1949 12 06 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS December 6, 1949 The City Council of the City of Baytown, Texas met in regular session on Tuesday, December 6, 1949 at 7:45 P- m. in the Council Room of the Baytown City Hall with the following members in attendance: J. A.Ward Mayor R. B. Bergeron Councilman H. I. Davis Councilman $ 2,543.42 Fatly Godfrey Councilman Chevrolet R. H. Pruett Councilman 3. J. A. Stroud Councilman fit. C. Williams Councilman A. V. Barber Acting City Manager David Donoghue City Attorney Edna Oliver City Rlerk ; -- Absent. C. Darwin Middleton City Manager The Mayor called the meeting to order, and the minutes of the regular meet- ing of November 15, 1949 were read and approved, whereupon the following business was transacted: Truck Bids Opened The bids were opened on the two (2) j ton pick -up trucks and are tabulated as follows: 1. Hemphill Pontiac Company OMC $ 1,267.21 $ 2,543.42 2. Buck Turner Chevrolet Chevrolet 1,235.00 2,470.00 3. J. B. Hollaway Studebaker 1,271.28 2,542.56 4. Thad Felton Ford 1,233.89 2,467.78 5. Higginbotham GMC 1,267.00 2,534.00 6. Gulf Coast Motor Company Dodge 1,299.00 2,598.00 Councilman Pruett moved to accept the bid submitted by Thad Felton as the lowest bidder, however, some question was raised by the council members regard- ing the ommiasion of designated information such as model and federal tax exemption allowance. After some discussion Councilman Pruett asked to withdraw his motion and Councilman Bergeron moved to throw out the by,ds submitted and re— advertise with requests that each bidder pay strict attention and include all items outlined in the bid. Williams Air Compressor Bids The air compressor bids, including paving breaker, tampers, clay digger, air hose, asphalt cutter and shanks, were opened and they are tabulated as follows: 1. Everett & Company Joy 2,401.10 Councilman Pruett moved to table the bids for further study. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Calls Ayes: Mayor Ward Kaye: None Councilman Bergeron " Davis It Godfrey to Pruett If Stroud 9I Williams 213 Resolution - Releasing Bond No. 4914615 The City Attorney introduced and read the following resolution: RESOLUTION A,RESOLUTION OF T9E CITY COUNCIL OF THE CITY OF BAYTOWN RELEASING FIDELITY AND DEPOSIT COMPANY OF MARYLAND FROM LIABILITY UNDER ITS BOND No. 4914615 COVERING C. DARWIN MIDDLETON AS DIRECTOR OF FINANCE AND TAX ASSESSOR*COLLEC- TOR FROM AND AFTER OCTOBER 15, 1948. C WHEREAS, Fidelity and Deposit Company of Maryland had issued its Bond No. 4914615 effective October 23, 1947 covering C. Darwin Middleton as Director of Finance and Tax Assessor-Collector for the City of Pally and which bond has been transferred to the City of Baytown, and WHEREAS, effective October 15, 1948 the said C. Darwin Middleton was appointed City Manager of said city and his duties as Director of Finance and Assessor- Collec- tor of Taxes ceased on such date, and WHEREAS, the City Council of the City of Baytown is desirous of executing a release to the Fidelity and Deposit Company of Maryland from its liability on said bond from and after October 15, 1948, Now, Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: THAT Fidelity and Deposit Company of Maryland is hereby released from further C liability under Bond No. 4914615 covering C. Darwin Middleton as Director of Finance and Tax Assessor- Collector of the City of Pally, from and after October 15, 1948. THAT is is further understood and agreed, however, that no release is intended as regards to the acts of C. Darwin Middleton is such capacity prior to October 15, 1948. He also suggested that each bidder supply the council members with ad- vertising litature on each bid. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Gall: Ayea: Mayor Ward Nays: None Councilman Bergeron " Davis to Godfrey it Pruett P Stroud It Williams Wilburn Subdivision- Streets Councilman Bergeron moved to authorize the City Manager to enter into an agree- ment to top the streets in Wilburn Brothers Subdivision by May 15, 1950, according to city specifications, upon Wilburn Brothers depositing in escrow the am of 62,200 representing the estimated cost of labor and materials. " Williams i Tunnel Transit Company - Parking Meters In order to expedite the city bus service, Councilman Bergeron moved to grant the request of the Tunnel Transit Company and remove parking meters Nos. 22123,24, 103 and 104 on Texas Avenue to allow space forthe purpose of loading and unloading passengers. Councilman Davis seconded the motion. Councilman Pruett seconded the motion.
