1953 09 10 CC Minutes6/7 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS September 10, 1953 The City Council of the City of Baytown, Texas met in regular session on Thursday, September 10, 1953, at 7:30 P. m. in the Council Room of the Baytown City Hall with the following members in attendance: R. H. Pruett Mayor R. B. Bergeron Councilman M. L. Campbell Councilman A. E. Lawless Councilman Lacy Lusk Councilman H. M. Campbell Councilman C. D. Middleton City Manager George Chandler City Attorney Absent: W. D. Reeves Councilman Edna Oliver City Clerk The Mayor called the meeting to order and the minutes of the regular meeting of August 27, 1553 were read and approved, whereunon the following business was transacted: Welfare League - Extension of Lease Mr. Charles Caldwell and Mr. Bill Strickler, representing the Welfare League, asked the Council to consider extending the lease where the Welfare buildings are situated or to make other buitable arrangements with the League. Mayor Pruett appointed a committee consisting of the Director of Public Works Grantham, Councilman Lusk and Councilman H. M. Campbell to study the problems and report back to the Council at the next meeting. Delegation - Briarwood Street Drainage A committee of residents living on Briarwood Street between Fourth and Sunset Streets asked the Council to alleviate the drainage problem adjacent to their homes. The Council requested that the City Manager and Director of Public Works meet with these property owners to try to get an easement running from Briarwood Street to the drainage ditch north of Wynnwood Addition. The Committee will report their results at the next meeting of the Council. Bids - Sewage and Electrical Equipment The sewage and electrical bids were opened and studied by the Council. These were referred to Mr. H. S. Berlin, consulting engineer, for further study. Mr. Berlin was asked to report his recommendations to the Council at its next meeting. Budget Appropriation Ordinance The budget appropriation ordinance for the fiscal year beginning October 1, 1953 and ending September 30, 1954 was studied by the Council. Councilman Bergeron moved the adoption thereof. Councilman H. H. Campbell seconded the motion. Campbell The caption of the ordinance follows: ORDINANCE NO. 198 AN ORDINANCE ADOPTING A EUDGET FOR THE ENSUING FISCAL YEAR BEGINNING OCTOBER 11 1953, AND ENDING SEPTEMBER 30, 1954, IN ACCOM)ANCE WITH THE CHARTER AND ORDINANCESOF THE CITY OF BAYTOWN; AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE. 611 Tax Levy and Tax Rate Ordinance A tax levy and tax rate ordinance was introduced and read by the City Attorney. Councilman M. L. Campbell moved that the ordinance be adopted as read. Councilman Lawless seconded the motion. Campbell The caption of the ordinance follows: ORDINANCE NO. 199 AN ORDINANCE FIXING THE TAX RATE AND TAX LEVY FOR THE CITY OF BAYTOWN, TEXAS, FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 195:, UPON ALL TAXABLE PROPERTY IN SAID CITY OF BAYTOWN, TEXAS, IN CONFORMITY WITH THE LAWS OF TEXAS AND THE CHARTER PROVISIONS AND THE ORDINANCES OF SAID CITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH: Discussion - Personal Property Tax The Council discussed the merits and demerits of the personal property tax exacted by the City of Baytown. It was decided to take no action at the present time. Appropriation OrdinaMN The City Attorney introduced and read an appropriation ordinance. Councilman H. 11. Campbell moved that the ordinance be adopted. Councilman Lawless seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Pruett Nays: None Councilman Bergeron " Lawless "- M. Campbell The caption of the ordinance follows: ORDINANCE NO. 200 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO TRANSFER TWO THOUSAND FIVE HUNDRED TWO DOLLARS AND NINETY CENTS ($2502.90) FROM THE WATER FUND TO CLASSIFICATION 1003 -Z -1, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. City Guy -Wire Encroaching on Private Property The City Manager brought to the attention of the Council the fact that a City guy -wire was encroaching on private property near the intersection of West Main with Market Street. He asked the Council's approval to purchase a pole for $75.00 to alleviate this situation. Councilman Bergeron moved to authorize the City Manager so to do. Campbell Contract - City of Baytown and Houston Lighting & Power Company The City Manager presented a contract w}p rein Houston Lighting & Power Company agreed to furnish electricity to the City Hall for the purpose of operating the newly purchased air conditioning equipment. The contract is the usual type made between the City and the Power Company and is placed on file with the City Clerk. Councilman Lawless moved the execution of such contract and Councilman H. M. Campbell Roof Repairs — City Library Building and Corporation Court Building The City Manager introduced letters from the Downing Roofing Company wherein 17 said company agreed to repair the leaking roof on the City Library Building for $70.00 and repair the leaks on the Corporation Court building roof for an additional $81.00. Councilman Lusk made a motion that the City Manager be authorized to have the Downing Roofing Company perform these repairs for these sums of money. Councilman W. E. Lawless seconded the motion. Campbell Easement Adjacent to Paul Black's Property, East Texas Avenue Mayor Pruett brought to the attention of the Council the is having trouble obtaining an easement from Mr. Paul Black. a committee consisting of the City Manager, Director of Public Attorney to study this problem and report back to the Council Nays: None fact that the City The Mayor appointed gorks and the City at the next meeting. Easement Across Frank Braswell, John Busch Property — Danubina Acres Mayor Pruett informed the Council that the City has sewer lines running through Frank Braswell's and John Busch's property in Danubina Acres and that the City had no easement across this property. He explained that easements could probably be obtained on this property and also told the Council that Frank Braswell was willing to sell the City a tract of property in this area for City purposes. No action was taken on this matter at this time. Application — Oil Permit The City k+anager introduced an application for an oil permit from C. J. Brown. Councilman H. M. Campbell made a motion thar, the same be approved, conditioned on the applicant furnishing the City Attorney with the proper insurance certificates and bond. Councilman Bergeron seconded the motion. Campbell _ Setting of Telephone Hearing Due to the fact that two councilmen would be unable to be present at the telephone hearing if the same were held on September 14, 1953, the Council agreed to postpone the same until 9:00 a. m., September 16, 1953. Purchase of Flashing Stop Signs Councilman M. L. Campbell made a motion that the City Manager buy two stop signs with blinking red lights in the middle thereof, to be placed at the int$rsection of Fayle and North Main Streets.
