1949 09 01 CC Minutes190 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS September 1, 1949 The city council of the city of Baytowh, Texas met in regular session on Thursday, September 1, 1949 at 7:40 P. M. in the council room of the Baytown city hall with the following in attendance: J. A. Ward Mayor Rufus Bergeron Councilman H. I. Davis Councilman Faby Godfrey Councilman R. H.*Pruett Councilman J. A. Stroud Councilman W. C. Williams Councilman C. Darwin Middleton City Manager David Donoghue City Attorney Edna Oliver City Clerk The mayor called the meeting to order, and the minutes of the regular meet- ing of August 18, 1949 were read and approved, whereupon the following business was transacted: Public Hearing Proposed Budget 1949-50 No protests were made against the proposed 1949 -50 budget. The city manager informed the council that the total tax valuation, including land, improvements, buildings on leased land, personal and utilities would be $38,748,274. Fiftj;(50%) per cent of this amount would be for tax purposes. With a $1.72 tax rate, the total amount raised from taxes would be $335,235.00�"" however , the budget was compiled with a 90% anticipated current tax collection and i6c,000.00 anticipated delinquent tax collection. This would leave a surplgs of $10,988 in the General Fund. He recom- mended that the transfer from the water operatirg fund be lowered $10,000.00. No action will be taken un'.the.tecommendation until the next meeting of the council on the review of the proposed budget, which time will be Friday, September 9th. Ordinance No. 54 55 The city attorney introduced and read an ordinance amending Ordinance No. 13 of the City of Baytown so as to provide for the renewgl, and reenactment of charges for city services in removing garbage and refuse from houses, buildings, etc. Councilman Bergeron moved to adopt the ordinance as read. Councilman 'Nilliams se- conded the motion. Letter . Nelms, Carter Lumber Company The city manager introduced and read a letter fwm Mr. Haywood Nelms, Presi- dent of the Carter Lumber Company of Houston, relative to Central Heights Subdivisim He expressed a desire to start improvement on the plat which had been recorded with the county on July 20, 1931. He agreed to make certain improvements to the streets, provide 2" water lines, and construct a trunk line and laterals for sewage, if the council would grant them permission to commegt, with the disposal plant located on the east side of Goose Creek stream. The council agreed to discontinue any dis- cussion on the proposal and extend an invitation to Mr. Nelms to make a personal ap- pearsace at a council meeting and discuss anticipated improvements to be made by the developer. t September 1, 1949 191. B. B. Elliott - Firemen's Bequest B. B. Elliott, Fire Chief of Station No. 1, asked permission to lease a plat of land,owmed by the city adjoining the present f #re station, so that a building can be erected by the firemen to use as a recreation center and a drill tower. At present the firemen have to drill in the streets. He promised that this building, when erected, would be maintained by the volunteer firemen. The council members expressed a willing- ness to grant the request, however, action was postponed until the mayor and city manager could check withthe county officials regarding the new proposed highway. Hat Control After some discussion by the council members, on the revision of the present rat- proofing ordinance the city attorney introduced and read an ordinance repealing Ordinance No. 6 passed by the city council of the city of Baytown on Feb. 9, 1948. Councilman Williams moved to adopt the ordinance as read. Councilman Bergeron seconded the motion. Ss 5 -b AN ORDINANCE REPEALING ORDINANCE N0. 6 PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON FEBRUARY 9, 1948, AS AMENDED BY ORDINANCE NO. 17 PASSED BY SAID CITY COUNCIL ON JULY 29, 194-�8,�,.,o-���� Councilman Pruett �t'o instract the mayor to appoint Councilmen Davis and Williams, as a committee of two, to work with the city attorney on preparing an or- dinance on rat- proofing to submit to the council for study and approval. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Bergeron Nays, Mayor Ward " Pruett Councilman Davis " Godfrey " Stroud Williams The mayor declared the motion failed to carry. Councilman Stroud moved to instruct the mayor to appoint a committee of five to work with the city attorney in preparing an ordinance for the council's study and approval. Councilman Godfrey seconded the motion. The roll call vote was as follows: Ron Call: Ayes: Mayor Ward Nays: None Councilman Bergeron Davis n Godfrey " Pruett 8 Stroud Williams Eddie Gray Subdivision No action was taken, at this time, on the proposed Eddie Gray subdivision plat submitted by Steele McDonald. The council asked Mr. McDonald to contact the property �owners on the adjoining properties relative to improving their portion of the dedicated I street before tentative approval would be given. Committee Appointed - Revision of Present Subdivision Ordinance The mayor announced that he had appointed the following committee to assist the city attorney in the revision of the present subdivision ordinance: R. H. Pruett - Chairman Elmer Gray B. B. Williams David Donoghue W. Ehrhardt Gulf Transit Company Franchise Cancelled The council instmeted the city manager to inform the officials of the Gulf Transit Company that their Franchise had expired with the city and they were to dis- 192 September 1, 1949 continue operation at midnight, Sunday September 4th. The city attorney was instructed to prepare an ordinance accordingly for presentation at the next meeting of the council. General Tire & Rubber Company Hearing Councilman Pruett moved that the General Tire & Rubber Company aha all others desiring to contest annexation Ordinance No. 54, passed August 4, 1949, shall have the opportunity to be heard at a regular meeting of the council of the City of Raytown on September 15, 1949 at 7:30 P. M. at the city ball in Baytown. Councilman Davis seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron n Davie " Godfrey Stroud " Pruett " Williams Adjounment Councilman Pruett moved to adjourn.
