1949 09 15 CC Minutesr MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS September 15, 1949 The City Council of the City of Baytown, Texas met in regular session on Thursday, September 15, 1949 at 7:30 p.m. in the Council room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor Rufus Bergeron Councilman H. I. Davis Councilman Fatly Godfrey Councilman R. H. Pruett Councilman J. A. Stroud Councilman W. C. Williams Councilman C. D. Middleton City Manager David Donoghue City Attorney Inez Mendenhall Acting City Clerk The mayor called the meeting to order and the minutes of the special meet- ing of September 9, 1949 were read and approved whereupon the following business was transacted. Annexation Hearing Councilman Pruett made a motion that Annexation Ordinance No. 54 be intro- duced and read for final reading. This motion was seconded by Councilman Bergeron. Before the vote was taken Councilman Davis made a motion to postpone action on the ordinance until a later date. Councilman Godfrey seconded the motion and the roll call vote was as follows: Roll Call: Ryes: Mayor Ward Nays: Councilman Bergeron Councilman Godfrey " Pruett " Stroud " Williams Mayor Ward, after a consultation with City Attorney Donoghue, declared the motion failed to carry because of the necessary two-thirds (2/3) vote requirement. The mayor then asked if there were any questions about the Annexation Ordinance No. 54. The following were present and declared themselves being opposed to the Annexation Ordinance: Carl Illig Jr., Assistant to the President of Humble Oil and Refining Co., Joe Lockett Jr. of Houston representing the Reconstruction Finance Corp., G. L. Farned, Manager of the Baytown Plant of Humble Oil and Refining Co., Bill Scott, an attorney of Houston representing the Busch Estate, Jack Bennett of the Wooster community, Roy Comeaux, L. L. Laird, E. W. Brucei and R. H. Webb of Baytown. Mr. Ed. Niles of Baytown also made comments on the ordinance. After further period of discussion, Councilman Godfrey made a motion that Ordinance No. 54 be tabled. This motion was seconded by Councilman Stroud and the roll call vote was as follows: Roll Call: lives: Mayor Ward Councilman Davis I " Godfrey " Stroud Williams Nays: Councilman Bergeron " Pruett Mayor ward declared the motion carried and that further action on ordinance had been taken. Councilman Pruettb Motion to Adjourn Councilman Pruett made the motion to adjourn and thereupon left the meet- ing. No second was made to the motion and the meeting continued. 17 Report of Tax Equalization Board Mr, Carter Miller, Chairman of the Tax Equalization Board, read a letter filed by the Board members composed of C. H. Miller, Steele McDonald, and E. W., Buelow that their work had been completed. Mr. E. l9. Buelow gave a report on the compiled final figures of the Board for'the year 1949. Mr. Steele McDonald gave a brief report on the work done by the Board. Mayor Ward thanked the Board for its splendid work. Resolution Approving Assessment Rolls for the Year 1949 City Attorney Donoghue introduced and read the following resolution: A RESOLUTION OF THE CITY COUNCIL APPROVING ASSESSMENT ROLLS FOR THE YEAR 1949. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: THAT the assessment rolla of the City of Baytown for the year 1949 as re- turned to the City Council by the Equalization Board be approved and are hereby adopted as the assessment rolls to be used for the collection of taxes for the - current year. INTRODUCED, READ, and APPROVED by the affirmative vote of a majority of the City Council on the 15th day of September, A.D., 1949. . /a/ 1. A. City Manager Middleton introduced and read Ordinance No. 58 adopting a budget for the ensuing fiscal year. Councilman Godfrey moved that the ordinance be adopted as read. Councilman Davis seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron " Davis " Godfrey " Stroud " Williams The Caption of the Ordinance is as follows: ORDINANCE NO. 58 AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGINNING OCTOBER 1, 1949, AND ENDING SEPTEMBER 30, 1950, IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF,BAYTOWND AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE. Ordinance No. 59 Tax Rate and Tax Levy City Attorney Donoghue introduced and read Ordinance No. 59 levying a tax rate of One Dollar Seventy -Two Cents (,$1.72) on each One Hundred Dollars ($100.00) worth of property. Councilman Williams moved that this ordinance be adopted as read. Councilman Davis seconded the motion and the roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron " Davis Godfrey Stroud " Williams The Caption of the Ordinance is as follows: ORDINANCE N0. 59 AN ORDNANCE FIXING THE TAR RATE AND TAX LEVY FOR THE CITY OF BAYTOWN, TEXAS, FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1950, UPON ALL TAXABLE PROPERTY N SAID CITY OF BAYTOWN, TEXAS, IN CONFORMITY WITH THE CHARTER PROVISIONS AND THE ORDINANCES OF SAID CITY; AND REPEAL- ING ALL ORDINANCES OR PARTS OF ORDINANCES N CONFLICT HEREWITH. Ordinance No. 60 Authorizing Tax Anticipation Warrant City Attorney Donoghue introduced and read an ordinance authorizing the issuance and sale of a tax anticipation warrant for paying the current expenses of the City of Baytown for the fiscal year ending September 30, 1950, to be payable out of the current property tax revenues of said city for the year, 1949. Council- man Williams moved to adopt the ordinance as read. Councilman Stroud seconded the motion and the roll call vote was as follows: Roll Call : Ayes: Mayor Ward Nays: None Councilman Bergeron Davis " Godfrey " Stroud Williams The Caption of the Ordinance is as follows: ORDNANCE NO. 60 AN ORDNANCE AUTHORIZING THE ISSUANCE AND SALE OF A TAX ANTICIPATION WARRANT FOR PAYING THE CURRENT EX- PENSES OF THE CITY OF BAYTOWN FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1950, TO BE PAYABLE OUT OF THE CURRENT PROPERTY TAX REVENUES OF SAID CITY FOR THE YEAR 1949, SAID WARRANT TO BE ISSUED N THE -SMd OF ONE HUNDRED FIFTY THOUSAND ($150,000.00) DOLLARS AND PAYABLE ON OR BEFORE JANUARY 15TH, 1950; PLEDG- ING THE CURRENT TAX REVENUES OF THE CITY OF BAYTOWN FOR THE YEAR 1949 AS SECURITY FOR THE PAYMENT OF SAID WARRANT; AND PROVIDING A SAVINGS CLAUSE. Ordinance No. 61 Cancelling Franchise of Gulf Transit Company �j City Attorney Donoghue introduced and read Ordinance No. 61 repealing Ordinance No. 5 passed by the City Commission of the former City of Pelly granting to Gulf Transit Company a bus franchise. Councilman Stroud moved to adopt the ordi- nance as read. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron _ " Davis Godfrey " Stroud Williams The Caption of the Ordinance is as follows: ORDINANCE NO. 61 AN ORDINANCE REPEALING ORDINANCE N0. 5 PASSED BY THE CITY COMMISSION OF THE CITY OF PELLY, NOW BAYTOWN, TEXAS, ON MAY 22, 19117; IT BEING THE DECLARED INTENT AND PURPOSE OF SAID ORDINANCE TO REVOKE AND CANCEL THE FRANCHISE OF GULF TRANSIT COMPANY TO ESTABLISH, MAINTAIN AND OPERATE A BUS SYSTEM IN THE CITY OF BAYTOWN. i Ordinance No. 62 Granting Bus Franchise to C. Q. Alexander Ordinance No. 62 was introduced and read by City Attorney Donoghue grant- ing C. Q. Alexander a twenty-five (25) year bus franchise. Councilman Stroud moved that the ordinance be passed for its first reading. Councilman Davis seconded the motion. Q. ALEXANDER, A FRANCHISE TO ESTABLISH, MAINTAIN AND OPERATE OVER THE STREETS OF THE CITY OF BAYTO.jN, TEXAS, A BUS SYSTEM FOR LOCAL TRANSPORTATION OF PASSENGERS FOR HIRE; GRANTING SAID FRANCHISE FOR TWENTY FIVE (25) YEARS; PROVIDING FOR-EXTENSION OF SAID FRANCHISE TO ANY TERRITORY ANNEXED IN THE FUTURE; ESTABLISHING PROCEDURE FOR DETERMINATION OF DEFINIrE ROUTES OVER AND UPON WHICH BUSES SHALL TRAVEL AND PROVIDING FOR CHANGING AND ALTERATION OF ROUTES AND ESTABLISHING DIFFERENT ROUTES OR ADDITIONAL ROUTES; PROVIDING TRIPPER SERVICE AND DEFINING SAID TERM AND ESTABLISHING RATES THEREFOR; PROVIDING REGULAR BUS STOPS ON CITY STREETS; ESTABLISHING RIGHT FOR RATES AND PROVIDING LETF!ODS AND MEANS OF DETERMINING WHETHER RATES OF FARE SHALL BE INCREASED; PROVIDING FOR COM- PENSATION TO BE PAID CITY UPON GROSS RECEIPTS AND METHOD OF INCREASE OR DECREASE OF SAID COMPENSATION, AND TIME OF PAYMENT; REQUIRING GRANTEE TO KELP BOOKS AND RE- CORDS AND CARRY PUBLIC LIABILITY AND PROPERTY DAMAGE INSURANCE; PROVIDING PROTEC- TION TO BUSINESS OF GRANTEE; PROVIDING THE RIGHT OF PURCHASE BY THE CITY OF THE PROPERTIES OF SAID GRANTEE AT EXPIRATION OF FRANCHISE, AND METHOD OF SAID PURCHASE AND MANNER OF DETERMINING PRICE; PROVIDING CONDITIONS OF PURCHASE AND RIGHT OF GRANTEE TO APPLY FOR EXTENSION OR NEW FRANCHISE; PROVIDING FOR TRANSFER AND SALE OF FRANCHISE; PROVIDING FOR FORFEITURE OF FRANCHISE; PROVIDING PROVISIONS OF CHARTER APPLICABLE TO FRANCHISE; PROVIDING A SAVI14GS CLAUSE; PROVIDING TIME FOR TAKING EF= FECT OF FRANCHISE, A14D CONDITIONS THEREUNDER. Change of Council Meeting Nights Councilman Stroud made a motion that the City Council meeting nights be changed from the first and third Thursdays of each month to the first and third Tuesdays of each month during the football season. Councilman Davis seconded the motion and the roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron " Davis Godfrey " Stroud Williams Councilman Godfrey moved the meeting adjourn.
