MINUTES OF A SPECIAL MEETING OFTHE
C17Y COUNCIL OF THE CITY OF BAYTOWN, TEXAS
February 13, 1950
The City Council of the City of Baytown, Texas, met in a special meeting on
Monday, February 13, 1950, at 8:00 P. m. in the office of the City Manager at-the
City Hall with the following members in attendances

Mayor Ward opened the meeting stating that it had been called by the City Clerk
upon his request. The purpose of the meeting was to arrive at a decision on the bHild-
ing permit application of the Humble Oil and R fing Company for a 8" wall addition
to their station located at Texas and Main. The Mayor said that if this request was
granted it would be in direct violation of the present zoning and building ordinances,
however, he urged the council to take final action. He said that he felt the re-
quirements were unjust 6jue to the location of the station, but if the city had an
ordinance it was necessary for the council to abide by the riles or make an amendment
to allow for similar situations that might arise in the future.
Fire Chief Linbelman stated that it would be necessary for any contractor to
use 12" walls on a 12, or 15' building even though pilasters were used for. support.
Cc uncilman Pruett contended that the code should be changed rather thanuthe
property owners made to suffer penalities for violations ofthis type or refusal of
permits in certain areas.
Councilman Williams reasoned that if no decreased rate was given, regardless of
what was done to eliminate the deficiency, he thought the ordinance should be amend-
ed rather than penalize all property owners under the present code.
Councilman Daiis was not in favor of complete violation of the present code
and if the 8" wall was allowed within the No. 1 Fire Zone this would be a direct viol-
ation to the code and the building ordinance, however, he f81t that an amendment dsould
be made to allow such changes in conditions where the building in question was not
abutting other buildings.
Councilman Godfrey was of the opinion that the sensible thing to do would be to
work with the Insurance Commission. If contractors were allowed the 8" walls in the
No. 1 Zone the insurance rate would never be lowered, however, if the city worked
with the Fire Insurance Commission of the State itvas possible to have a lower rate
at some future date.
Councilman Pruett moved to amend the present building ordinance and require
8e walls, thus eliminating the No. 1 Zone.
Councilman Stroud favored the amendment of the present ordinance to 8" walls.
Mayor Ward recommedned that the City Council adopt the National Code with
some of the State of Texas requirements, as endorsed by Mr. Hawley.
After a lengthy discussion, it was decided to retain the present Ordinance
with the No. 1 and No. 2 Fire Zones as stipulated until such time as a code can be ua
adopted which will allow exceptions in cases of this type. The City Manager was
instructed to notify the Building Department to issue a permit for a 12" wall only.
Councilman Pruett moved to adjourn.
Councilman Bergeron seconded the motion.
The ayes were
unanimous and the Mayor declared
the meeting adjourned.
