1949 03 03 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF B]YTOWN, TEXAS . March 3, 1949 The City Council of the City of Baytown, Texas, met in regular session at 7s30 p.m. in the council room of the Baytown City Hall with the following members in attendances E. D. Cleveland Mayor H. I. Davis Councilman Fahy Godfrey Councilman Robert Strickland Councilman Weldon H. Williams Councilman C. Darwin Middleton City Manager David Donoghue City Attorney Edna Oliver City Clerk Absents 0. 0. Dorris Councilman J. A. Stroud Councilman The Mayor called the meeting to order, and the minutes of the regular meeting of February 17, 1949, and the Special Meetings of February 18, and February 24, 19119, were read. City Manager Middleton requested the minutes of February 17, be changed to read, "He recommended that a cement stabilized shell base with prime coat and one and one -half (1 *) inches of compact rock asphalt at a cost of only $3.26 per front foot." With this correction the minutes were approved, whereupon the following business was transacteds Lowell Lammers - Fire Zone Lowell Lammers recommended that the present fire zone of the City of Baytown be extended to include Market Street. At present the city has no control over anyone who wished to build on Market Street, Airhart Drive or Decker Drive. If the council was not willing to extend the present fire limits, he recommended that a secondary fire zone be created which would require eight (811) inch masonry walls and parapets. Action was promised on the recommendation. W. W. Hunt - Telephone Company Mr. W. W. Hunt appeared before the council to renew a request for the recently proposed telephone rate increase. He told the council that its action on the request was "totally unacceptable to the company" and asked that a detailed outline on in- formation, wanted by the council, be submitted to the local manager of the company and every effort would be made to furnish same. Councilman Williams moved that a meeting be held with the company within 30 days. Councilman Godfrey seconded the motion. The roll call vote was as follewss Roll Calls Ayess Mayor Cleveland Nays None Councilman Davis " Godfrey " Strickland " Williams Wilburn Brothers Subdivision Councilman Strickland moved to give tentative approval of the Wilburn Brothers Subdivision plat. Hobbs - Palsy and cerebral Clinic C. 0. Hobbs, representing the Baytown division of the Cerebral -Palsy League, asked permission to lease a piece of city land on which to erect a Health Clinic for the league. At present they have thirteen (13) regular patients and no building in which to treat them. They had been using the V. F. W. Building, but it had recently been rented. Due to lack of funds the league was not able to buy the land and erect a building also. The council instructed the City Manager to have the land surveyed, after which, the City Attorney should draw up proper papers for a lease contract. METERAD Corporation Action on the Metered Corporation's proposal was tabled. The City Attorney in- formed the company's representative that he was not able to arrive at a definite decision on the proposal due to lack of time for proper study. The council agreed to have the City Manager notify the representative when it was ready for action on the proposal. Water Extension Ordinance The City Attorney introduced and read an ordinance relating to water line exten- sions. Councilman Strickland moved to adopt the ordinance as read. Sewer Line Extension Ordinance The City Manager introduced and read an ordinance relating to the sewer line extensions. Councilman Williams moved to adopt the ordinance as read. Williams The caption is as followss ORDINANCE N0. 43 AN ORDINANCE PROVIDING FOR RULES AND REOUDATIONS FOR.THE EXTENSION OF SANITARY SEWER MAINS AND LINES IN THE CITY OF BAYTOWN; CONTAINING A SEVERABILITY CLAUSE; REPEALING ORDINANCES IN CONFLICT THEREWITH, AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Policemen and Fireman - Civil Service No action was taken on the request of the policemen and Firemen for the Civil Service Plan. Councilman Godfrey expressed himself as being "against" the plan. Councilman Strickland commented that the plan was an invasion of home role and he was "opposed to the State Legislature telling us what to do." It was pointed out that, under the present charter, the council had no control over the hiring or firing of any member of the police force or the fire departments; this was controlled entirely by the chiefs and the City Manager. The City Attorney informed the council that there is a bill pending before the State Legislature that makes it mandatory for cities over 10,000 population to adopt the civil service code. The council agreed that it was not ready for action at this time. - I 1 187 The City }danger informed the council that the traffic light bids had been delayed because the companies could not get a quotation on cable, also, that bids would be asked on Monday on the complete rehabilitation of the Morrell Park Sewage Disposal Plant. Councilman Williams moved that the meeting adjourn. Councilman Davis seconded the motion. The ayes were unanimous,and the mayor declared the meeting adjourned. E. D.
