1950 10 30 CC Minutes, Special815 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTONN, TEXAS October 301 1950 The City Co uncil of the City of Baytown, Texas met in special session on Monday, October 302 1950 at Do'clock p. m. in the CounciL.Room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor R. B. Bergeron Councilman Milton L. Campbell Councilman R. H. Pruett Councilman W. D. Reeves Councilman W. C. Williams Councilman C. Darwin Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk Absent: E. W. Buelow Councilman The Mayor called the meeting to order. Building Ordinance The City Attorney introduced the proposed Building Ordinance for discussion. The ordinance was amended to read: "Section 2: Outside Fire Limit Area or 'Lone No. 1 and Fire Limit Area or 'Lone No. 2, one family dwellings and one and two apartment dwellings, used exclusively for residences, are hereby exempted from this ordinance and its provisions excapt as follows: "No frame residential building or garage may be built less than five (Sj feet from a side or rear property line with these exceptions: (1) If at least a ten foot (101) easement has been granted in a rear or side property line, this restriction shall not apply to the property line adjacent thereto. (2) A garage located not less than ten feet (101) from residence may be located not less than two feet (21) frpm a side or rear property line. (3) If residence and garage are attached so as to be one building, the unit thus considered must be not less than five feet (5') from rear or side property line. (4) All separate fume building located on the same prol�prty which are used as residential property must be not mt' &,than ten feet (101) apart." Section 3 Page 26 was amended to read as followss "Outside Zone No. is" The Last paragraph in the orginal ordinance was deleted from the amended ordinance. With these changes Councilman Reeves moved to adopt theordinance as amended. Council- man Campbell seconded the motion. Pruett Reeves 'Williams The caption of the ordinance was as follows: ORDINANCE NO. 98 AN ORDINANCE PROVIDING FOR FIRE LIMITS; AND REGULATIONS GOVERNING THE CONSTRUCTION, ALTERATION, EQUIPMENT AND REMOVAL OF BUILDINGS AND STRUCTURES WITHIK THE CITY LIMITS OF BAYTOWN, TEXAS; REPEALING ORMINANCES INCONSISTENT HERE- WITH; CONTAINING A PENALTY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE AND THE EFFECTIVE DATE HEREOF. Taxes - St John Methodist Church The Council authorized the City Attorney to handle the delinquent tax problem on property belonging to the Saint John Methodist Church. 316 Easement — Sidewalk Wynnewood Addition Councilman Campbell moved to accept an easement for sidewalk purposes, five (51) feet in width extending from 4th street Drive to South Circle Drive parallel to the west or north west line of 7th Street Drive as dedicated uy the Basswood Building Company and Baytown Developers, Inc. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Calls Ayes: Mayor Ward Nays: None Councilman Bergeron Campbell a Pruett U Reeves , It Williams Electrical Ordinance It was agreed to defer action on the proposed electrical ordinance until a later date. City Land — Lease for Oil The Mayor presented a letter from C. J McAlpin who expressed a desire to lease, for oil prospecting purposes, a 5.8 acre tract and a 2.5 acre tract owned by the City. Councilman Pruett moved to advertise for bids on the leasing of the city owned property allowing no more than a 90 day lease to any bidder. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Call: Ayes: mayor Ward Nays: None Councilman Bergeron u Campbell u Pruett u Reeves " Williams Adjourn Councilman Pruett moved to adjourn. Councilman Campbell seconded the motion. The ayes were unanimous and the Mayor declared the meeting adjourned. Reconvene The Mayor called the meeting back into session. Councilman Pruett moved to lease the 3 acre tract of land owned by the city and located in the Pelly Addition to the City of Baytown. This portion to be leased less theportion actually used by the city. Councilman Reeves seconded the Motion.
