1951 12 13 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXSS December 13, 1951 The City Council of the City of Baytown, Texas met in regular session on Thursday, December 13, 1951 at 7:30 P. M. in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor • R. B. Bergeron Councilman E. W. Buelow Councilman Milton L. Campbell Councilman R. H. Pruett Councilman • W. D. Reeves Councilman • H. M. Campbell Councilman' C. D. Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order and the minutes of the regular meeting of November 28, 1951 were read and approved, whereupon the following business was transacted: Hearing -,-City Improvements The Council again reviewed the need of certain Sanitary Sewer Improvements for the City of Baytown at a hearing with D. F. Smallhorst, of the State Health Department and W. J. Cutbirth, of the Game & Fish Commission as speakers. From a health standpoint, the disposal plants were listed as being far below efficiency, the only plant carrying a high grade being the East James plant with a 94.8% effi- ciency. The Game and Fish Commission had received numerous complaints on the pollution found in the bay waters and, although none of the complaints had been directly traced to the City of Baytown, it was noted that, because of the inade- quate sewage disposal facilities, a portion of this could be attributed to the- - City of Baytown. It was suggested that the proposed bond issues be re- submitted to the Baytown voters and an educational program be arranged in order that the citizens may be enlightened on the urgent need of such proposed improvements. Lawndell Section 3 - Final Approval A plat of Lawndell Subdivision, Section 3 was submitted for final approval.. After some discussion Councilman Pruett moved to give final approval of Section 3 provided wing walls on each of the bridges be extended to the back of the curbs of the slabs at approximately top of pavement elevation, (2) Rails be installed blocking end of the side walk on seventh street where subdivision ends and (3) Ditches of 4th street be graded for better drainage. Campball Berlin - elf Street Xr nsion Plans and specifications on the opening of Gulf Street Extension, from S. Whiting to Robert E. Lee Drive, were presented by Mr. Berlin, engineer. After some discussion Councilman Bergeron moved to approve the plans and specifications as presented and to proceed with the extension of West Gulf, from S. Whiting to Robert E. Lee Drive; Funds for the project to be taken from the Traffic Improve - ment Fund. Councilman M. L. Campbell seconded the motion. Campbell Parking Penalties - Commerce Street, Saturday. December 15 Councilman Pruett moved to omit perking meter regulations on Commerce Street for all day,Saturday, December 15, 1951 in order to provide parking space for football fans desiring to take train for-Dallas. Campbell' Ordinance No. 131 - Amending Traffic Ordinance The City Attorney introduced and read an ordinance relating to traffic and regulating the use of the streets and highways of the City of Baytown and creat- ing parking zones and providing for penalties on violation. Councilman H. M. Campbell moved to adopt the ordinance as read. Councilman Bergeron seconded the motion. Campbell The caption of the ordinance follows: ORDINANCE NO. 131 AN ORDINANCE RELATING TO TRAFFIC AND REGULATING THE USE OF THE STREETS AND HIGHWAYS OF THE CITY OF BAYTOWN, TEXAS; CREATING AND DEFINING PARKING METER ZONES; DEFINING AND PROVIDING FOR THE INSTALLATION OPERATION AND MAINTENANCE OF PARKING METERS AND PRESCRIBING PARKING TIME; REQUIRING DEPOSIT OF COINS FOR THE USE OF PARKING METERS AND PARK- ING METER ZONES AND PROVIDING FOR THE COLLECTION AND DISPOSITION OF SUCH COINS; REPEALING CONFLICTING ORDI- NANCES; PROVIDING FOR THE ENFORCEMENT THEREOF; DEFINING OFFENSES AND PRESCRIBING PENALTIES; AND PROVIDING THAT IN- VALIDITY OF PART SHALL NOT AFFFECT THE VALIDITY OF THE REMAINDER. Shrub Ordinance No. 132 The proposed Shrub Ordinance was disa,isses at length. City Attorney Chandler introduced and read the ordinance with certain Amendments. Councilman M. L. Campbell moved to adopt the ordinance as amended. Councilman Bergeron seconded the motion. Campbell The caption of the ordinance followsz ORDINANCE NO. 132 AN ORDINANCE PRESCRIBING THE MINIMUM OVERHEAD CLEARANCE OF ALL TREES, SHRUBS, VINES, PALMS AND SIMILAR PLANTS OF EVERY DESCRIPTION OVERHANGING ANY STREET OR SIDEWALK IN THE CITY OF BAYTOWN; PRESCRIBING THE MINIMUM DISTANCE THAT SUCH TREES, SHRUBS, VINES, PALMS, ETC MAY BE GROWN FROM THE CORNER OF ANY BLOCK IN SAID CITY BETWEEN THE SIDEWALK AND THE CURB; PRESCRIBING THE MINIMUM DISTANCE THAT TREES, SHRUBS, VINES, PALMS ETC MAY BE GROWN, PLANTED OR CULTIVATED FROM ANY CURB LIN OF ANY STREET; DECLARING THAT TREES, SHRUBS, VINES, PALMS,. AND ALL SIMILAR PLANTS OF EMY DESCRIPTION PLANTED, GROWN OR CULTIVATED ALONG ANY SIDEWALK OR PUBLIC WAY IN THE CITY OF RAYTOWN, EXCEPT AS PROVIDED HEREIN'; TO BE UNLAWFUL; REPEALING ORDINANCE INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIM PENALTY OF TWO HUNDRED ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Purchase Pads --City Jail Councilman Reeves moved to authorize the City Manager to purchase, from the lowest bidder, sixteen (16)-30" x 74!' pads for the bunks at the City Jail. Councilman M. L.
