MINUTES OF THE SPECIAL MEETING OF THE
CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS
May 11, 1949
The City Council of the City of Baytown, Texas, met in special session on May
11, 1949, at 7140 p.m. in the council room of the Baytown City Hall with the fol-
lowing members in attendance:

The mayor called the meeting to order. The returns of the special city elec-
tion of April 30, 1949, were canvassed by the Council.
The City Attorney introduced and read the following resolutions
RESOLUTION
A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL
MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN
ON THE 30TH DAY OF APRIL, A. D., 1949, FOR THE PURPOSE
OF ELECTING ONE :(1) COUNCILMAN FROM DISTRICT NO. 2 AMID
A MAYOR FROM THE CITY AT IARGES DECLARING THE RESULTS
OF SAID ELECTIONS FINDING THAT NOTICE OF SAID ELECTION
WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION
WAS DULY AND PROPERLY HELD AND THE RETURNS THEREOF
MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE
LAWS OF THE STATE OF TEXAS.
WHEREAS, the -city council of the City of Baytown at its special meeting held

on this the 11th day of May, 1949, proceeded as required by law to canvass the re-
turns of tW Pecial municipal election held in the City of Baytown on the 30th
day of April, 1949, for the purpose of electing one (1) councilman from District
No. 2 and a mayor from the city at large, said election having been held under and
pursuant to the provisions of the dharter of said city and an ordinance duly passed
on the 13th day of April, 1949, calling said election, and
WHEREAS, said election having been duly and regularly had and held as called
in said ordinance and according to law and the returns thereof having been duly
made and the election judges having certified the results of said election as here-
inafter set out and the city council having duly and regularly canvassed the returns
of said election and finding that the total votes cast at said election were as
follows, to -wit:

Rufus B. Bergeron Votes
J. Bryan Stratton _ Votes
For Mayor:
J. A. (Jack) Ward Votes
H. G. Corneil Votes

and WHEREAS, the city council of the city of Baytown finds the election returns
as set out above to be accurate and correct and no election protest or contest having
been filed with said council or instituted in connection with said election,.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWNs
Section 1. THAT Rufus B. Bergeron received a majority of the votes cast at
said election for the office of Councilman from District No. 2 and accordingly, the
said Rufus B. Bergeron is hereby declared elected to the office of councilman from
District No. 2 of the City of Baytown.
Sdstion 2. THAT J. A. (Jack) Ward received a majority of the votes cast at
said election for the office of mayor and accordingly the said J. A. (Jack) Ward
is hereby declared elected to the office of mayor of the City of Baytown.

Resolution - Accepting Application of Citizens National Bank - City Depository
The City Attorney introduced and read the following resolution:
RESOLUTION
A RESOLUTION ACCEPTENG THE APPLICATION OF CITIZENS
NATIONAL BANK AND TRUST COMPANY OF BAYTOWN, TEXAS
FOR CITY DEPOSITORY OF THE CITY OF BAYT04N, TEXAS.
WHEREAS, the City Council of the City of Baytown, Texas, at its regular
meeting on Thnraday night, April 7, 1949, authorized the publication of Notice
for Applications of all banks desiring to be City Depository for the City of n
Baytown, Texas, which Notice was in words and terms as follows: I

"NOTICE TO BIDDERS
"NOTICE is hereby given that the City Clerk of the City of Baytown,
Texas, on or before Thursday, May 5th, A. D., 1949, at 7:30 p.m., will
receive applications of all banks desiring to be selected as City Depo-
sitory for the City of Baytown, Texas.
"SUCH Applications shall state the rate of interest to be paid on
time deposits, the rate of interest to be paid on daily balances, and
the kind of bond such bank proposes to make to qualify as such depository,
and shall be sealed.
"THE City of Baytown reserves the right to reject any and all bids.
City Clerk
City of Baytown"
AND WHEREAS, said Notice was published in THE DAILY SUN, a newspaper of
general circulation of Baytown, Texas, on April 22, 1949, and April 29, 1949.
AND WHEREAS, among others, the following bid of Citizens National Bank and
Trust Company, Baytown, Texas, was submitted:
"May 3, 1949
To the Mayor and Council
City of Baytown
Baytown, Texas
Gentlemen:
In response to your invitation for bids for the City Depository for the
next two ensuing years beginning on May 1, 1949, and ending on April 30, 19511
we submit our proposals as follows:
(a) TIME DEPOSITSt
On such sums as are placed for a minimum period of 90
days, we shall pay 1% per annum.
On such sums as are placed for a minimum period of
four months, we shall pay 2% per annum.
On such sums as are placed for a minimum period of
six months, we shall pay 2 -1/2,% per annum.
Interest in each case to be credited to the respective
account at the termination of each contract period.
(b) KIND OF BOND:
We shall pledge with the City through a custodianship
agreement with the South Texas National Bank, Houston,
Texas, municipal bonds of Texas cities, counties or
school districts satisfactory to yourselves.
(c) LOANS.
On such direct credits as are made to the City with
the approval of Bank's counsel, Reid, Strickland &
Gillette, we shall charge interest It a rate not to

exceed 2 -1/2% per annum, and any advances so made
shall be for a period not to exceed the Depository
Agreement.

C AND WHEREAS, said bid of Citizens National Bank and Trust.Company, Baytown,
Texas, is adjudged by the City Council to be the best bid submitted and the most
advantageous to the interest of the City: ,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
THAT the Application of Citizens National Bank and Trust Company, Baytown,
Texas, be and the same is hereby accepted, and said Citizens National Bank and
Trust Company shall hereafter be the City Depository of the City of Baytown, Texas,
for the term of two (2) years from May 1, 1949, and the City Treasurer and the
City. Manager of the City of Baytown, Texas, are hereby authorized and ordered to
transfer all funds of the City of Baytown to said Citizens National Bank and Trust
Company as soon as said bank has qualified as such depository by furnishing bond in
accordance with its applicaj,yon and given the Treasurer of said City written notice
thereof, stating the amoung and kind of securities placed in escrow as such bond,
which notice shall be filed with the papers of said City in the office of the `'ity
Clerk.
THAT all other applications of banks desiring to become City Depository for
the City of Baytown, Texas, are hereby rejected.
INTRODUCED, READ and PASSED by a majority of the City Council of the City of
Baytown, Texas, on this the day of May, 1949.

Councilman davis moved to adopt the resolution as read. Councilman Bergeron
seconded the motion. The roll call vote was as follows:
