1950 01 05 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,. TEXAS January 5, 1950 The City Council of the City of Baytown, Texas met in regular session on Thursday, January 5, 19% at 7:45, P.M. in the Council [bons of the Baytown City Hall k with the following members in attendance: J. A. Ward Mayor R. b. Bergeron Councilman Fahy Godfrey Councilman R. H. Pruett Councilman J. A. Stroud Councilman W. C. hilliams Councilman C. Darwin Middleton City Manager David Donoghue City Attorney Edna Oliver City Clerk Absent: H. I. Davis Councilmen The Mayor called the meeting to order, and the minutes of the regular meet- ing of Tuesday, December 20, 1949 and the minutes of the special meeting of Thursday, December 22, 1949 were read and approved, whereupon the following business was transacted: R. F. Williams - Gulf Tract Taxes R. F. Williams, representing the Gulf 011 Corporation, asked the Council for a tax proration on a portion of land disanneded in April, 1949. The disannexation ordinance had been presented for its forst reading in December, 19489 however, it , was not finally passed until April, 1949. Since such an ordinance was pending as of January 1, 1949, Councilman Pruett moved to prorate the 1949 city taxes for the period of time held within the city limits. Councilman Bergeron seconded the motion. The roll call vote was as follows: RollCall: Ayes: Mayor Ward Nays: None Councilman Bergeron e Godfrey it Pruett " Stroud " Williams Proposed Milk Ordinance The City Attorney submitted copies of a proposed Milk Ordinance which regu- lates milk producers and mauafacturers within the corporate limits. City Sanitarian Muennink advised the Council members that the ordinance conformed with the U. S. Public Health Code and carried the recommendation of the city:s Board of Health. He explained that with the passage of such an ordinance it would be possible to ban the sale of all milk products which did not conform to the health regulations. J.D. Jones - Building Fire Zone Mr, J. D. Jones, representing the Jones Lumber Company, asked the Council to consider his application for a building permit which had been refused on Decem- ber 21stand 22nd. The application designated a frame office and display room in the new No. 2 Fire Zone, however, the ordinance requiring the 8" masonry walls was not acted upon by the City Council until December 22, 1949, Mr. Jones based his contention on the fact that he had made application before the ordinance was finally passed. By way of explanation, City Manager Middleton advised the Council that the Building Department was aware of the proposed extension ordinance and they felt that any action on a frome building permit within this zone would have to come from the Council. After some discussion Councilman Bergeron moved to grant the re- quest and issue A permit. Councilman Godfrey seconded the motion. Carpenter - Building Jimmy Carpenter, Local Barber, asked permission to erect a masonry build- ing with 81s walls to replace frame buildings in the 100 block of Egst Texas Avenue. This section of the business district is now in the No. 1 Fire Zone which requires 1211 walls. At this point Fire Chief Lintelman presented a map outlining a proposed Fire Zoning Revision for the entire city. The proposal would place the 100 block of Fast Texas Avenue and the business districts of "old" Baytown and Pelly within the No. 2 Fire Zone. This would allow buildings of masonry type with 8e walla in sec- tions of the city where building has been curtailed because of the No. 1 'Lone require- ments. After some discussion Councilman Godfrey moved to approve the proposed Fire Zone changes and to instruct the City Attorney to prepare an ordinance accordingly. Councilman Bergeron seconded the motion. None Harry Levine, a representative of the Baytown Emergency Corpsj appeqled for an increase in the insurance coverage on the truck and equipment of the Emergency Corps. The City of Baytown had paid the insurance onthe truck for the year 1949- 1950, however, it covered fire, theft and windstorm only. Mr. Levine asked that the coverage be extended,.if possible, to allow collision and liability also. This would cost the city $184.30. Councilman Godfrey moved to grant the request and give the additional insurance coverage. Councilman Bergeron seconded the motion. Knights of Pythias - Change Meeting Nights The Council agreed to allow the Knights of Pythias to change their regular meetings from Wednesday to Tuesday nights of each week until football season begins. Miscelleanous The Chief of Police was instructed to check the complaint of Used Car Dealers using the non - metered sections of the business district as parking lots and block- ing streets and driveways. The City Attorney was instructed to investigate the gas rate charge of Baytown as compared to other cities of comparable size and give a report. The Council agreed to have an informal meeting with Corporation Judge E. E. Hunter on Tuesday, January 10th. The City Attorney was instructed to prepare an ordinance extending the vot- ing districts to include the recently annexed territory. Adjournment Councilman Pruett moved to adjourn.
