1950 12 12 CC Minutes328 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS December 12, 1950 The City Council of the City of Baytown, Texas, met in regular session on Tuesday, December 12, 19502 at 7 :30 P. m. in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor R. B. Bergeron Councilman E. W.Buelow Councilman Milton L. Campbell Councilman W. D. Reeves Councilman W. C. Williams Councilman C. Darwin Middleton City Manager George Chandler City Attorney. Edna Oliver City Clerk Absent: R. H. Pruett Councilman The Mayor called the meeting to order, and the minutes of the regular meet- ing of November 28, 1950, were read. Councilman Campbell asked that the minutes be amended to read: (1) "Councilman Reeves moved to purchase the two 8- cylinder 1951 Fordor Fbrds from Thad Felton for 91,798.00, plus the trade -in allowance of two (2) 1949 Ford Fbrdor Sedans.11 (2) "Councilman Reeves moved to trandfer $500 from the Contingent Rind into Account.No. 103 -Z1 for the purpose of buying new equipment for the Corporatiop Court Office.' Witfs these corrections the minutes were approved as read, whereupon the following business was transacted: Boyd Hill - Cedar Esyou Water District Boyd Hill, of Cedar Bayou, approached the Council on a co- operative plan in an effort to form a Cedar Bayou Water District. He explained that the residents were anxious to take some definite action in this direction, however, the issue would not be sufficient to provide a well and treating plant. He proposed to bring the water and sewer lines to the Baytown city limits in order that the district could use the city's treating plant on West James and the city's water system. At present the city is furnishing seventy per cent of the water supply to this section, and he proposed that all the residents of the proposed district be supplied by the city's system. Mr. Berlin, engineer, told the council that the disposal plantmon Names was using only 22% of its capacity at present, and he thought the plant could take care of this added waste but the city's wEkter pumping and storage facilities were inade- quate for any extra lines. The Mayor told Mr. Hill that the Council would have Mr. Berlin check into the feasibility of such a step by the city. After certain esti- mates were compiled the Council would review the figures and dive a definite reply to the proposal. Rio Vista System Councilman Buelow reported that he had contacted Mr. Harbers relative to buy- ing the Rio Vista Water System. Mr. Harbers agreed td sell the system for the amount shown on the city's tax roll. Mr. Grantham and Mr. Berlin were instructed to check the size, condition and amount of lines and submit an estimate of their findings. Ordinance No. 100 - Railroad Crossing Signal Lights City Attorney Chandler introduced and read an ordinance promoting public safety by requiring each railroad company having tracks in Baytown to maintain a flagman or automatic signal devices at street crossings in tie City of Baytown., Councilman Campbell moved to amend the ordinance to allow a 60 -day time limit to all _ present railroad compatdes operating within the city limits to meet the require- ments of the ordinance and to adopt the ordinance as amended. Councilman- Buelow seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron Buelow !� Campbell it Reeves 11 Williams 329 The caption of the ordinance was as follows: ORDINANCE NO. 100 AN ORDINANCE TO PROMOTE PUBLIC SAFETY BY REQUIRING EACH RAILROAD COMPANY HAVING A TRACK OR TRACKS CROSSING STREETS WITHIN THE CITY OF BAYTOWN, TEXAS, TO MAINTAIN A FLAGMAN DURING THE TIME SAID STREETS ARE BEING CROSSED BY TRAINS OR, IN LIEU THEFWF, RDQUIRING AUTOMATIC SIG- NAL DEVICES; REPEALING ORDI14ANCES INCONSISTENT HERWITH; CONTAIIQING A SAVINGS CLAUSE; PRESCdIBING A MAXIMUM PENALTY OF ONE HUNDRED ($100.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND THE EFFECTIVE DATE THEREOF. Oil Drilling Permits Councilman Reeves moved to approve the Eddy Refining Company application on The John Cook and Mattingly Leases pending the arrival of the bonds. Councilman Buelow seconded the motion. Reasor drilling application on city property located behind the Memorial Hospital pending the arrival of the bond and plat. Councilman Reeves seconded the motion. Reasor and City of Baytown The City Attorney introduced and read the following resolution: RESOLUTION A RESOLUTION AUTHORIZING THL MAYOR AND THE CITY. CLERK TO EXECUTE A LEASE FROM THE CITY OF BAYTONN To G. L. REASOR, :iAID LEASE COVERING THREE (3) TRACTS OF CITY PROPERTY. "WHEREAS, the City of Baytown has advertised for bids on City property; and "WHEREAS, G. L. Reasor was high bidder on three (3) tracts of said City's property; and "WHEREAS, the bid of G. L. Reasor has been accepted by the City of Baytown; "NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWNI "Section 1s THAT the Mayor and City Clerk of the City of Baytown be and are hereby authorized to execute a lease to the said G. L• Reasor; ' "Section 2: THAT the property is fully described in said lease dated the 29th day of November, 1950, and made a part of this resolution for all intents and purposes. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron " Buelow " Campbell Reeves Williams Nurse Fare to Atomic Nursing School Councilman Buelow moved to withdraw 475.00 from the Contingent Fund and do- nate to a local County Health Nurse for the purpose of providing transportation, room rent and food for a five (5) day Nurses' Training School on Atomic J:arefare which is to be held at New Orleans. The nurse will conduct special classes with all local nurses when she returns. Councilman Campbell seconded the motion. If Attorney Chandler is called into the Service or leaves the city for any reason, the requirements will revert to the original setting. Councilman Reeves seconded the motion. If the Baytown Chamber of Commerce is planning on decorating the tree for Christmas the tree will be allowed to stand until after the first of the coming year. Councilman Reeves seconded the motion. Councilman Bergeron seconded the motion.
