A RESOLUTION OF THE BAYTOWN MUNICIPAL DEVELOPMENT
DISTRICT AUTHORIZING THE EXPENDITURE OF FUNDS FOR THE
COMPLETION OF THE MAIN LANES OF SPUR 330 FROM FAIRWAY
DRIVE TO IH-10 AND SUPPORTING TEXAS DEPARTMENT OF
TRANSPORTATION'S FUNDING OF THE PROJECT;AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
WHEREAS,Spur 330,which begins at the interchange IH-10 and extends approximately
4.5 miles to its intersection with State Highway 146,is one of the primary entrances into the City
of Baytown;and
WHEREAS,the Spur 330 Project(the"Project")includes the construction of the
following:
the two 2-lane frontage roads from State Highway 146 to IH-10,
a direct connector ramp from northbound State Highway 146 to westbound Spur
330,
➢the main lanes from State Highway 146 to Fairway Drive,and
-a six-lane freeway between the frontage roads,including three bridges to provide
grade separations at Baker Road,Bayway Drive,and the railroad crossing at
Wade Road;and
WHEREAS,construction contracts have been let for the following phases of the Project:
two 2-lane frontage roads from State Highway 146 to IH-10,
a direct connector ramp from northbound State Highway 146 to westbound Spur
330,and
>the main lanes from State Highway 146 to Fairway Drive;and
WHEREAS,because the City of Baytown's traffic flow is being impacted by the opening
of the Fred Hartman Bridge,completion of State Highway 146,the development of the Bayland
Marina,the expansion of the Port of Houston Authority Bayport Terminal,and expanding
residential development,the completion of the two lane frontage roads will not be enough to
provide a safe and efficient traffic flow through this corridor;and
WHEREAS,without the completion of the main lanes,undue safety hazards on the
citizens and motoring public will continue to increase;and
WHEREAS,the completion of the Project is absolutely vital to the City of Baytown and
will enhance the area's economic development potential,which will improve the socio-economic
environment:and
WHEREAS,the Board of Directors after reviewing the Project hereby finds that the
Project furthers the purposes of the Baytown Municipal Development District and qualifies as
"development project"as that term is defined in Section 377.001 of the Texas Local Government
Code:and
WHEREAS,funding by the Texas Department of Transportation has been requested to
complete the Project;and
WHEREAS,the Board of Directors of the Baytown Development District wants to
express its support of Texas Department of Transportation's funding of the project and to
authorize funds in support thereof under the conditions listed herein;NOW THEREFORE,
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN
MUNICIPAL DEVELOPMENT DISTRICT:
Section 1:That the recitals contained in the preamble of this ordinance are
determined to be true and correct and are hereby adopted.
Section 2:That the Board of Directors of the Baytown Municipal Development
District hereby supports both the completion of the main lanes of Spur 330 from Fairway Drive
to IH-10 in Baytown,Harris County,Texas,and Texas Department of Transportation's funding
of the remainder of the construction costs for the Spur 330 Project.
Section 3:That the Board of Directors of the Baytown Municipal Development
District hereby authorizes the expenditure of funds in the amount of TWO MILLION FIVE
HUNDRED THOUSAND AND NO/100 DOLLARS($2,500,000.00)for the completion of the
main lanes of Spur 330 from Fairway Drive to I1-1-10,contingent upon Texas Department of
Transportation's funding of the completion of the Project.
Section 4:This resolution shall take effect immediately from and after its passage by
the Board of Directors of the Baytown Municipal Development District.
