1951 04 11 CC Minutes, SpecialMINUTES OF THE SPECIAL ME -ETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS April 11,.1951 The City Council of the City of Baytown, Texas met in special session on Wednesday, April 11, 1951 at 700 po m..in the Council Room of the Baytown City Hall with the following members in attendance: J. Darwin Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, and the minutes of the regular meeting of March 229 1951 and the special meetings of March 30, 1951 and April 7, 1951 were read and a pproved, whereupon the following business was transacted: Canvass Election Returns :The returns of the general municipal election were canvassed by the Council, afterwhich, the City Attorney introduced and read the,following resolution: RESOLUTION A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 3RD DAY OF APRIL, 1951, FOR THE PURPOSE OF ELECTING THREE(3) COUNCILMEN FROM THE RESPECTIVE DISTRCITS NOS. 2, 39 AND 6 9.1AND THE ELEC- TION OF A MAYOR FROM.19HE CITY AT LARGE; DECLARING THE RESULTS OE SAID ELECTION; FINDING THAT NOTICE OF SAIDD.IELECTION WAS DULY AND PROPERLY HELD AND THE RETURNS THEREQF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. "W.gEREAS, pursuant to Section 96, Article IX of the Charter of the City of Baytown, the City Council of said City.at a special meeting held on this llth day of April, 1951) proceeded as required by law to canvass the returns of the regular municipal election held in the Cit of Baytown-on the 3rd day of April, 1951, for the purpose of electing three councilmen from the respective districts nos. 2, 3, and 61 and a mayor from the City at large, said Election having been held under and pursuant to the provisions of the charter of said city and an ordi- nance duly passed on the 2 5th day of January, 1951, calling said election, and IIWHEREAS, said election having been duly and regularly had and held as called in said ordinance and according to law and the returns thereof having been duly made and the election judges having certified the results of said election as hereinafter set out and the city council having duly and regularly canvassed the returns of said election and finding that the total votes cast at said election were as follows: to -wit: "For Mayor (From City at Large) "J. Winston Hayes, Jr 339 Votes "and, WHEREAS, the City Council of the City of Baytown rinds the election returns as set out above to be accurate and correct and no election protest or contest having been filed with said council or instituted in connection wito said election, "NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTO'NN: "Section 1. THAT J. A. (Jack) Ward received a majority of the votes cast at said election for the office of Mayor from the City at large and accordingly the said J. A. (Jack) Ward is hereby declared elected to the office of Mayor of the City of Baytown. "Section 2. THAT A. B. (Rufus) Bergeron received a majority of the votes cast at said election for the office of councilman from District No. 21 and accord- ingly the said R. B. (Rufus) Bergeron is hereby declared elected to the office of councilman from District No. 2 of the City of Baytown. "Section 3. THAT H. M. Campbell received a majority of the votes cast at said election for the office of councilman from District No. 3 and accordingly the said H. M. Campbell is hereby declared elected to the office of councilman from District No. 3 of the City of Baytown. "Section 4. THAT R. H. (Red) Pruett received a majority of the votes cast at said election for the office of councilman from District No. 4 and accord- ingly the said R. H (Red) Pruett is hereby declared elected to the office of councilman from District No,-6 of the City of Baytown. "Section 5. THAT, as shown above, no special run -dff election is necessary. "Section 6. THAT the City Council of the City of Baytown further finds J that the notice of said election was duly and properly Biven as required by law and as provided in theordinance calling said election and that said election eras_ duly and regularly held and the returns thereof duly and regularly made.by the ppoper officials of said election, and in all things according to law. H..Olive administered the oath of office to Mayor J. A. Ward and- Council- men Bergeron,z:ftuett and Campbell for the two (2) ensuing years as elected Mayor from the city at large and Councilmen from Districts 2, 3, and 6 resp ectively. At this point Councilman Williams congratulated the successful candidates and surreadeded his place to H. M. Campbell. Q. L. Reasor Drilling Applications. Councilman Reeves moved to approve the drilling applications of G. L. Reasor on the Jones Estate, Well No. 2 and the W. L. Jones, et al, Well No. 2. Councilman Pruett seconded the motion. Campbell Wilcox - Application Bessie Trifon Councilman Buelow moved to approve the drilling application of the Wilcox Investment Company on the Bessie Trifon Lease, Well No. 1. Reeves ...:�H 1Campbell Condemnation Proceedings - Trifon Ditch It had been brought to the attention of the Council recently that the natural drainage ditch through Mrs. Bessie Trifon's property on West Texas Avenue was being filled with loose concrete by the owner in an effort to close the drain- age. The Harris County Flood Control had made several attempts to negotiate with Mrs. Trifon for an easement but it had been unsuccessful in each instance. Inas- much as every effort had been made by the County to deal with the owners of said property to no avail. Councilman Buelow moved that the.city.file condemnation proceedings against the owner owing to the factthat the ditch -is- a natural drain.. - age outlet. The.City Manager was hereby instructed to obtain the 'necessary metes and bounds meeded forthe particular location and proceed,with'6'6hdemnation pro- ceedings as there is an immediate need of the ditch for drainage purposes. Campbell Butane Ordinance No. 115 City Attorney Chandler introduced and read an ordinance regulating the carrying -.of gasoline and other liquified petroleum or natural gas products on any street or alley in the city.of Baytown. Councilman Buelow moved to.adopt the ordinance as read. Councilman Reeves seconded the motion. Proposed Smoking Ordinance Copies of a proposed ordinance controlling smoking in tourist courts, hotels, and rooming houses were submitted to the Council for study. Appointment - Housing; Authority Commissioners Councilman Bergeron moved to approve the appointment of C. H, Olive, 0, C. Behymer and C. L. Thorpe as Commissioners to the Housing Authority Board for the next two (2) years. Councilman M. L. Campbell seconded the motion. Campbell Councilman Reeves moved to approve an ordinance instructing the City Manager to transfer $19375.00 from the General Fund to Classification 103-A-2 to allow an increase in salary of the Corporation Court Clerk, Councilman Bergeron seconded the motion. Campbell The caption of the ordinance follows: ORDINANCE NO. 116 AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THL CITY OF BAYTOVIN TO TRANSFER ONE THOUSAND THREE HUNDRED SEVENTY FIVE ($19375.00) DOLLARS FROM THE GENERAL FUND TO CLASSIFI- CATION ONE HUNDRED THREE -A-2. (103 -A -2). Travis Street Sewer Line — Bond Issue Councilman Buelow moved to instruct the City Manager to include the estimated installation costs of the Travis Street Line in the proposed $1,000,000 Bond Issue. Campbell Miscelleanous The City Manager was instructed to contact Dean Gorman, Director of the Texas Municipal Retirement System, and invite him to appear before the Council, at his convenience, to explain the benefits offered to city employees by the Texas Municipal Retirement System. The City Attorney was instructed to contact the Coast Guards regarding Federal Control and Enforcement of regulations which require life belts on all speed boats in navigable streets, especially touching Rpsaland Park. Mayor Ward was nominated as a Committee of one to negotiate with the School Board regarding an easement and installation of a 6e water main to the new Educational Building now under construction. If the School Board would purchase the necessary pipe the Council expressed a willingness to lay the pipe for them. Adjournment Councilman Pruett moved to adjourn.
