October 3, 1951
The City Council of the City of Baytown, Texas, met in special session on
Wednesdzy, October 3, 1951 at 7:30 P. m. in the Council Room of the Baytown
City Hall with the following members in attendance:

The Mayor called the meeting to order, and the following business was
transacted:
Resolution - Canvassing Election
The City Attorney introduced and read the following resolution:
RESOLUTION
A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL
MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN
ON THE 22ND DAY OF SEPTEMBER, 1951, FOR THE PURPOSE
OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF
BAYTCWN, FOR ADOPTION OR REJECTION, SEVEN PROPOSED
AMENDMENTS TO THE EXISTING CHARTER OF THE CITY OF
BAYTOWN; DECLARING THE RESULTS OF RAID ELECTION; FIND
ING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY
GIVEN; THAT SAID ELECTION WAS DULY AND PROPERLY HELD
AND THAT THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS
IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS.
WHEREAS, pursuant to Section 96, Article IX of the Charter of the City
of Baytown, the City Council of said city at a special meeting held onthis
the 3rd day of October, 1951, proceeded as required by law to canvass the re-
turns of the special municipal election held in the City of Baytown on the
22nd day of September, 1951, for the purpose of submitting seven amendments to
the existing Charter of the City of Baytwm and said election having been held
under and pursuant to the provisions of the Charter of said City, the laws of
the State of Texas and an Ordinance duly passed on the 28th day of June, 1951,
calling said election, and
"WHEREAS, said election having been duly and regularly had and held as
called in said Ordinance and according to law, and th a returns thereof having
been duly made and the election judges having certified the results of said
election as hereinafter set out and the City Council having duly and regularly
canvassed the returns of said election and finding that the total votes cast
at said election were as follows, to -wit:

"WHEREAS, the City Council of the City of Baytown finds the election re-
turns as set out above to be accurate and correct and no election protest or
coubwe "Yl g oeen filed with said council or instituted in connection with
said election.
"NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
"Section 1: THAT, as shown above, each and all of the seven proposed
amendments failed to receive a majority of the votes cast, and, as a consequence,
they are hereby deemed to be ineffective.
"Section 21 THAT the City Council of the City of Baytown further finds
that the notice of said election was duly and properly given as required by law
and as provided in the Ordinance calling said election and that said election
was duly and regularly held and the returns thereof duly and regularly made by
the proper officials of said election, and in all things according to law.
^INTRODUCED, READ and PASSED by the affirmative vote of a majority
of the memebers of the City Council of the City of Baytown, this the 3rd day
of October, 1951. '

Councilman Pruett moved to adopt the resolution as read-*' Councilman
Bergeron seconded the motion. The roll call vote was as follows:

Councilman Bergeron moved to approve the Allen A. Barton applicationson
the Sam Davis Lease, Well No. 1. Councilman H. M. Campbell seconded the
motion. The roll call vote was as follows:

Cancellation Contract - City of Baytown - Missouri- Racific Railroad
Councilman H. M. Campbell moved to approve the cancellation of a street right -
of -way co����n����ct between the City of Baytown and the Missouri - Pacific Railroad.
lma or,bit'the right -of -way hadi been included in Robert E. Lee Drive and there
be no further need of a contract. Councilman Bergeron seconded the
motion. The roll call vote was as follows:

Health Officer - Appointment
The City Manager presented a letter from the State Health Department requestin g
the appointment of a City Health Officer for the years 1952 -53• At present
Dr. L. W. Crossman is serving as City Health Officer, however, his:�term of
appointment expires on October 4, 1951 and theCity will be without a Health
Officer unless an appointment is made immediately, Owing to the fact that
a full council was not present, Councilman M. L. Campbell moved that no action
be taken on the request until a full council is present.
Adiournemt
Councilmann Pruett moved to adjourn. Councilman Bergeron seconded the
motion. The ayes were unanimous and the Mayor declared the meeting adjourned.
