1952 01 10 CC MinutesF r MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS January 10, 1952. The City Council of the City of Baytown, Texas met in regular session on Thursday, January 10, 195.2 at 7:30 P. m. in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor M. L. Campbell Councilman R. H. Pruett Councilman W. D. Reeves Councilman H. M. Campbell Councilman C. D. Middleton City Manager George Chandler City Attorney Edna Oliver' City Clerk Absent: R. B. Bergeron Councilman E. W. Buelow Councilman The Mayor called the meeting to order and the xhinutes of the regular meeting of December 13, 1951 were read and approved, whereupon the following business was transacted: Petitions - Miscelleanous C. D. Little, local attorney, presented a petition from the Baytown Police Department asking the Council to place the department under Civil Service. He stated that the 52nd legislature last year amended a law calling for elections on adoption of Civil Service of police and fire departments in cities with more than 10,000 population. If the Council should favorably consider such a plan, the election could be held in conjunction with the regular city election in April. A petition was presented from residents of Busch Terrace subdivision, ask- ing for better drainage facilities in the area. The Council promised immediate action on the cleaning of ditches in that area. Members of the Student Council from Horace Mann Junior High School petitioned the Council to install concrete pipe in the ditch along side the school. Supt. of Public Works Grantham informed the Council that he had made a study of this situation and it would take approximately 485 feet of 36" cement tile to properly drain the ditch. Councilman Pruett moved to authorize the purchase of necessary tile to make the proper installation; work to beginaas soon as possible. Council- man M. L. Campbell seconded the motion. L. Campbell moved to purchase the two (2)rpbliceecAms from Higginbotham Motor Company at.a cost of $2,720.74. Councilman Reeves seconded the motion. Campbell moved to purchase the car for the City Manager from Higginbotham Motor Company at a cost of $1,527.51: Councilman Reeves seconded the motion. Campbell Ordinance — Amending Oil Drilling Ordinance The City Attorney introduced and read an ordinance amending an ordinance licensing the drilling of oil and gas wells within the corporate limits of the City of Baytown by including a provision making it unlawful to remove any casing from any well and making it mandatory for any well to be completed or abandoned within 45 days and the premises restored to its prior condition. Councilman M. L. Campbell moved to consider amdndment "X" (casings) and table amendment "Y" (Well Completion) for further investigation. The proposed amendment was opened for discussion. The Council heard Mr. Farnsworth and Jimmy Eubanks of the Eddy Refining Company, afterwhich, CouncilmanM. L. Campbell moved to adopt amend- ment "X" which amendment made It unlawful to remove any casing from any well. Councilman Pruett seconded the.mot1on. The roll call vote was as follows: . The caption of the ordinance follows: ORDINANCE NO. 133 AN ORDINANCE AMENDING "AN.ORDINANCE LICENSING THE DRILL- ING OF OIL AND GAS WELLS WITHIN THE CORPORATE LIMITS OF THE CITY OF BAYTOWN, TEXAS; REGULATING THE DRILLING AND OPERATION OF SUCH WELLS WITHIN THE CITY; REPEALING ORDI- NANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED Q$200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF ", BEING ORDINANCE NO. 120 PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 10TH DAY OF JULY, 1 19511BY ADDING TO SECTION 11 THEREOF ONE ADDITIONAL PROVI- SION2 SAID PROVISION MAKING IT UNLAWFUL TO REMOVE ANY CASING FROM ANY WELL, SAID ADDITIONAL PROVISION SHALL BE KNOWN AS "(X) ", AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. Waterwell Repair Bids Bids on the repair of water well.in South Baytown were opened and they .are tabulated as follows: Layne— Texas Company $ 11595.00 Texas Water Wells $ 12517.00 Less $200.00 for the Peerless bowl assembly, plus any additional parts billed at cost plus 15% and 15 %. Turbine Pump Service $ 21709.10 After much discussion Councilman H. M. Campbell moved to table all bids; to instruct the City Manager to notify Texas Water Well Company to pull well and bring necessary equipment to do complete repair job, including new bowls, if necessary. This work to be done under the supervision of the City Manager and Superintendent of Public Works. Councilman Pruett seconded the Ootion. Campbell Bench Contract The City Attorney introduced and read a proposed contract between the City of Baytown and the Courtesy Bench Advertising Company for the placing of benches'in various bus stops and other convenient locations within the City of Baytown. The contract was discussed at length and several amendments were made, afterwhich, Councilman H. M. Campbell moved to accept the contract as amended. Councilman Reeves seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman M. L. Campbell " Pruett " Reeves " H. M. Campbell Councilman H. M. Campbell excused himself from the meeting. Rady — Services Street Improvements The City Manager presented a statement from J. J. Rady Engineering firm on engineering services rendered the city in the preparation of all necessary data for the street portion of the recnet bond issue. The services included the field work, preparation of master paving plan, meetings with the street committee and council and preparation of estimate of construction costs for city and property owners. The total amount was $946.89. Councilman Pruett moved to instruct the City Manager to pay the engineering fees due the J. J. Rady Engineering Company; funds to be taken from the Traffic Improvement Fund. Councilman M. L. Campbell seconded the motion. Campbell " Pruett " Reeves Drilling Application Councilman Pruett moved to approve the drilling application of Goodwin and Cooke on the G. L. Allen Lease, Well No, 1, Councilman Reeves seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman M. L. Campbell " Reeves " Pruett AdJournment After a discussion of several items Councilman Pruett moved to adjourn. Councilman M. L. eampbell seconded the motion.
