1952 11 03 CC Minutes'Q Al MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS November 3, 1952 The City Council of the City of Baytown, Texas met in regular session on Monday, November 3, 1952 at 7: 30 P. M. in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor R. B. Bergeron Councilman W. E Lawless Councilman M. L: Campbell Councilman R. H. Pruett Councilman W. D. Reeves Councilman C. D. Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk Absent: H. M. Campbell Councilman The Mayor called the meeting to order and the minutes of the regular meeting of October 21st and the special meeting of October 29th, 1952 were read and approved, whereupon, the following business was transacted: Closina - West Main Street - Protest A delegation of business men fro m West Main Street asked Council assistance in working out a plan, with the State Highway Department, to close West Main Street for the shortest period of time, particularly during this season of the year. The merchants pointed out that the pre - Christmas buying would be curtailed if the road was closed for the next two (2) months, as proposed. After a lengthy discussion it was agreed that a Committee, composed of R. W. Reynolds, Dr. George Bruce and City Manager Middleton, should meet with the State Highway Engineers, in order that this problem may be presented. By so doing it may be possible that the State Highway Department can defer the closing of the road until the pre - Christmas season is over. Transfer Ordinance The City Manager introduced and read an ordinance setting forth certain trans- fers from the Contingent Fund to pay for the Law Library and the retaining of additional legal advise furing the Telephone Suit. Councilman Lawless moved to adopt the ordinance as read. Councilman Reeves seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron Lawless M. L. Campbell Pruett Reeves The caption of the ordinance follows: ORDINANCE NO. 164 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO TRANSFER SIX HUNDRED NINE -TY FOUR DOLLARS AND FIFTY CENTS ($694.50) FROM THE CONTINGENT FUND TO CLASSI- FICATION 106 -Z-15 AND ONE THOUSAND EIGHT HUNDRED DOLLARS ($1,800.00) FROM THE CONTINGENT FUND TO THE CLASSIFICATION 10L, -F -4. It was agreed that the law library would be paid in full out of this fiscal year's budget. The payment to be made as soon as funds are made available. Ordinance Classifying Ciiri1 Service Employees The City Attorney introduced and read an ordinance classifying all positions in the classified service of the City of Baytown, defining terms, providing for records, positions, appeal by the employee, and initestigation of the classification !I plan. It was stipulated that a provision be made for the Fire Marshal, after— which, Councilman Reeves moved to adopt the ordinance as amended. Councilman Bergeron seconded the motion. Campbell " Reeves Pruett The caption of the ordinance follows: ORDINANCE NO. 165 AN ORDINANCE CLASSIFYING ALL POSITIONS IN THE CLASSIFIED SERVICE OF THE CITY OF BAYTOWN; DEFINING CERTAIN TERMS; PROVIDING FOR THE ESTABLISHMENT AND ADOPTION OF THE CLASSI- FICATION PLAN; PROVIDING FOR THE RECORDS OF THE PLAN TO BE MAINTAINED; INTERPRETING THE CLASS SPECIFICATIONS SO ESTAB- LISHED; PROVIDING FOR THE ALLOCATION OF POSITIONS TO THE VARIOUS CLASSES; PROVIDING FOR THE RE— ALLOCATION OF POSITIONS WHEN DUTIES CHANGE; PROVIDING FOR APPEAL BY THE EMPLOYEE; PROVIDING FOR THE STATUS OF PRESENT EMPLOYEES; PROVIDING FOR PERIODIC INVESTIGATION "OF THE CLASSIFICATION PLAN; PROVIDING FOR CLASS CLASSIFICATIONS; PROBIDING A SAVINGS CLAUSE; REPEALING AKK CIBF%UCTUBG IRDUBABCES; PROVIDING FOR AMENDMENTS TO THIS ORDINANCE; LISTING CLASS SPECIFICATIONS1 AND PROVIDING FOR =PUBLICATION AND EFFECTIVE DATE THEREOF. Electrical Contract — EosSland Park The Council tabled action on a revised contract on power furnished the Roseland Park Swimming Pool. The contract will be considered at a later date. Harbers — Wet" System The City Manager presented aproposal, submitted by Finery Harbers, to sell the City of Baytown his privately owned water system at a price of $1,000.00. The 'System is located in the Rio Vista Addition and it services 39 customers, however, the City of Baytown furnishes garbage service to the area. Mr. Harbers had previously offered the water system to the city for $2,500.00 but the Council declined to act upon the proposal at that time. City Manager Middleton was instructed to contact Mr. Harbers and ask that he meet with the Council before final disposition of the offer is made. Water and Sewer Line — Extension — Upon the recommendation of City Manager Middleton, Councilman M. L. Campbell moved to authorize the expenditure of laying an additional 650' of 8" water and sewer lines along East Texas Avenue from 7th Street to Highway 146. Councilman Bergeron seconded the motion.
