1950 01 19 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF RAYTOWN, TEXAS January 19, 1950 The City Council of the City of Baytown, Texas met in regular session on Thursday, January 19, 1950 at 7:30 p. m. in the Council Room of the Baytown City Ball with the following members in attendance: J. A. Ward Mayor Rufus Bergeron Councilman H. I. Davis Councilman Fahy Godfrey Councilman J. A. Stroud Councilman R. H. Pruett Councilman W.G. Williams Councilman C. Darwin Middleton City Manager David Donoghue City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, and the minuteaoof the regular meet- ing of January 5, 1950 were read and approved, whereupon the following business -was transacted: Henry Cathriner - Pearce Avenue Opening A petition, with approximately 200 signatures, was presented to the council members by Henry Cathriner with the following request: "Recognizing the need for more through streets in our city, the undersigned property owners respectfully petition your honorable body to open Pearce Avenue between Main and Commerce Streets. "As it is now, Pearce Avenue has a dead end at Whiting and a bottle neck at Commerce. It rightfully should carry its load of traffic so as to relieve the congestion of other streets which is caused by the conditions on Pearce Avenue. "By opening this railroad crossing, it would not only relieve the congested traffic on Texas Avenue, but it would give the city access from Pearce Avenue to Highway 146. This in turn would increase the development of adjacent properties and their subsequent taxable valuations." The Rumble 011 & Refining Company, the Southern Pacific Railroad Company_ and the City of Baytown would be the only property owners involved in the proposed 214' x 6011 right -o£- -way. The Council authorized the City Manager to enter into negotiations with the Humble Company and theSouthern Pacific Railroad Company for their portion of property required in the proposed opening for the right-of-way. He was to give a report on his findings at the next regular meeting of the council. Bids - Air Compressor and Ascessories The bids on the air compressor and accessories were opened and they are tabu- lated as follows: 1. Boehck Engineering Company 2. R. B. Everett & Company 3. Councilman Pruett seconded the motion. Hemphill Pontiac OMC- 2,168.27 6. Higginbotham Motor Cc GMC 2,101.00 Councilman Pruett moved to purchase the 8 cylinder Ford truck chassis. Council- man Davis seconded the motion. The roll call vote was as follows: Roll Call: Ayes. Mayor Ward Nays: None Councilman Bergeron " Davis n Godfrey " Pruett " Stroud " Williams W. L. Jones - Danubina Court Section 2A W. L. Jones, Jr., representing his parents, W. L. and Elizabeth J. Jones, presented a letter asking for final approval of Section 2A of Danubina Court in order to continue with the real estate and building development of Blocks 6, 7, and 8. In making this request, the developers had proposed.to top the streets in the addition promptly upon request of the City Manager or Director of Public Works in the manner set forth for double asphalt treatment as required by the Texas State Highway Depart- ment. As evidence of their good faith in the matter, . the developers agreed to submit to the city a performance bond or a cash bond acceptable to the city. After some dis- cussion, Councilman Pruett.moved to authorize the City Manager to have an estimate pre- pared on the cost of curb and gutter on East James Street, two (2) valley gutters and crown and base for the streets. The figure shall then be submitted to the developers in order that a performance bond may be provided to cover the cost. When the negotia- tions have been completed, Councilman Pruett moved to accept the final plat of Section 2A. Councilman Bergeron seconded the motion. The roll call vote was as follows: Roll Calls Ayes: Mayor Ward Nays: None Councilman Bergeron " Davis " Godfrey " Stroud " Pruett i Williams Rehabilitation of Water Towers Mr. B. F. Isms, Manager of the Mississippi valley Tank Company of lawton, Okla., gave a report on the city's elevated water tanks. He had made a preliminary inspection of the wells and found the two (2) tanks, one on South Main and the other in old Bay- town, were badly deteriorated and in immediated need of repair. The other two (2) tanks needed some repairs, however, there was no immediate danger connected with either. He proposed to make a thorough inspection of the four tanks at a cost of $100.00 cash, afterwhich, he would furnish the council with an expert recommendation on the cost of rehabilitation. Councilman Pruett moved to authorize the City Manager to proceed with negotiations for a thorough inspection of the two (2) tanks which were termed "unsafe ". Councilman Godfrey seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Mayor Ward Nays: None Council3an Bergeron It Davis " Godfrey " Pruett " Stroud " Williams Fire Zone Revision Ordinance The City Attorney introduced and read Ordinance No. 71 which placed the busi- ness districts of Pally and old Baytown in Fire Zone No. 2. Councilman Pruett moved to adopt the ordinance as read. Councilman Davis seconded the motion. The roll call vote was as follows: 224 Roll Calls Ayes: Mayor Ward Councilman Bergeron " Davis Godfrey ff Pruett " Stroud WillAims The caption of the ordinance was as follows: ORDINANCE NO. 71 January 19, 1950 Nays: None AN ORDINANCE DEFINING THE FIRE LIMITS OF THE CITY OF BAYTOWN; REPEALING ORDINANCES IN CONFLICT THEREWITH; PROVIDING X SEVERABILITY CLAUSE; AND CCUTAINING THE EFFECTIVE DATE THEREOF. Ordinance - Regulating Oil & Gas Wells Copies of an ordinance regulating the drilling and operations of oil and gas wells within the city limits were presented to the council members for their consideration and study. Action to be taken at a later meeting. Woods and Denman - Proposed Lubber Company Messrs. Woods and Denman, of the Home Lumber Company,, presented plans of a proposed lumber yard on their property on East Texas Avenue which property <is.now included within the No. 2 Fire Zone. The proposal included 81 masonry walls for the front.of the building,, however, the sides and back would be built of fire proof tran- site material with wooden frame. Mr. Woods reminded the council that he had been promised "consideration" at a meeting immediately following the passage of the No. 2 Fire Zone Extension Ordinance. Councilman Godfusy reasoned that if such a permit should be issued, all property owners within the city would be penalized because -the building did not conform to regulations. Councilman Bergeron was of the opinion that an exception should be made onthis proposed building as Mr. Woods had been promised consideration. Final action was postponed to allow time for father study. M. T. Ward - Ditches on Pegg Street Mr. N. T. Ward, representing residents on Peggy Street in AronAddition, asked the Council for some drainage relief in their section of the city. The streets needed drainage ditches out on either side to provide an outlet for the water. Promises had been made but so far no work had been done. Councilman Pruett moved to have the ditches cut and three (3) culverts installed as soon as weather permitted. Councilman Bergeron seconded the motion.
