1951 06 28 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS June 28, 1951 The City Council of the City of Baytown, Texas, met in regular session on lhursday, June 28, 1951 at 7:30 P. m. in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward R. B. Bergeron E. W. Buelow R. H Pruett W, D: Reeves H. M. Campbell C. D. Middleton George Chandler Edna Oliver Absent: Milton L. Campbell Mayor Councilman Councilman Councilman Councilman Councilman City Manager City Attorney City Clerk Councilman The Mayor called the meeting to order, and the minutes of the regular meet- ing of June 14, 1951 and the special meeting of June 15, 1951 were read and approved, whereupon the following business was transacteds Light Committee Report Councilman Buelow moved to accept the recommendation of theLight Committee on the placing of the 32 free lights, by the Houston Lighting and Power Company, as per agreement dated March 30, 1951. The recommended locations are as follows: One (1) in alley at Illinois and Huggins ONe 1 in alley near St. Mark's Methodist Church One (1) in alley corner of Carnegie Street One (1) at St John's Methodist Church on Highway 146 One (1) on Park Avenue Five (5) for business section of Old Baytown Five (5) for business section of Oil Polly One (1) corner of Robert E. Lee Gymnasium at Market Street One (1) at intersectio;j of South Pruett and Neal Street One (1) at Highway 116 and Davis ibad One 1) in 600 Block of West Sterling — Memorial Baptist Church site Five (5) at Roseland Park Five (5) on Robert E. Campbell Pay Mark Carter Councilman Pruett moved to pay Mark:iCarter court costs on the case of Ben Sledge vs City of Pelly and $100100 on the case of Cynthia Edgeworth vs City of Pelly and W. C. Williams. The City Commission of the City of Pelly had agreed to pay Mr. Carter a fee of $200.00 as assista{)t to the City Attorney in the case of Cynthia Edgeworth vs City of Pelly. One Hundred Dollars ($100.00) was paid at the time the agreement was made in 1943 and the balance to be paid'upon final disposition of the suit. The Supreme Court recently denied a rehearing of the case after a lapse of eight (8) years. Councilman Bergeron seconded the motion. Campbell 7 1 Smoking Ordinance The proposed smoking ordinance relating to persons smoking in hotelss rooming houses, tourist courts or other places renting rooms was discussed at length. Coun- cilman Buelow moved to teject the ordinance, however, Councilman Reeves asked that the ordinance be tabled. Councilman Buelow withdraw his motion and Councilman Reeves moved to table the present ordinance and instruct Fire Marshal Bounds and Fire Chief Lintelman to rewrite the ordinance and present at a later date. Campbell Junk Dealer's Ordinance Copies of an ordinance regulating the operations and keeping of Junk Yards within the City limits were passed out to the Council for study. Drilling Permits - Approved Councilman Bergeron moved to approve the drilling application of the Conroe Well Service on the Joseph Armata Well No. 2, Subject to the latest recommendations of the Rail Road Commission on the protection of water sands. Campbell moved to approve the Potter and Hansbro application on the Bussey- Mcdain, Lease, Well No. 1, subject to the latest recommendations of the Rail Road Commission on the protection of water sands. Campbell Councilman Reeves moved to approve the J. J. Broadus Drilling application on the A. G. BArber Lease, Well No. 1, subject to the latest recommendations of the Rail Road Bommission on the protection of the water sands. Councilman Bergeron seconded the motion. Reasor's applications on the L. F. McFarland, Goose Creek Independent School, No. 15 and E. C. Dugat leases, sub- ject to the latest recommendations of the Rail Road Commission on the protection of the water sands. Councilman Reeves seconded the motion. Campbell 396 Ordinance - Charter Amendments The proposed charter amendments were reviewed. The Mayor asked if any present would like to be heard regarding the amendments. C. Q. Alexander, local businessman, present (kd his views, as a tax -payer and resident of the City of Baytown, by urging the Council to consider the:presentation of a new charter for the city rather than an amendment of the present charter. After the;,hegving the City Attorney introduced and read an ordinance. ordering an election in the City of Baytown for the purpose of submitting to the qualified voters of the City of Baytown certain amendments to the existing charter. Councilman Reeves moved to adopt the ordinance as read. Councilman Bergeron seconded the motion. The roll call vote was as follows: Poll Calls Ayess Mayor Ward .. Campbell The caption of the ordinance follows: ORDINANCE NO. 119 AN CRDI14ANCE ORDERING AN ELECTION IN THE CITY OF BAYTOWN$ TEXAS, TO BE HELD ON THE 22ND DAY OF SEPTEMBER, 1951$ FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF BAYTCWN, FOR ADOPTION OR REJECTION, CERTAIN PRO- POSED AMENDMENTS TO THE EXISTING CHARTER OF THE CITY OF BAYTOWN, DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION, APPOINTING THE ELECTION OFFICIALS THEREOF, PRE- SCRIBING THE HOURS OF SAID ELECTION AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE OF SAID ELECTION. Street Paving Project Final approval of the proposed street paving recommendations, to be included in the proposed Bond Issue, was deferred until Monday, July 2nd. Vacation Policy Councilman Reeves moved to adopt the following resolutions RES OLUT ION A POLICY DIRECTING THE VACATION POLICY FOR THE CITY OF BAYTOWN ON AND AFTER JANUARY 11, 1951 "WHEREAS, in order to have a clear• understanding of the policy of the city of Baytown concerning vacations for employees and credit allowed in case an em- ployee separates from the city either voluntarily or involuntarilysNON, THEREFORE, "BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTO114: " THAT $his rule is retroactive to January 1, 1951, and shall include only those who have separated from the City since 12 :01 A.M., January 1, 1951. "Section 1: THAT an employee shall be eligible for twelve (12) wiork- ing days vacation at the completion of one year service on the basgs of one day for each month's service, however, no vacation credit will be allowed unless and until at least one year of service has.been completed. uSection 2s THAT an employee who becomes separated from the City shall have vacation credit at the rate of one day for each month's service accumulated since his last full year of service. uSection 3s THAT fto employee shall be allowed to accumUtte more than twelve (12) days for any one vacation. "Section 4s THAT every employee shall take his vacation before the end of the fiscal year in which his vacation comes due unless authorized nat to do so by the City Manager, and only then when it works hardship on the City or the employee or unless there is not enough tibe :within the fiscal year for the employee to take his vacation.
