1949 09 09 CC Minutes, Specialr A 193 MINUTES OF SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BA' TOWN, TEXAS SEPT.9,1949 The City Council of the City of Baytown, Texas, met in a special meeting on Friday, September 9, 1949 at 7:30 P.M., in the council room of the Ba:•town city ball, with the following members in attendance: J.A. ' ;Tard Mayor Rufus B. Bergeron C6uncilman H. I. Davie Councilman Faby Godfrey Councilman R.H. Pruett Councilman J.A. Stroud Councilman W.C. Williams Councilman C. Darwin Middleton City Manager David Donoghue City Attorney The Mayor called the meeting to order. Councilman Bergeron made a motion that Mrs. Inez Mendenhall be appointed Acting City Clerk in the absence of Mrs. Ed= Oliver on vacation. This motion was seconded by Councilman Pruett and the roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron " Davis " Godfrey " Pruett " Stroud " Hilliams The minutes of the regular meeting of September 1, 1949 were read and approved whereupon the following business was transacted: Abpearance of Mr and hire T Wolowski in regard to Tax Assessment Mr. and Mrs T. Wolowski appeared before the council to protest the assessment of Lots 30 through 33, 35, 37 through 44,46 through 45,51 through 53, of Mollie Know- lton addition. Mr. and Mrs. Wolowski contended that their taxes had been raised for the year 1949ghowever, City Manager Middleton informed the council that there had not been any raise of the assessment. The Wolowskis did not have any papers with them to show the council that these had been a raise and therefore no action was taken. Final Approval on Plat on Britton - Cravens Subdivision Section 4 Mr. R.L. 'Van Deventer of Britton - Cravens Lumber Company appeared before the council requesting final approval of the plat covering Britton - Cravens Addition No. 4. City Manager Middleton and Public Works Director Grantham advised the council that the work in the subdivision is 95�er cent complete. Councilmen Godfrey moved that the subdivision be approved and the council sign the plat. Council ruett second- ed the motion. Mr. Crabbe stated that he also proposed to install a 20-foot concrete slab in the new area in accordance with previous plans for t Wynnewood Addition. It was his contention Nt due to prior approval of compr ve plans of the whole area by the City of Pally that it would not be necessary to install curb and gutter. No action was taken and Mayor Ward requested City Attorney Donoghue to study the matter. Aonlication of C. Q Alexander for Bus Franchise Mr. C. Q. Alexander, and files and submits his application to the City of Baytown, Texas for a bus line franchise, and any and all necessary authority from the city of Baytown, Texas, to operate buses transporting passengers for compensaticn in local transportation service over streets within the city of Baytown subject toa>.y and all applicable provisions of the city charter, and in support thereof says: C. Q. Alexander is in the process of organizing a Corporation under the laws of the State of Texas, with its principal place of business to be in Baytown, Harris County, Texas. C.Q. Alexander to be the majority stockholder, President and General Manager of daid corporation, and propose to complete organization during Lhe procedure of issuing this requested Franchise. Applicant seeks a franchise for a period of twenty -five (25) years, authorizing the conduct of b.s line operations in local transportation service of passengers for compensation over such reasonable mutes as shall be approved by the City Council. C. Q. Alexander proposes to accord expeditious, convenient, regular, adequate, economical and dependable local bus transportation service. C. Q. Alexander is willing and able to conduct the proposed local transportation service. The applicant has adequate financial resources and adequate new equipment available to conduct the proposed oper.,tion and service. Personnel experienced in conductine trans ortatica of the kind an character proposed will assist in conducting operations and service under the franchise requested in this application, under the supervision of C. Q. Alexander. The transportation to be conducted by C. Q. Alexander 195 Mr. Alexander also presented the proposed draft of the ordinance granting a 25 Sear franchise to his organization. The council informed Mr. Alexander that they would study his proposal and requested that he return at the next council meeting. Request of Use of Council Room by Pythian Sisters In accordance with request of the City Council granted the P-thian Sisters use of the Council room for meetings for second and fourth Mon -ays beginning September 12, 1949, at a rental of :;2.00 per night. This permission was only given for the balance of the year 1949. Council !'illiams moved that the request be granted and the motion . ,ea seconded by Councilman Bergeron. Darwin Middleton City Manager Bayto-.m, Texas Dear Mr. Middleton: In reference to the many recent council meting discussions concerning Public health nrobi.e.s, I find that I am not in agreement with the stand the council has taken in some of these issues. I feel thtt the councilmen as representatives of the city ere not interested in making progress a: far as public health is concerned. They are not interested in promoting and maintaining a program of public health of modern high standards. They have not considered the health of thr community in their stand in the rat - control program. They have allowed public health issues to become political issues, as • ell as personal ones. In view of these facts, I ask that you please accept my resignation as City Heal -h Oificer of Baytolin, Texas effective immediately. Mr. Byrley stated that his company wanted city the right to connect with the � g y sel-a ge. Mayor :tarsi instructed City Atto: nay Donoghue to stud. the matter and report back to the council. No action -,as taken on the proposal. Ordinance No. 57- Truck Weight Ordinance City Attorney Donoghue introduced and read Ordinance No. 57 regulating weight of trucks on Missouri, Florida, Alabama, Utah, Maryland, Carolina, New Jersey KentuclW, Huggins, Louisiana and Oklahoma Streets. Councilman Godfrey moved that the ordinance be adopted as read. Councilman Davis seconded the motion. Proposed Amendment to Annexation Ordinance No. 54 Mayor Ward presented a map outlining a proposal to change the boundary lines of the area covered by Annexation Ordinance No. 54, now pending. Considerable discussion of the proposal was made bui no action was taken. Councilman Bergeron moved the meeting adjourn. Councilman Davis seconded the motion.
