1950 05 10 CC Minutes, Specialr r 257 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS May 10, 19$0 The City Council of the City of Baytown. Texas met in special session on Wed - nesday, May 10, 1950 at 700 p. m, in the Council Room of the Baytown City Hall with the following members in attendance: J. A. Ward Mayor R. B. Bergeron Councilman E. W. Buelow Councilman !I. I. Davis Councilman R. H. Pruett Councilman J. A. Stroud Councilman W. C. Williams Councilman Milton L. Campbell Councilman Willie D. Reeves Councilman C. Darwin Middleton City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order. The Special Election returns of April 29, 1950 were canvassed. Auditor's Report At he request of the. Council, T. B. Trotter C.P.A. and City Auditor, appeared to discuss certain statements contained in his recent audit report. Mr. Trotter introduced F. R. Houlihan and gsked that he he allowed to explain the "Z9,0DO shortage" between the controls and the trial balances. Mr. Houlihan informed the Council that this was not in terms of dollars and cents as all the moneys had been accounted for in each instance, but the shortage was shown on the so- called control sheets. Due to certain mis- understandings arising between the persons in charge of the accounts, customer's account sheets were changed indiscriminately throughout the year thus making an audit of water accounts impossible. The reason for the errors nee because no one appreciated the keeping of accurate records. Too, there had been no approved system kept which would afford a cross balance check. Councilmen Buelow, Campbell and Mayor Ward questioned the auditors at length rela- tive to the water department and then the corporation court records were brought into discussion. Mr. Houlihan told the Council that the only records whjkch could -rw*� be audited were the Court Docket Books. Judge Hunter had not posted the docket book since April, 1949. It was required by law that a docket book be kept on each and every offense and the disposition of each case. This manner of book- keeping would provide knowledge of the amount collected and the amount due the city. Too, repeated offenders, who ignore fine assessment, could be easily detected if a complete docket was kept. The individual fine receipts that were retained as re- cords had been balanced and the money accounted for but this method did not provide an accurate audit. The Council thanked the Auditors for their report and promised corrections in each case. Resolution City Attorney Chandler introduced and read the following resolution. RESOLUTION A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTCNN ON THE 29TH DAY OF APRIL, A. D., 1950, FOR THE PURPOSE OF ELECTING TWO (2) COUNCIL- MEN FROM DISTRICTS NOS 4 AND 5; DECLARING THE RESULTS OF SAID ELECTION ; FINDING THAT NOTICE OF SAID FT TION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS DULY AND PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF TTiE STATE OF TEXAS WHERE AS, the City Council of the City of Baytown at its special meeting held on this the 10th day of May, 1950, proceeded as required by law to canvass the re- turns of the special municipal election held in the City of Baytown on the 29th day of April, 1950, for the purpose of electing two (2) councilmen from Districts No. 4 and No. 5, said election halving been held under and pursuant to the provisions 258 of the charter of said city and an ordinance duly passed on the 12th day of April, 1950, calling said election, and WHEREAS, said election having been duly and regularly had and held as called in said ordinance and according to law and the returns thereof having been duly made and the election judges having certified the results of said election as -here- inafter set out and the City Council having duly•and regularly canvassed the.re- turns of said election and finding that the total votes cast at said election were as follows: to -wit: For Councilman from District No. 4 Sam G. Como 441 Votes_ Milton L.Campbell 765 Votes. For Councilman from District No. 5 Mrs. Cuba Greer 538, Votes Willie Dearmon Reeves 666 Votes. and WHEREAS, the City Council of the City of Baytown finds the election returns as set out above to be accurate and correct and no election protest or contest having been filed with said council or instituted in connection with said election, NCW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1. THAT Milton L. Campbell received a majority of the votes cast at said election for the office of Eouncilmah from District No. )t and accordingly, the said Milton L. Camphell is hereby declared elected to the office of councilman from District No. 4 of the City of Baytown. . Section 2e THAT Willie Dearmon Reeves received a majority of the votes cast at said election for the office of Councilman from District No. 5 and accordingly, the said Willie Dearmon Reeves is hereby declared elected to the office of council- man from District No. 5 of the City of Baytown.' Section 3. THAT -the City Council of the City of Baytown further finds that the notice of said election was duly and properly given as required by law and that said election wqs duly and regularly held and the returns thereof duly and regularly made by the proper officials of said election, and in all things accord- ing to law. INTRODUCED, READ and PASSED by the afformative vote of the majority of the menbers of the City Council of the City of Baytown, this the 10th day of May, 1950• /s/ J. A. Oath Administered to CouncilmeniCampbell and Reeves Councilman Williams administered the oath of office to Councilmen Milton L. Campbell and Willie D. Reeves for the two (2) ensuing years as elected Councilmen from Districts No. 4 and 5 respectively. At this point Councilmen Davis and Stroud left the table and their places were taken by the aforesaid newly elected officials. Appointment J. R. Read and E. Hoffpauir - Housing Authority Board Councilman Buelow moved to approve the appointment of J. Rodger Head and E. Hoff - pauir to the Housing Authority Board. Councilman Williams seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron It Buelow It Campbell " Pruett Reeves !' Williams Mayor Pro; Tem Councilman Campbell moved to approve the appointment of R. H. Pruett as Mayor Pro Tem. Councilman Reeves seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Councilman Bergeron It Buelow It Campbell It Pruett It Reeves !! Williams C. Q. Alexander - Bus Line Councilman Pruett moved to approve the new proposed bus route fif the Tunnel Transit Company. The proposed route would come down Market. West Main, Hill, Florida, Kentucky, New Jersey, Huggins, Finley, San Jacinto Avenue, Market and back to place of beginning. Councilman Bergeron seconded the motion. The roll call vote was follows: Roll Call: Ayes: Mayor Ward Nayss None Councilman Bergeron It Campbell It Buelow 1t Pruett Reeves Williams Councilman Bergeron moved to adjourn.
