The City Council of the City of Baytown, Texas, met in regular session on
Thursday, June 14, 1951 at 6so'clock p.m. in the Council Room of the Baytown City
Hall with the following members in attendances

The Mayor called the meeting to order and the minutes of the regular meeting
of May 24, 1951 and the special meeting of June 4, 1951 were read and approved,
whereupon the following business was transacteds
Resolution - Time Deposit
The City Attorney introduced and read the following resolutions
RESOLUTION -
. A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER OF
THE CITY OF BAYTOWN TO DEPOSIT, FOR A MINIMUM PERIOD OF ONE
HUNDRED TWENTY (120) DAYS, THIRTY -THREE THOUSAND, THREE
HUNDRED NINETY ONE DOLLARS AND FORTY -NINE CENTS ($33,391.49)
IN THE OFFICIAL DEPOSITORY OF THE CITY OF BAYTOWN
"BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTO'NNs
"THAT the City Manager of the City of Baytown is hereby authorized and directed
to deposit Thirty -Three Thousand, Three Hundred Ninety -One Dollars and Fbrty -Nine
a nts'(033s391.49) in the official depository of the City of Baytdwn, said sum to
be placed in time deposit account for a minimum period of one hundred twenty (120)
days.

Councilman M. L. Campbell moved to adopt the resolution as read. Councilman

Creger - Petition
Mr. H. S. Creger, local businessman, presented a petition, with approximately
signers, requesting the Council to consider passage of an ordinance making it a

misdemeanor for anyone to smoke in bed in any public hotel, rooming- house, apart-
ment - house, motel or tourist - courts in the corporate limits of the City of Bay-
town. Councilman Reeves moved to-table action on the proposed smoking ordinance
until a later date. Councilman H. M. Campbell seconded the motion. The roll call

Strickland - Water Line - Schillings Acreage
Robert Strickland, Local Attorney, representing two clients, C. S. Barnett and
Mrs. Dora Dodd, asked permission to tap onto the city's water main at the owner's
expense. The houses were located in the Schillings Acreage Tract on the north
side of Schillings Street, and each owner had been informed by the Building- Inspection
Department of the city, that he would be unable to secure water from the city ow-
ing to the fact that the acreage had not been developed bu.0 was being sold by metes
and bounds. After much discussion, Councilman Reeves moved to allow the owners,
C. S. Barnett and Mrs. Dora Dodd, to install, at their expense, a minimum size
water line across Schillings Street and tap onto city's main, under the direct
supervision of Supt. of Public Works, Grantham. Councilman Bergeron seconded the
motion. The roll call vote was as follows=

Councilman Reeves moved to request City Attorney Chandler, assisted by C. W.
Grantham, to investigate the possibility of a violation of the subdivision ordi-
nance, by Stewart and Bailey, in the handling and selling of property by metes
and bounds on the north side of Schillings Street. Councilman Bergeron seconded
the motion. The roll call vote was as followss

Drilling Ordinance
Copies of a revised oil and gas drilling ordinance were presented to the
Council. The revised ordinance required operators to set surface casing to a
minimum depth of twelve hundred feet in order that the two water sands may be
protected and it forbade the erection of battery tanks within 150 feet of any
building, public thoroughfare.or well. A protest was made against the amount
of surface casing required and it was asked if multi -stage cementing could not
be used as it was less expensive and would protect water sands. After a lengthy
discussion, Councilman H. M. Campbell moved that pending final action on the pro-
posed Drilling Ordinance, no further drilling applications will be considered by
the City Council unless such applications are accompanied by signed agreement to
protect the water sands in accordance with the water Committeers recommendation.

Councilman H. M. Campbell moved to table the proposed drilling ordinance at
this tire and send City Manager Middleton to Austin to meet with Railroad Commis-
sion regarding the surface casing requirements in this area and the multi -stage
cementing proposal. Councilman Reeves seconded the motion. The roll call vote

Drilling - Application - H. A. Potter - Hansbro
Attorney Erwin Flowers asked the Council to consider the drilling application
of Potter and Hansbro on the Trifon 1 - "A" Lease. In order to get the permit ap-
proved, he consented to sign an agreement to comply with the requirements as set
forth by the Water Committee. Councilman Reeves moved to give approval of the
drilling application, provided the representative will deliver to City Manager
Middleton, before drilling operations.begin, a written statement agreeing to abide
by the recommendations of the Water Committee with reference to the setting of
surface casing for the protection of the water sands. Councilman Bergeron seconded
the motion. The roll call vote was as follows-

Battery Tanks
Ervin Flowers, representing G. L. Reasor, asked the Council to re- consider it's
decision of June hth regarding the moving of battery tanks on Travis Street. He
told the council that he was not aware of any objections to the location of the
battery tanks until he had received a letter from the City Manager instructing the
company to remove the tanks. This would incur considerable expense to the company
and too, land was not available for the erection of battery tanks. The Council in-
formed Mr. Flowers that the City Ordinance had been violated when the tanks were
placed at this location and no fire wall had been installed although the tanks had
been there for several days. Too, the tanks were too close to a residential section.
After much discussion, Mayor Ward appointed a committee composed of Councilman Buelow,
H. M. Campbell, Reeves, City Attorney Chandler, City Manager Middleton and Supt. of
Public Works Grantham to meet at 4 00 P.M. Friday, June 15th and prepare recommenda-
tions in order that a compromise might be reached between the City and the Company
at a special meeting to be held at 6100 P.M. June 15th.
Roller Bids - Opened
The bids on the street roller were opened and they are tabulated as follows.

R. B. Everett Company Fergerson 3 -5 Ton Tandem 3,874.00
Councilman Reeves moved to reject all bids and re-advertise due to the fact that
the rollers listed in the bids were too small for the city's requirements. Council-
man M. L. Campbell seconded the motion. The roll call was as followss

Petition - Parking Meters - Business Section "Pelly"
A petition, undersigned oy Businessmen of Pelly, was presented asking the Council
to remove the parking meters that are standing on two (2) blocks of West Main. Council-
man Reeves moved that a study be made of the parking meter situation in the business
district of former "Pelly" and "Old Baytown" before action is taken on the request.
Councilman Buelow seconded the motion. The roll call vote was as followss

Petition — Fire Station Site
Petitions were presented to the Council by Mrs. J. A. Snyder, Mrs. Wayland
Spear and Mrs. L. L. Hallman protesting the construction and operation of a Fire
Station on Block 34 of East Baytown. Representatives from the No. 2 Fire Station
were present and the problem was discussed at.length. No action was taken by the
Council.
Adjournment
Councilman Reeves moved to adjourn. Councilman M. Campbell seconded the mo-
tion. The ayes were unanimous and the Mayor declared the meeting adjourned.
