A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN
MUNICIPAL DEVELOPMENT DISTRICT AUTHORIZING AND DIRECTING
THE GENERAL MANAGER AND THE SECRETARY TO EXECUTE AND
ATTEST TO A CONTRACT WITH LONE STAR STRIPING AND PAVING,LLC
FOR THE ROLLINGBROOK SIDEWALK CONSTRUCTION PROJECT;
AUTHORIZING PAYMENT OF THE SUM OF SEVENTY-EIGHT THOUSAND
ONE HUNDRED EIGHTY AND NO/100 DOLLARS($78,180.00);MAKING
OTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS,the Board of Directors of the Baytown Municipal Development District did
authorize the City Engineer of the City of Baytown to advertise for bids for the Rollingbrook
Sidewalk Construction Project to be received November 16,2001;and
WHEREAS,notice to bidders as to the time and place,when and where the contract for said
construction would be let was published pursuant to provisions of Texas Local Government Code
Annotated§252.041;and
WHEREAS,all bids were opened and publicly read at City Hall at 2:00 o'clock p.m.,Friday,
November,16,2001,as per published notice to bidders;NOW THEREFORE
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN
MUNICIPAL DEVELOPMENT DISTRICT:
Section 1:That the Board of Directors of the Baytown Municipal Development District
hereby accepts the bid of Lone Star Striping and Paving,LLC for the Rollingbrook Sidewalk
Construction Project according to the plans and specifications set forth by the City Engineer of the
City of Baytown for the sum of SEVENTY-EIGHT THOUSAND ONE HUNDRED EIGHTY AND
NO/100 DOLLARS($78,180.00)and authorizes payment thereof,and the General Manager and the
Secretary of the Baytown Municipal Development District are hereby authorized and directed to
execute and attest to a contract with Lone Star Striping and Paving,LLC for the above-described
work,said contract containing the plans,specifications,and requirements of the City Engineer of the
City of Baytown and appropriate bond requirements in accordance with the provisions of Texas
Government Code,Chapter 2253.
Section 2:That the General Manager is authorized to contract for utility adjustments,
laboratory testing,and other professional services necessary to the operation and completion of the
project.
Section 3:That pursuant to the provisions of Texas Local Government Code Annotated
§252.048,the General Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO/100
DOLLARS($25,000.00)or less,subject to the provision that the original contract price may not be

increased by more than twenty-five percent(25%)or decreased by more than twenty-five percent
(25%)without the consent of the contractor to such decrease.
Section 4:This resolution shall take effect immediately from and after its passage by the
Board of Directors of the Baytown Municipal Development District.
INTRODUCED,READ and PASSED by the affirmative vote of the Board of Directors of the
Baytown Municipal Development District this the 20`h day of November,2001.
