1950 07 20 CC Minutes277 MINUTES OF THE REGULAR MEETING OF THE ._,CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS July 20, 1950 The City Council of the City of Baytown, Texas met in regular session on Thursday, July 20, 1950 at 7:30 P. m. in the Council Room of the Baytown City Hall _ with the following members in attendance: J. A. Ward Mayor E. W Buelow Councilman Rufus Bergeron Councilman Milton L. Campbell Councilman R. H. Pruett Councilman W. D. Reeves Councilman W. C. Williams Councilman A. V. Darwin Middleton City Manager The Mayor called the meeting to order, and the minutes of the n: gular meeting of July 6, 19:0 and the special meeting of July 7, 1950 were read and approved, where- upon the following business was transacted: Ordinance No. 81 The City Attorney introduced and read an ordinance authorizing the Mayor to execute a contract with the Houston Lighting & Power Company on street lighting. Councilman Campbell moved to adopt the ordinance as read. Councilman Reeves seconded the motion. The roll call vote was as follows: Roll gall: Ayes: Mayor Ward Nays: None Councilman Bergeron It Buelow ^ Campbell ^ Pruett to Reeves e Williams The caption of the ordinance was as follows: ORDINANCE NO. 81 AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT' WITH THE-HOUSTON LIGHTING AND POKER COMPANY, A CORPORATION DULY ORGANIZED AND EXISTING UNDER AND BY VIRTUE OF THE LAWS OF THE STATE OF TEXAS, WHOSE HOME OFFICE IS IN THE CITY OF HOUSTON, HARRIS COUNTY, TEXAS, FOR AND ON BEHALF OF THE CITY OF BAYTOWN, IN CONNECTION WITH THE INSTALLATION, MAINTENANCE, AND OPERATION OF A STREET LIGHTING SYSTEM, AND FOR THE CHARGES INCIDENT THERETO, AND OTHER PROVISION, ALL OF WHICH SAID PRO_ VISIONS ARE MORE FULLY SET FORTH IN SAID CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART =iEOF. 011 Drilling Permits Councilman Pruett moved to approve the oil drilling applications of the Gulf Oil Corporation on Texas Lease No. 32283, Wells No. 8, 11, 12, 13 and 14.. Council- - man Bergeron seconded the motion. Rady Engineering firm, presented estimates of material costs on a proposed street improvement program which-included Main Street from the "Y" in "Old Baytown" to the city limit lines of former Goose Creek, The estimates are listed as followst Projects New Concrete Pavement 401 -01 F to F curb City Furnishing nc e e $ 105095.00 City Furnishing Transit Mix Concrete 1199198.00 Contractor 2509915-00 Projects Widen Existing 201-01 Pavement to 401-01 F to F Curbs, Save Existing C oncrete City Furnishing Concrete Aggreg�— — 0 65.,600.00 City - Furnishing Transit Mix Concrete 922983.00 Contractor 145,627.00 The Council agreed thatihe portion of Main which needed repairs j.mmediately lay between the Goose Creek bridge and the intersecion of Causeway Road. Storm sewers would have to be installed to provide adequate drainage facilities before a paving program could begin. Mr. Berlin was instructed to prepare estimates on the cost of materials and installinn of storm sewers along this section of West Main. The estimates were to be submitted to each councilmember before Augtist lat. - Drainage The Stayor gave instruction to have the Acting City Engineer check and give an estimate on the cost of installing adequate drainage pipe at a point on Market Street opposite the Dairy Queen Ice Cream Building. Since curb and gutter had been placed along the property line of the Goose Creek Independent District the present pipe was not sufficient to take care of the drainage situation and the overflow flooded the area around the Dairy Queen Building and the Quack Shack. Building Ordinance Councilman Reeves presented a list of twenty-two (22) deletions and five (5) amendments to the proposed building ordinance; one section of the proposed ordinance to be checked with the present city ordinance for conflictions. Councilman Pruett suggested that each Councilmember take a copy of the proposed ordinance and make an extensive study before an ordinance is prepared for presentation. Sewer Line Upon the request of Councilman Bergeron the Council agreed to allow all pro- perty owners on the North side of Cedar Bayou Road to tie dnto the dewer line which is being laidlat present„-provided, they bear all the cost of material, tapping fees and cost of crossing road to sewer line. Pipe for Stock Pile Councilman Reeves moved to, authorise the Director of Finance to prepare an estimate on the total footage and cost of 80 water.main needed to connect Pally and Baytown; to apply the $102000 now in the Emergency Fund on the purchase price. Councilman Bergeron seconded the motion. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Calls Ayes: Mayor Ward Nayst None Councilman Bergeron is Buelow it Campbell w Pruett t' Reeves Williams - Corporation Judge - Salary Councilman Buelow moved to approve the reduction of the Corporations Judge's salary from $200.00 per month to $150.00 as per agreement. This reduction to be- come effective as of August 1, 1950. Councilman Beeves seconded the motion. Williams Corporation Judge - City Attorney The City Attorney presented a written memorandum to the Council charging the Corporation Judge with illegal practice and procedure. The five offences are listed as follows 1. Failed to turn over to the City some of the money that was given to him in payment of fines. 2. Working City prisionera in his private business 3. In trying defendants improper procedure was often employed by him 4. Failure to cooperate with city Sanitarian 5. Violated the Texas Penal Ode by selling concrete to the City of Baytown After a short discussion of the charges the Mayor asked that a special meet- ing be held the following evening, Friday, July 21st, forthepurpose of allowing the Corporation Judge to appear personally and answer the charges made against him by the City Attorney. Taxi Cab Ordinance Request C. Q. Alexander, co -owner of the Tunnel Transit Company, Inc., asked the Council for a workable and legitimate Taxi Cab Ordinance. He based his request on the fact that the ordinance now in effect is not a Taxi Cab Ordinance but rather a Jitney Ordinance. The Mayor appointed a Committee composed of Councilmen; Reeves, Bergeron and Williams to w rk with the City Attorney in compiling a workable ordinance. Adjournment Councilman Pruett moved to adjourn.
