1952 09 25 CC MinutesMINUTES OF THE REGULAR MEFTING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS September 25, 1952 The City Council of the City of Baytown, Texas met in regular session on Thursdayp September 25, 1952 at 7:30 P. m. in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor R. B. Bergeron Councilman W. E' Lawless Councilman Milton L. Campbell Councilman R. H. Pruett Councilma n W. D. Reeves Councilman H. M. Campbell Councilman C. D. Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order and the minutes of the regular meet- ing of September 11th were read, whereupon, the following business was trans- acted: Change Meeting Nights - City Council The City Manager contacted the Knights of Phythias and reported that the organization was agreeable to an exchange of meeting dates, therefore, the Council agreed to meet the first and third Tuesday nights of each month through. December, 1952. Budget Ordinance - Fiscal Year 1 The City Attorney introduced and rad an ordinance adopting a budget for the f ensuing fiscal year beginning October 1, 1952 and ending September 30, 1953. Councilman Bergeron moved to adopt the ordinance as read. Councilman M. L. Campbell seconded the motion. Campbell The caption of the ordinance follows: ORDINANCE NO. 156 AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR BEGINNING OCTOBER 1, 1952, AND ENDING SEPTEMBER 30, 1953, IN ACCORDANCE WITH THE CHARTFR AND ORDINANCES OF TH' CITY OF BAYTOWN; AND7PROVIDING FOR THE PUBLICATION OF THIS ORDINANCF. Councilman M. L. Campbell asked that the items,held,in abeyance by the Council during the budget review, be placed on an early agenda so that the Council may make disposition of them at the earliest possible date. Tax Rate Ordinance The City Attorney introduced and read an ordinance fixing the tax rate and tax levy for the City of Baytown for the fiscal year ending September 30, 1959. Councilman Bergeron moved to adopt the ordinance as read. Councilman Pruett seconded the motion. Campbell i7ili X13 The caption of the ordinance follows: CRDINANCF NO. 157 AN ORDINANCF FIXING THE TAX RATF AND TAX LEVY FOR THE CITY OF. BAYTOWN, TEXAS, FOR THE FISCAL YEAR FNDING SEPTEMBER 30, 1952,`/ S 3 UPON ALL TAXABLE PROPERTY IN SAID CITY OF BAYTOWN, TEXAS, IN CONFORMITY WITH THE CRARTFR PROVISIONS AND TH ORDINANCES OF SAID CITY; AND REPEALING ALL ORDINANCES OR PARTS OF CRDINANCES IN CONFLICT HEREWITH. Steuart - Water and Sewer Lines B. A. Stewart, realtor, petitioned the Council to approve the installation of a water and sewer line, on an undedicated easement, one hundred (100') feet or more distance from the nirth side of Schillings Street. He proposed to buy all materials necessary for the installation if the city would furnish labor and equipment to complete therjob. The Mayor.informed Mr. Stewart that theCity Charter would not all the Council to authorize the expenditure of public funds for the development of a privately owned subdivision. In order for the City to take any part in the laying of the water and sewer lines, the easement would have to be dedicated to the city, and this could not be accepted on undeveloped property without directly violating the city's subdivision ordinance. In order to service the two (2) houses now facing Schillings Stteet, Councilman M. L. Campbell suggested that the city cross Schillings 'Street with the service lines and stop before getting onto private property. Councilman H. M. Campbell expressed a willingness to approve the installation of water and sewer lines,in front of the property parallel with Schillings Street provided an easement would be dedicated to the city and sidewalk placed along the edge. After a lengthy discussion the Council asked Mr. Stewart to meet with them again on October 7th. In the meantime the Council would give further study to the request. M. J. Sawyer - Water Line _ M. J. Sawyer, resident of Danubina Acres, petitioned the Council for water service to fourteen (14) residents along Kilgore Read. He explained that the residents had been buying water from a privately owned well but it had gone dry. Councilman Reeves moved to authorize the installation of 2800 feet of 2" water line along the Kilgore Road in order to supply the residents with water. Council- man Pruett seconded the motion. Campbell Transfer Ordinance - Appropriation� The City Attorney introduced and read an ordinance authorizing to make appropriation of $50,744.99 into certain designated funds. Campbell moved to adopt the ordinance as read. Councilman Bergeron motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Wavd Nays: None Councilman Bergeron " Lawless " M. Canpbell " Pruett " Reeves " H. M. Campbell The caption of the ordinance follows: CRDINANCE NO. 158 the City Manager Councilman H.M. seconded the AN ORDINANCE AUTHORIZING THE CITY MANAGER. OF THE CITY OF BAYTOWN TO TRANSFER FIFTY FHOUSAND SEVEN HUNDRFD FORTY -FOUR DOLLARS AND NINELY -NINE CFNTS ($50,$44.99) FROM THE OFNERAL EMERGFNCY FUND, THE UNAPPROPRIATFD SURPLUS TRAFFIC FUND, THE UNAPPROPRIATED SURPLUS WATER FUND AND THE GENERAL FOND UNAPPROPRIATFD SURPLUS TO CERTAIN CLASSIFICATIONS AS SET OUT BELOW. - 11a Repay Government - Proiect No. Tex 41 -P -1045 The City Manager read a letter form the Housing and Home Finance agency requesting repayment of the Government advance of $1,485.00 for planning purposes on Project No. Tex 41 -P- 1045, Waterworks Improvements. Under the terms of the original agreement the full amount of the government advance would be repaid when the work is started on the projects. The City had advertised for bids on a portion of the projects, July 24, 1952. Councilman Reeves moved to authorize the repayment of the loan in the amount of $1,485.00. Councilman H. M.
