1953 04 15 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS April 15, 1953: TheCity Council of the City of Baytown, Texas met in special session on Wednes- day, April 15, 1953 at 7:30 p. M. in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor R. B. Bergeron Councilman W. E. Lawless Councilman M. L. Campbell Councilman R. H. Pruett Councilman W. D. Reeves Councilman H. M. Campbell Councilman C. D. Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order. Canvass Election returns - Resoldtti.on The election returns of the city election, held on April 7th were canvassed, afterwhich, the City Attorney introduced aid read the following resbltuian: A RESOLETION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION HELD WITH THE CITY OF BAYTOWN ON THE 7TH DAY OF APRIL, 1953, FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEN FROK THE RESPECTIVE DISTRICTS NOS. 2, 3, AND 6, AND THE ELECTION OF A MAYOR FROM THE CITY AT LARGE; DECLARING THE EREULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS DULY AND PROPERLY HELD AND TZ RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDNACE WITH THE LAWS OF THE STATE OF TEXAS "WHEREAS, pursuant to Section 96, Article IX of the Charter of the City of Baytown, the City Council of said City at a special meeting held on this 15th day of April, 1953, proceeded as required by law to canbass thereturns of the regular municipal election held in the Cityof Baytown on the 7th day of April, 1953, for the purpose of electing three (3) councilmen from the respecitve districts nos. 2, 3, and 6, and a mayor from the City at large, said election having been held under and pursuant to the provisions of the charter of said city and an ordinance duly passed on the 22nd day of Janyary, 1953, calling said election, and "WHEREAS, said election having beep duly and regularly had and held as called in said erdinance and according to law and the returns thereof having been duly made and the election judges having certified ehe results of said election as hereinefter set out and the city council having duly and regularly canvassed the teturns BB said election and finding that the total votes cast at said election were as follows: to -wit: For Mayor (From City at Large) George M. Talton 455 votes - R. H. (Red) Pruett 1,296 votes C. R. (Cris) Myers 783 votes For Councilman from District No. 2 Louis W. Bains 968 votes R. B. (Rufus) Bergeron 1,477 votes For Councilman from District No. 3: Herbert M. Campbell 1,480 votes W. Audrel Vinson 959 votes For Councilman from District No. 6: Lacy Lusk 2,471 votes "and WHEREAS, the City Council of the City of Baytown finds the election returns as set out above to be accurate and correct and no election protest or con- test having been filed with said ecouncil or instituted in connection with said election, "NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: "Section 1: THAT R. H.(Red) Pruett received a majority of the votes cast at said election for the office of Mayor fromthe city at large and accordingly the said R. H. (Red) Pruett is hereby declared elected to the office of Mayor of the City of Baytown. "Section 2: THAT R. B. (Rufus) Bergeron received a majority of the votes cast at said election for the office of councilman from DiArict No. 2 and according- ly the said R. B. (Rufus) B rgeron is hereby declared elected to the office of councilman from District No. 2 of the City of BAytown. "Section 3: THAT H. M. Lampbell received a majority of the cotes cast at said election for the office of councilman from District No. 3 and accordingly the said H. M. Campbell is hereby declared elected I go the office of councilman from District No. 3 of the City of Baytown. "Section 4: that Lacy Lusk received a majority of thecotes cast at said election for the office of councilman from District No. 6 and accordingly the said Lacy Lusk is hereby deccared elected to the office of councilman from District No. 6 of the City of Baytown. "SECTIONS: THAT, as shown above, no special run -off election is necessary. "Section 6: THAT the City council of the city of Baytown further finds that the notice of said election was duly and aproperly given as required by law and as provided in the ordinance ealling said election and that said election was duly and regularly held and the returns thereof duly and regularly made by theproper officials of said election, and in all things according to law. Campbell Oath of Office Mayor and Councilmen Robert Strickland, Local Attorney, administered the oath of office to R. H. Pruett for the two ensuing years as elected Mayor from the city at large. City Attorney Chandler administered the oath of office to R. B. Bergeron, H. M. Campbell and Lacy Lusk as elected councilmen from districts 2, 3,"and 6, respectively. Mayor Ward expressed his appreciation to the.dity Manager, City Attorney City Clerk, Department Heads and Council for their co- operation during his four (4) years as Mayor of the City of Baytown. He congratulated Mayor Pruett and wished he and the Council success in the future growth and development of the city. Resolution - Honoring Mayor J. A. Ward The'City Attorney introduced and read the following resolution: A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF BAYTOWN FORMALLY RECOGNIZING AND THANKING THE HONORABLE J. A. WARD FOR HIS NUVE YMS IN PML36 WnaE AS OMMSSIONER OF THE CITY OF GOOSE CREEK AND HIS FOUR YEARS AS MAYOR OF THE CITY OF BAYD WN; AND HEREBY RESOLVING THAT THE SAID HONORABLE J. A. WARD HENCEFORTH SHALL BE MAYOR EMERITUS OF THE CITY OF BAYTOWN AS AS SUCH SHALL ALWAYS HAVE A SEAT AT THE COUNCIL TABLE AT AXI'CMCIL MEETINGS OF THE CITY OF BAYTOWN. 4-5'3 "WHEREAS, Honorable S. A. Ward faithfully and conscientiously served as commissioner of the City of Goose Creek for twelve years; and "WHEREAS, he is this day completing four full years as mayor of the City of Baytown; and 'SEAS, the City Council of the City of Baytown desires to formally express its appreciation to Mayor Ward for his sixteen yeats of faithful civic partidipation in the government of the city of Goose Creek and Baytown; NOW, THEREFORE, "BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: "THAT the city of Baytown, by and through its duly elected City Council, hereby formally recognizes and thanks the Honorable J. A. Ward for his sixteen years in public office in greater Baytown and hereby edpressly makes and constitutes J. A. Ward as mayor emeritus of the Cityof Baytown and resolves that Mayor Emeritus J. A. Ward henceforth shall always have a seat at the Council table of the City Council ofo the City of Baytown. Campbell The Council and Department Heads presented Mayor Ward with a Kaywoodie pipe, tobacco, tobacco pouch and five (5) pieces of alligator luggage. Certificate of Appointment - Housing Authority. Commissioners The City Attorney presented the following certificate of appointment of Commis- sions of the Housing Authority of the City ofBaytown: "Pursuant to the provisions of a resolution adopted on the 18th day of April, 1938, by the City Commission of the City of Pelly, now Baytown, Texas, creating a housing authority of the Cityof Pelly and to the provisions of Section 5 of the Housing Authorities Laws of the State of Texas, and by virtue of my office as Mayor of the City of Baytown, Texas, I herebyti.appoint C. HL OLIVE, to serve as commissioner of the Housing Authority of theCity of Baytown, formerly Pelly, ; to serve for a term of two (2) years, 0. C. BEHYN R, to serve for a term of two (k) years, and C. L. THORPE, to serve for a term of one (1) year. "I hereby certify that the above designated commissioners are not city officials nor city employees. "That the appointments and designations hereinabove made are in all things confirmed by the City Council of the City ofBaytown, Texas. Pruett " Councilman Bergeron moved to approve the certificate of appointment of commissioners of the housing authority. Councilman Lawless seconded the motion.
