE FOLLOWING DISTRICTS, TO WIT: NOS. 1, to AND 5; DECIARING RESULTS OF SAID ELECTION; FINDING 'THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS DULY AND PROPERLY HEIR AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. WHEREAS, pursuant to Section 96, Article 9 of the Charter of the City of Baytown, the City Council of said city at a regular meeting held on this the 5th day of May, 19542 proceeded as required by law to canvass the returns of the special municipal election held in the City of Baytown on the 27th day of April, 1954, for the purpose of electing a councilman from the following three districts, to wits Nos. 1, 4 and 5; said election having been held under and pursuant to the provisions of the Charter of said city and an ordinance duly passed on the 14th day of April, 1952, calling said election; and WHEREAS, said election having been duly and regularly had and held as called in said ordinance and according to law and the returns thereof having been duly made and the election judges having certified the results of said election as here- inafter set out and the City Council having duly and regularly canvassed the returns of said election and finding that the total votes cast at said election were as follows, to wit: For Councilman from District No. 1: P. H. Mears 411 Votes H. H. Dorris 348 It For Councilman from District No. 4: Wade H. Callam, Jr. 363 " __­,-Milton L. Campbell 404 �t For Councilman from District No. 5: Al Clayton 505 " Walter H. Boucher 258 " 699 and WHEREAS, the City Council of the City of Baytown finds the election returns as set out above to be accurate and correct and no election protest or contest having been filed with said Council or instituted in connection with said election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYrOWN: SECTION 1: THAT P. H. Mears received a majority of the votes cast at said election for the office of Councilman from District No. 1, and accordingly the said P. H. Mears is hereby declared elected to the office of Councilman from District No. 1 of the City of Baytown. SECTION 2s THAT Milton L. Campbell received a majority of the votes cast at said election for the office of Councilman from District No. 4, and accordingly the said Milton L. Campbell is hereby declared elected to the office of Councilman from District No. 4 of the City of Baytown. SECTION 3s THAT Al Clayton received a majority of the votes cast at said election for the office of Councilman from District No. 5, and accordingly the said Al Clayton is hereby declared elected to the office of Councilman from District No. 5 of the City of Baytown. SECTION 4: THAT the City Council of the City of Baytown further finds that the notice of said election was duly and properly given as required by law and as provided in the ordinance calling said election and that said election was duly and regularly held and the returns thereof duly and regularly made by the proper officials of said election, and in all things according to law. INTRODUCED, READ and PASSED by the affirmative vote of a majority of the members of the City Council of the City of Baytown on this the 5th day of May, 1954. /s/ R. H. Campbell Housing Authority Commissioner — Appointment The City Manager introduced and read a certificate of appointment of one commissioner to the Housing Authority Board for the next two (2) years. The commissioner as appointed was Burt J. Davison and his term of office was retro- active to April 18, 1954. Councilman Reeves moved to approve the Certificate of Appointment as presented. Councilman H. M. Campbell seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Pruett Nays: None Councilman Bergeron to Lawless It Lusk It Reeves 01 H. M. Campbell * Councilman M. L. Campbell arrives at the meeting. Oil Drilling Permits Councilman M. L. Campbell moved to approve the drilling application of C. J. Brown on the W, L. Jones lease; waiving the amendment. requiring the use of metal mud tanks and allowing earthern slush pits at this one well as it is located on X63 undeveloped acreage. Councilman Reeves seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Pruett Nays: None Councilman Bergeron " lawless " Lusk " Reeves " M. L. Campbell " H. M. Campbell Petition - Opposing 011 Drilling - Wynnewood Addition C. A. Hansen, resident of lawndale Addition, presented a petition carrying the signatures of 152 property owners of Wynnewood and Lawndale Additions, opposing the drilling for oil or gas in the additions. The petition requested the City Council of Baytown to issue no permits for drilling operations since the drilling permits were flagrant violations of the restrictions of the additions. The petitions further stipulated that the group felt that it was the duty of the City Council to respect the restrictions of the addition and deny the drilling permit applications. The Mayor accepted the petition and informed Mr. Hansen that it would be placed on file as a matter of formal protest from the 152 property owners, however, the City Council could not deny the request of any operator for a drilling permit if the operator met all the requirements of the City's drilling ordinance. Oath of Office - Councilmen The City Attorney administered the Oath of Office to P. H. Mears, Milton L. Campbell and Al Clayton as councilmen from District Nos, 1, 4 and 5, respectively. Mayor Pro tem The Council unanimously approved the appointment of Councilman R. H. Bergeron as Mayor pro tem for the city. He will serve at any and all regular or special meetings of the Council when the Mayor is udable to attend. Miscellaneous The Council acknowledged receipt of a letter from the Goose Creek Odd Fellows Lodge No. 960 which expressed appreciation to the Mayor and Council for the installation of the traffic light at East Texas and Fourth Streets. Councilmen Lusk and Clayton were instructed to check into the recent crossing of Decker Drive with a pipe line extension which was done by breaking the concrete rather than tunneling under same. The City Manager presented a letter which urged the Council to enact an ordinance which would provide a municipal Defense and Relief Committee, Civil. Defense Director and other workers and delegate certain powers to them in times of disaster. Ad jourrment Councilman M. L. Campbell moved that the meeting adjourn.
