1949 10 04 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS October 4, 1949 The City Council of the City of Baytown, Texas met in regular session on Tuesday, October 4, 1949 at 7:45 P.M. in the council room of the Baytown City Hall with the following in attendance: J. A. Ward Mayor i Rufus Bergeron Councilman Fahy Godfrey Councilman J. A. Stroud Councilman W. C. Williams Councilman C. Darwin Middleton City Manager David Donoghue City Attorney Edna Oliver City Clerk Absent: H. I. Davis Councilman R..H. Pruett Councilman The Mayor called the meeting to order, and the Minutes of the regular meet- ing of September 15, 1949 were read and approved, whereupon the following business was transacted: Dr. Crossman's Appointment - City Health Officer The City Attorney introduced and read the following resolution: A RESOLUTION APPROVING THE APPOINTMENT OF LYMAN W. CROSSMAN, M. D., AS DIRECTOR OF HEALTH FOR THE CITY OF BAYTOWN. "WHEREAS, on the 30th day of September, 1949, the City Manager has appointed Lyman W. Crossman, M. D., Director of Health; and "WHEREAS, under the Charter of the City of Baytown the appointment of department heads by the City Manager is subject to the approval of the City Council; "NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: "THAT the appointment of Lyman W. Crossman, M. D., as Director of Health of the City of Baytown be hereby approved and in all things conformed. "INTRODUCED, READ and PASSED by the majority of the City Council of the City of Baytown on this the 4th day of October, A. D., 1949. A. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron " Godfrey " Stroud " Williams Ordinance No. 63 - Tax Anticipation Warrant The City Attorney introduced and read an ordinance authorizing the issuance and sale of a tax anticipation warrant. Councilman Williams moved to adopt the or- dinance as read. Councilman Godfrey seconded the motion. The roll call vote was as follows: Roll Call: byes: Mayor Ward Nays: None Councilman Bergeron " Godfrey " Stroud " Williams The caption of the ordinance was as follows: ORDINANCE NO. 63 AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF A TAR ANTICIPATION WARRANT FOR PAYING THE CURRENT EXPENSES OF THE CITY OF BAYTOWN FOR THE FISCAL YEAR ENDING SEPTEGDBER 30, 1950, TO BE PAYABLE OUT OF THE CURRENT PROPERTY TAX REVENUES OF SAID CITY FOR THE YEAR 1949, SAID WARRANT TO BE ISSUED IN THE SUM OF ONE HUNDRED THOUSAND AND N01100 DOLLARS ($100,M.00) AND PAYABLE ON OR BEFORE JANUARY 15TH, 1950; PLEDGING THE CURRENT PROPERTY TAXES OF THE CITY OF BAYTOWN FOR THE YEAR 1949 AS SECURITY FOR THE PAYMENT OF SAID WARRANT; AND PROVIDING A SAVINGS CLAUSE. Roll Call Vote Change Action was deferred until a full Council was present, on the suggestion made by Councilman Godfrey relative to changing the order of roll call vote with the Mayor voting last. Second Reading - Bus Franchise The City Attorney introduced Ordinance No. 62 for the second reading. Councilman Bergeron moved to adopt the ordinance as read for its second reading. Councilman Stroud seconded the motion. The roll call vote was as follows: Roll Call: !Ayes: Mayor Ward Nays: None Councilman Bergeron " Godfrey " Stroud " Williams The caption of the ordinance was as follows: ORDINANCE NO. 62 AN ORDINANCE DEFINING TERMS; GRANTING TO C. Q. ALEXANDER, A FRANCHISE TO ESTABLISH, MAINTAIN AND OPERATE OVER THE STREETS OF THE CITY OF BAYTOWN, TEXAS, A BUS SYSTEM FOR LOCAL TRANSPORTATION OF PASSENGERS FOR HIRE; GRANTING SAID FRANCHISE FOR TWENTY FIVE (25) YEARS; PROVIDING FOR EXTENSION OF SAID FRANCHISE TO ANY TERRITORY ANNEXED IN THE FUTURE; ESTABLISHING PROCEDURE FOR DETERMINATION OF DEFINITE ROUTES OVER AND UPON WHICH BUSES SHALL TRAVEL AND PROVIDING FOR CHANGING AND ALTERATION OF ROUTES AND ESTABLISHING DIFFERENT ROUTES OR ADDITIONAL ROUTES; PROVIDING TRIPPER SERVICE AND DEFINING SAID TERM AND ESTABLISHING RATES THEREFOR; PROVIDING REGULAR BUS STOPS ON CITY STREETS; ESTABLISHING RIGHT FOR RATES AND PROVIDING METHODS AND MEANS OF DETERMINING VATETHER RATES OF FARE SHALL BE INCREASED; PROVIDING FOR COM- PENSATION TO BE PAID CITY UPON GROSS RECEIPTS AND METHOD OF INCREASE OR DECREASE OF SAID COMPENSATION, AND TIME OF PAYMENT; REQUIRING GRANTEE TO KEEP BOOKS AND RECORDS AND CARRY PUBLIC LIABILITY AND PROPERTY DAMAGE INSURANCE; PROVIDING PRO- TECTION TO BUSINESS OF GRANTEE; PROVIDING THE RIGHT OF PURCHASE BY THE CITY OF THE PROPERTIES OF SAID GRANTEE AT EXPIRATION OF FRANCHISE, AND METHOD OF SAID PURCHASE AND MANNER OF DETERMINING PRICE; PROVIDING CONDITIONS OF PURCHASE AND RIGHT OF GRANTEE TO APPLY FOR EXTENSION OR NEW FRANCHISE; PROVIDING PROVISIONS OF CHARTER APPLICABLE TO FRANCHISE; PROVIDING A SAVINGS CLAUSE; PROVIDING TIME FOR TAKING EFFECT OF FRANCHISE, AND CONDITIONS THEREUNDER. r 11 r Baytown Developers - Wynnewood Addition Tentative approval of Section 4 of Wynnewood Addition wan postponed until a full Council was present. (Mr. W. A. Ehrhardt, Local Surveyor with representatives of the Baytown Developers, asked permission to use a 20 foot concrete slab for street with open ditches for drainage, rather than curb and gutter as specified in the present City Subdivision Ordinance. Mr. Ehrhardt based his request on the fact that Sections One, Tso and Three of the subdivision had been approved with this type streets and drainage of Section 4 could be diverted in like manner. The Mayor informed the repre- sentatives that until such time as the present ordinance could be amended to allow exceptions, each subdivider would be required to meet the specifications contained in the ordinance before tentative approval would be given. Finger Brothers Addition The Council approved roll type curb rather than straight curb in the Hill Terrace Subdivision. Miscellaneous The Mayor asked the Council members to study the proposed anti -noise ordi- nance for discussion at the next regular meeting of the Council. The City Manager informed the Mayor that he had written letters of commendation to the National Guards, Red Cross, Volunteer Fire Departments and other local agencies assisting in the maintenance of order during the recent hurricane.
