February 12, 1953
The City Council of the City of Baytown, Texas met in regular session on
Thursday, February 12, 1953 at 7:30 p.m. in the Council Room of the Baytown City
Hall with the following members in attendance:

The Mayor ealled the meeting to order and the minutes of the regular meet -
ing of January 22, 1953 were readrand approved, whereupon, the following busi-
ness was transacted:
W. T. Busch - Wii Ring, North Gaigard
W. T. Busch, representing the Baytown Chamber of Commerce, asked the Council
to give some consideration to the widening of North Gaillard between West Sterling
and West Defeo to permit angle parking on the west side of the Post Office Build-
ing. This plan had recently been endorsed by the Chamber of Commerce due to the
traffic congestion with narrow streets and parallel parking. It was pointed out
that the Postal Department has plenty of land on the North Gaillard side of the
building and it may be possible for the City Officials to secure the right -of-
way to widen the street at this point. Mayor Ward appointed a Cc1mittee composed
of Councilmen M. L. Campbell, Pruett, Lawless, Chief of Police McKee, City Manager
Middleton and Engineer H. S. Berlin to make a complete traffic survey of the dty
and confer with members of the Chamber of Commerce and the Postal Departemnt
regarding such a program.
Water Services - Off Schillings Street
The Council heard the request of C. M. Albright to approve a two (2 ") water
connection extension to a proposed home to be built inthe undeveloped area north
of Bchillings Street between State and Harvard. He proposed to purchase the pipe,
make his oun installation, the adjoining property owner will grant the city an
eastment if the city will allow him to tie-on to the city's water main. The
Council informed him that it would be a direct violation of the city's subdivision
ordinance to allow such procedure on undeveloped property, however, the Mayor
appointed a Committee composed of Councilmen H. M. Campbell, Bergeron, Reeves, Supt.
if Public Works Brantham and City Manager Middleton to work out some solution
to this preplexing problem, if possible.
Zoning Committee Appointed
Mayor Ward appointed a Committee composed of Councilmen M. L. Campbell, Reeves,
Lawless, Attorney George Chandler and City Manager Middleton to study a possible
zoning ordinance for the City of Baytown after H. A. Matthews, 10 Stimpson Street,
was informed that the city had no protection for property owners when unsightly '
buildings are moved on vacant lots in residential areas. City Attorney Chandler
told Mr. Matthews (Mat )the only recourse for him would be A, private suit for
violation of a deed restriction, after which, Mr. Matthews urged the passage of such
an ordinance to protect other citizens in the future.
Stain - Houston Lighting and Power Comaany
W. C. Swain, Division Supervisor of the Houston Lighting and Power Company,
presented the Council with a check in the amount of $13,347.33 which was payment
of two (2%) per cent of the Company's annual gross receipts from the sale of electric
energy to custimers within the City of Baytown for the year, 1952•

Robert Donnelly - Roseland Park Swimming Pool
Robert Donnelly, asked the Council to consider the possibility of providing
facilities at the Itoseland Park Swimming Pool for the summer program of all polio
victims within this area. He explained that the pool would be meeded only one -half
day each week. The Mayor asked Mr. Donnelly to prepare, or have prepared, a
schedule setting forth the hours needed and the Council would take immediate action
upon the request.
Health Nurse
Mrs. Joan Johnson, County Health Nurse for this area, presented the Council
a detailed report of the vafied duties of a Health Nurse. The report consisted
of Communicable disease, maternity services,_child health service, infant hygiene,
pre school hygiene, school health service, adult service and educational classes.
She asked the Council to approve the hiring of an additional nurse to assist her
in her duties. Councilman Reeves moved to authorizs the City Manager to prepare
• transfer ordinance providing funds for the remainder of this fiscal year; hire
• nurse at $220.00 per month with $75.00 per month for car expenses. Councilman
Bergeron sedonded the motion. The roll call vote was as follows:

It was agreed to ask Dr. Farragut, County Health Doctor, to furnish the state's
regular application, handle examination and make recommendations to the City
Manager Before a nurse is hired.
Baytown Insurance Exchange
David Arnett, representing the Baytown Insurance Exchange, asked the Council
to consider making certain amendments to the presen Building Code, pass an
Electrical Ordinance and do all things reasonable educe thepresent fire insurance
key rate levied against the City ofBaytown. To be classed among the No. One (1)
key rate towns the rate would have to be 40¢ per $100.00 insurance coverage
rather that the 46¢ now levied against the City. The Mayor asked the Committee,
Councilman Pruett, Bergeron and Reeves, to make a thorough study of this request
and present a proposal to the Ccincil that will meet the requirements for a No.
One (1) key rate town.
Fire Departmet No. 1
Representatives of the Volunteer Fire Department from Station No. 1, asked
the Council to grant a deed to the Department on the tract of land abutting the
present Fire Station and bounded on either side by the city barn, Nazro Street
and Lee Drive. The Department plans to erect a Recreation Hall at this location
but no Loan Campany will advance m6ney on the proposed building until a died has
been-submitted. The Council instructed the City Attorney to prepare a deed,
with certain stipulated reservAtIons, for Council approval.
Firemen - Station Ng_, _2
Eddie Anderson, spokesman for Volunteer Firemen frcm Station No. 2, requested
some definite action on the erection of a Fire Station for West Baytown. The city
has purchased a tract of land on Market Street with the promise that a new station
will be rercted to house a new fire truck but, as yei, no work has begun on such
a project. The Mayor informed the group that the Council did not approve the plans
on the proposed building as submitted, several months prior because it was the
general opinion that the cost of the proposed building was in excess of the need
at this time. He appointed a Committee composed of Councilman Pruett, Bergeron,
and H. M. Campbell to work with the Volunteer Firemen's Building Committee on
plans for a more moderately priced building.
Lowell Lammers
Lowell Lammers, architect, asked the Council to consider his services in the
preparation of plans for the proposed Fire Station for West Baytown.

Ordinance - Amending Garbage Ordinance
The City Attorney was instructed to read an ordinance amending the city's
garbage ordinance regulating the collection of garbage and refuse within the City
of Baytown to allow a specified type of canvas waver to be used over the cans in
lieu of a tightly- fitted metal cover as provided in the ordinance. Councilman
Bergeron moved to adopt the ordinance as read. Councilman Reeves secoxbd the
motion. The roll call vote was as follows:

Councilman Reeves moved to authorize the installation of five (5) street
lights along Stimpson 'Street and one (1) street light at the Congregational
Methodist ehurch on Causeway Road. Councilman H. M. Campbell seconded the
motion. The roll call vote was as follows:

Harry Levine - Paid Firemen
Harry Levine presented a petition from the fild firemen requesting that
their work -week be designated as seventy -two hours rather than the one hundred
twenty hours now being worked by :hembers offthe paid Fire Department. The
petition was discussed at length and the Council favored hiring two (2) additional
men in the department if available funds could be found to allow such action. The
City Manager was asked to check the budget.
Tranfer Ordinance
The City Manager introduced and readnan ordinance authorizing the transfer of
$1,981.23. from the General Fluid Unappropriated Surplus and the Council Contingent
Fluid to Classification 702 -F -3B and 401 -B62 respectively. Councilman H. M. Camp-
bell moved to adopt the ordinance as read: Councilman Bergeron seconded the

Amendment - Health Ordinance
The City Attorney introduced and read an ordinance amending an ordinance to
promote the health conditions of the City of Baytown by providing a code of sanitaty
regulations on the sale of oysters, clams, scollops and other shell fish which are
sold within the limits of the City of Baytown. Councilman Lawless moved to adopt
the ordinance as read. Councilman Beeves seconded the motion. The roll call vote
was as follows:

Councilman Reeves moved to authorize payment of Brown & Root, Estimate No. 1
on Contract No. 6 of the Waterworks Improvement project in the amount of $6,513.30.

Councilman Reeves moved to authorize the payment of the Layne Texas Company,
Estimate No. 2 on Contract No. .l of the Waterworks Improvement project in the amount
of $4,170.43. Councilman H. M� Campbell seconded the motion. The roll call vote

Councilman H. M. Campbell moved to authorize payment of $10.00 to the South-
western Laboratories on the testing of cylinders on the Waterworks Improvement project.

Councilman Reeves moved to authorize Engineer, J. J. Rady, to advertise for
bids, to be opened at 7:30rp,mm, Tuesday, March 3rd, on Con tract No. 7 of the
Waterworks Improvement project for the construction of power add light wiring
at West James and North 7th Weter.Produetion Plant. Councilman B. M. Campbell
seconded the motion. The roll call vote was as follows: .

Parking Fines - Discussion
Councilman lawless asked Mayor Ward if it would be possible for refunds
to be make to all football season violators of the "No Parking" zone on the vest
side of Lee Drive opposite the college since refunds were made to the violators
during the performance of "Springtime for Henry" on the night of February 6th.
He had been approached by one who had paid a fine under such circumstances and he
wanted the question discussed. After somediseussion Councilman H. M. Campbell
moved to authorize the refund of all parking fines on Lee Drive where the viola-
tion occured within the "No Parking" zone on the west side of Lee Btive on the
curve at Lee college. Councilman lawless seconded the motion. The roll call
vote was as follows:

It was agreed that certain steps will be taken to emphasize the "No Parking"
zone and all violators in the future will be prosecuted.
Middleton - Recreational Council
Councilman Reeves moved to appoint City Manager Middleton as the city's
representative on the Recreation Council. Councilman Bergeron seconded the
motion. The roll call vote was as follows

Miscelleancus
The Council discussed such miscelleanous items as a delinquent personal tax
report being published as outlined in the Charter; investigating the dedication
of a 60 -foot right -of -way known as Tenth Street and open slush pits.

Councilman lawless moved for the meeting to adjourn. Councilman Bergeron
seconded the motion. The ayes were unanimous and thh Mayor declared the
meeting adjourned.
