1950 11 23 CC Minutes, Special321 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CTTY OF BAYTOWN, TEXAS November 23, 1950 The City Council of the City of Baytown, Texas met in special session on Thursday, November 23, 1950 at 7.00 o'clock p.m. in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward R. B. Bergeron E. W. Buelow Milton L. Campbell R. H. Pruett W. C. Williams C. D. Middleton George Chandler Inez Mendenhall Absent: Y4. D. Reeves Edna Oliver The Mayor called the meeting to order. Drilling Permits Mayor Councilman Councilman Councilman Councilman Councilman City Manager City Attorney Acting City Clerk Councilman City Clerk Councilman Pruett moved to approve the drilling application of the G. L. Reasor Company on the C. Q. Alexander lease. Councilman Bergeron seconded the motion. The roll call vote was as followss Roll Calls Ayess Mayor Ward Nayes: None Councilman Bergeron it Buelow it Campbell " Pruett " William Councilman Campbell moved to approve the application of the Muckelroy Drilling Company on the A. W. Iamb lease. Councilman Buelow seconded the motion. The roll call vote was as follows$ Roll Calls Ayes, Mayor Ward Nayes$ None Councilman Bergeron " Buelow " Campbell Pruett " Williams Charges - Policemen The Mayor opened the meeting for discussion on the charges made against Chief of Police McKee and Asst Chief of Police Montgomery of allowing gambling in certain sections of Baytown when pay offs have been made. Two affidavits, made by Ike Spencer, colored, were introduced. The first affidavit, dated November 17, 1950, was presented by Corporation Court Judge 0. S. McCullough. This affidavit accused Asst Chief Montgomery of taking money from Spencer as a bribe in order to allow gambling at his place of business. The affidavit also stated that Spencer furnished Montgomery and McKee cases of beer for which no pay was received. City Attorney Chandler and Attorney Howard Boyles had witnessed the affidavit. Chief McKee presented an affidavit signed by Spencer on November 22, 1950 before C. D. Little, local attorney, and two witnesses, J. H. Frazier and Monroe Pryor, in which he, Spencer, denied the charges contained in the first affidavit. He stated that he had signed the first affidavit under pressure and was afraid not to sign it. Corporation Court Judge 0. S. McCullough denied that the negro was abused in any way. He stated that the negro had made the statement freely. Two discharged policemen, F. W. Vetuski and Joe Shaughnessy, and a former city patrolman Edgar Rountree, testified that each had either been told or made to under- stand otherwise that they were to overlook gambling in certain sections of town. 322 Charges - Policemen (Continued) Chief McKee read a bulletin which had been posted on the police bulletin board since August 31, 1948- It ordered all patrolmen to raid dice, poker and gambling games of any kind. McKee said the bulletin had been displayed on the board at all times until taken down to present to the Council at this hearing. The Mayor suggested that the hearing rest until further investigation can be inade. Adjournment Councilman Bergeron moved to adjourn. Councilman Pruett seconded the motion.
