1950 10 02 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS October 2, 1950 The City Council of the City of Baytown, Texas met in special session on Monday, October 2, 1950 at 7: otclock P.M. in the Council Room of the Baytown City Hall with the following in attendance: J.A. Ward R.B. Bergeron E.W. Buslow M.L. Campbell R.H. Pruett W.D. Reaves W.C. Williams C. Darwin Middleton George Chandler Inez Mendenhall Mayor Councilman Councilman Councilman Councilmen Councilman Councilman City Manager City Attorney Acting City Clerk The Mayor called the meeting to order. He stated that the meeting was called for the purpose of discussing the Taxicab ordinance. SIX MONTHS AUDIT REPORT Mr. Theron Dossey Jr. presented tothe Council the six months audit report, stating that the finances of the City were ingood order and that the department had done a splendid job with t he present net up and promised a complete audit report soon. Action on the report will be taken at a later date. DISCUSSION ON TAXICAB ORDINANCE Mr. C. Q. Alexander came before the Council representing the Tumnell Transit Company, asking the Council to enforce the Bus Franchise, sectionll, was the part not being enforced, according to Mr. Alexander. Attorneys C.D. Little and Ervin Flowers, representing the Red Top and Safeway Cab Companies. The Taxicab Compamies asked for a rate of two miles for twenty -five (250) cents instead of the thirty-five(350) cents now being charged and fifty (500) cents for phone calls, and were opposed to metering the taxicabs. TAXICAB ORDINANCE NO. 9 City Attorney Chandler introduced and read Ordinance No. 93 ORDINANCE NO. 93 The Caption of The Ordinance is as f ollows: AN ORDINANCE REGULATING TAXICAB TRANSPORTATION,DEFININF TERMS, PROVIDING FOR ENFORCEMENT, REQUIRING PERMIT AND INSPECTION,RE- QUIRING CERIFICATE OF PUBLIC CONVENIENCE AND NECESSITY, FEQUIRING STATE CHAUFFEUR'S LICENSE, SPECIFYING FATES AND FARES TO BE C ARCED, SEQUIRING TERMINALS, REQUIRING PERFORMANCE BOND AND INSURANCE, REQUIRING SPECIFIED SIGNS ON TAXICABS, REQUIRING PAY - 14ENT OF AD VOLOREM TAffi, SPECIFYING NUMBER OF PERSONS WHO MAY RIDE IN TAXICAB, PROHIBITING CTUISING, PROHIBITING SOLICITING PATRONS REQUIRING TAX DRIVERS TO CONVEY PASSENGERS, SPECIFYING REGULATIONS ON DRIVERS, PASSENGERS, LOST ARTICLES, SPECIFYING LIMITATIONS ON GRANT OF PERMIT AND PROVIDING FOR SUSPENSION REVOCATION, TERMINATION OR CANCELLATION OF PERMTS, SPECIFYING PERMIT FEES, RUi2UIRINC REPORTS AND RECORDS, PROVIDING FOR TAXI METERS, $SQUIRING PASSENGERS TO PAY FARES, PROVIDING FOR OPERATIONS THROUGH DIVISIONS, PROVIDING FOR PENALTIES, PROVIDING A SAVINGS CLAUSE, PROVIDING A REPEALING CLAUSE, AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. After much discussion, Councilman Reeves moved that section 20, of the ordinance, which specified the metering of taxicabs be adopted as read. Council man Buelov seconded the motion. The roll can vote was as follows: RILL CALL: AYES Mayor Ward Nays Councilman Buelow Councilman Bergeron 305 306 Councilman Campbell " Reeves Councilman Pruett n Williams SECT Councilman Reeves moved that section 6, read as follows: The rate or fare for one passenger shall be thirty -five (35¢) cents for the first one mile, or fraction thereof, and five (5¢) cents for each additional one -half mile, or fraction thereof, and ten(10¢) cents for each additional passenger regardless of distance traveled. Councilman Buelow seconded the motion The roll call vote was as follows: ROLL CALL: AYES Mayor Ward NAYS: Councilman Bergeron " Buelow Campbell Councilman Pruett " Reeves " Williams SECTION 12 Section 12, was deleted in its entirety and now reads: SECTION 12 STANDARD COLORS _USED All Taxicab permit owners shall adopt a standard color or combination of coloes and shall not operate a taxicab untill all of said taxicabs are painted the color or combination of colors adopted bg the permit owner. MINOR CHANGES Several other minor changes were made in the ordinance, after which the City Attorney re -read the entire ordinance with the new changes. Councilman Camp- bell moved to adopt the ordinance as read. Councilman Bergeron seconded the motion. The roll call vote was as follows: ROLL CALL: AYES ADJOURN Mayor Ward Councilman Bergeron " Buelow " Campbell " Pruett " Reeves HAYS:: Councilman Williams Councilman Bergeron moved to adjourn.
