1950 10 24 CC Minutes312 MINUTES CF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS October 24, 1950 The City Council of the City of Baytown, Texas met in regular session on Tuesday, October 242 1950 at 7:30 p. m. in the Council Room of the Baytown City Hall with the following members in attendances J. A. Ward Mayor K. B. Bergeron Councilman E. W. Buelow Councilman Milton L. Campbell Councilman R. H. Pruett Councilman W. D. Reeves Councilman W. C. Williams Councilman C. Darwin Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, and the minutes of the regular meeting of October 10, 1950 and the special meeting of October 161 1950 were read and approved, whereupon the following business was tr ansacteds Drilling Permits Councilman Pruett moved to approve the two drilling applications of the Eddy Refining Company on the Grady W. Strother lease and the Clint 0. Duke Lease. Council- man Buelow seconded the motion. The roll call vote was as follows Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron it Buelow Campbell " Pruett !' Reeves '! Williams Councilman Pruett moved to approve the drilling application of Grady Whiteside on the M. H. Beilstein Lease. This application approved subject to the presentation of the bond and certificate of insurance. Councilman Williams seconded the motion. The roll call vote was as follows: Roll Calls Ayess Mayor Ward Nays: None Councilman Bergeron to Buelow to Campbell 's Pruett of Reeves to Williams Councilman Pruett moved to approve the drilling application of G. L. Reasor on the Grady Huron Lease subject to the presentation of the bond and certificate of insurance. Councilman Williams seconded the motion. The roll call vote was as followss Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron U. Buelow Campbell Pruett !' Reeves Williams Street Light Approved Councilman Pruett moved to approve the installation of a street light at the intersection of Graham and Dailey near the Baptist Temple. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Calls Ayes: Mayor Ward Nays: None Councilman Bergeron u Buelow a r Mtll eves Williams 313 J. J. Rady Report Mr. H. S. Berlin presented a print of data on the drainage ditch along the west side of 4th dndd7th streets in the iynnewood Addition. He also presented an estimate on the construction cost to pave Pierce Street from Commerce to Main. The concrete slab base will be $5,070 and asphalt on shell base will be $2,840. Councilman Campbell moved to cut the street and lay a shell base,only, at an approximate cost of $1,600. Councilman Pruett seconded the motion. Mayor {Yard asked the Councilmen to consider withdrawing their motions until such time as the City Manager can check with the Humble Oil and Refining Company on a participationplan for the street. If the Humble Compapy should desire to participate ag asphalt bane, with shell, can be laid for the $1,600. The motions were withdrawn for the present time. Sale Water Pumps Councilman Campbell moved to authorize the City Manager to contaci-Layne —Texas Company and the Texas Waterwells Company concerning the sale of two (2) obsolete well pumps what will have to be removed in order that Pierce Street can be opened. Sale and disposal of pumps to. be given to the highest bidder. Councilman Buelow seconded the motion. Reeves it Williams Remove Parking Meter Councilman Bergeron moved to instruct the City I°anwger to have the parking meter at the corner of 'Nest Texas and South. Pruett removed as it is a traffic hazard. Councilman Buelow seconded the motion. The roll call vote wasas follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron a Buelow It Campbell Pruett " Reeves ° Williams Fire Marshal Ordinance The City Attorney introduced and read an ordinance creating the office of Fire Marshal for the City of Baytown. Section 6 was amended to reads "Provided, however, that said owner shall have a right to appeal to the City Council before said order shall become final and effective." With this amendment Councilman Bergeron moved to adopt the ordinance as read. Councilman Campbell seconded the motion. The roll call vote was as follows: Boll Calls Ayess Mayor Ward Nayss peeves Councilman Bergeron to Buelow It Campbell ^' Pruett !s Williams The caption of the ordinance was as follows: ORDINANCE NO. 97 F AN ORDINANCE CREATING THE OFFICE OF FIRE MARSHAL FOR THE CITY OF BAYTGY N; PROVIDING FOR THE INVESTIGATION AS TO THE ORGIN OF FIReSj DECLARING THAT THE 3RE MARSHAL SHALL CONDUCT EXAMINATIONS FOR THE CAUSES OF FIRES; PROVIDING FOR THE SUMMONING AND COMPELLING THE ATTENDANCE OF WITNESSES; GIVING THE FIRE MARSHAL THE POWER TO ENTER AND EXAMINE. BUILDINGS; CONTAINING A PENALTY CLAUSE; PROVIDING A SEVERABILITY CLAUSE AND FOR THE EFFECTIVE DATE HEREOF. 314 Building Ordinance Councilman Campbell moved to refer the proposed building ordinance to building Committee for final observation; recommendations for changes to be at the next meeting. Councilman Buelow seconded the motion. The roll call as follows: RollCall: Ayes: Mayor Ward Nays: None Councilman Bergeron 11 Buelow U Campbell U Pruett Is Reeves It Williams Mayor — Expenses the original presented vote was Councilman Reeves moved to reimburse the Mayor $40-00 for expenses suffered while being subpoenaed as witness in the case of Cleve Dickens and Elmo Anderson two local policemen. Councilman Pruett seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Adjournment Councilman Bergeron It Buelow to Campbell to Pruett 't' Reeves It Williams Nays: Mayor Ward Councilman Campbell moved to adjourn.
