1949 12 22 CC Minutes, SpecialPTV MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS December 22, 1949 The City Council of the City of Baytown, Texas, met in a special meeting on Thursday, December 22, 1949, at 6:00 p.m. in the office of the City Manager at the City Hall with the following members in attendance: J. A. Ward Mayor Rufus B. Bergeron Councilman H. I.Davis Councilman Fahy Godfrey Councilman R. H. Pruett Councilman C. Darwin Middleton City Manager David Donoghue City Attorney Edna Oliver City Clerk Absents W. C. Williams Councilman J. A. Stroud Councilman Mayor Ward opened the meeting stating that it had been called by the City Clerk upon his request. Mayor Ward then requested the City Clerk to incorporate in the Minutes the following instrument which had been signed by the members of the Council and City Officials pertaining to this meeting: CONSENT TO MEETING We, the undersigned members of the City Council of the City of Baytown, Texas, do hereby waive Notice of Special Meeting and consent and agree that a Special Meeting of said City Council shall be held on Thursday, December 22, 1949, at 6700 p.m. at the regular meeting place of said City Council in the City Hall in said City, for the purpose of adopting an amendment to the Build - ing Ordinance of the City of Baytown setting up requirements for No. 2 Fire Limit..Area and for any other business that may come before the meeting. /s/ J. Darwin Middleton City Manager /s/ David Donoghue City Attorney Mayor Ward added that on August 4, 1949, the City Council had passed Ordinance No. 53 creating a No. 2 Fire Zone along East Texas Avenue, Decker Drive, and Market Street area between old Baytown and Goode Creek. He stated that such ordinance was considered at the same meeting as the Annexation Ordinance and due to the great volume of business handled that night a complimentary amending the building dode to set up requirements for a No. 2 Fire Zone inadvertently had been overlooked. This oversight was not discovered until sometime in November and at the November 15th meet- ing the City Attorney called the Council's attention to the situation. Councilman Stroud had not been present at the August 4th, 1949 meeting at which time the No. 2 Fire Zone was presented and he requested an opportunity to study the matter further. Due to pressure of other business the Council had failed to take the matter up and it was deemed advisable that the ordinance be passed as soon as possible. 1 I r r Mayor Ward instructed the City Attorney to read Ordinance No. 7Q after which Councilman Davis made the :ration that the ordinance be adopted as read. Councilman Pruett seconded the motion. The Roll call vote was as followst Roll Call: Ages: Mayor Ward Nays: None Councilman Davis " Bergeron " Godfrey - Pruett The caption of the ordinance was as follows: ORDINANCE NO. 70 AN ORDINANCE AMENDING SECTION 6 OF AN ORDINANCE KNOWN AS THE "BUILDING ORDINANCE ", BEING "AN ORDINANCE REGU- LATING THE CONSTRUCTION, ALTERATION. MAINTENANCE, - REPAIR AND REMOVAL OF BUILDINGS, PROVIDING FOR FIRE LIMITS WITH THE CITY OF PELLY (NOW BAYTOWN), TEXAS, PRESCRIBING PENALTIES FOR VIOLATION; AND DECLARING AN EMERGENCY. ", AS AMENDED BY ORDINANCE NO. 37 DATED JANUARY 20, 1949, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Tax Exemption of M.B.A. City Manager Middleton called attention to the fact that the M.B.A. had re- quested a tax exemption for its property in old Baytown. The matter had been re- ferred to the City Attorney and that Mr. Donoghue had submitted an opinion to him holding that the property was exempt. Councilman nergeron made the motion that the opinion of Mr. Donoghue be approved. Councilman Pruett seconded the motion. The roll call vote was as follows: Roll Call: Ayes:•Mayor Ward Nays: None Councilman Davie " Bergeron " Gddfrey Councilman Davis made the motion to adjourn. Councilman Bergeron seconded the motion.
