30-CCPDTransferringProperty2COBRESOLUTION NO. 30 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT TRANSFERRING ASSETS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT TO THE CITY OF BAYTOWN; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ******************************************************************************************** WHEREAS, on February 2, 2002, the Baytown Crime Control and Prevention District (the “District”) held a special election regarding the continuation of the District and the associated sales tax; and WHEREAS, a majority of the votes cast at the such election were not in favor of continuing the District for 10 years nor continuing the Crime Control and Prevention District sales tax for 10 years; and WHEREAS, due to the results of the election, the District was dissolved pursuant to the Crime Control and Prevention District Act (the “Act”) on August 2, 2002; and WHEREAS, on the date the District was dissolved, the District was required to convey or transfer the following items to the City of Baytown: title to land, buildings, real and tangible improvements, and equipment owned by the District; operating funds and reserves for operating expenses and funds that have been budgeted by the District for the remainder of the fiscal year in which the District is dissolved to support crime control activities and programs for residents of the City of Baytown; taxes levied by the District during the current year for crime control purposes; funds established for payment of indebtedness assumed by the District; and any accumulated employee retirement funds; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT: Section 1: That the Board of Directors of the Baytown Crime Control and Prevention District hereby conveys and transfers the following items to the City of Baytown in accordance with the Crime Control and Prevention District Act: title to land, buildings, real and tangible improvements, and equipment owned by the District; operati ng funds and reserves for operating expenses and funds that have been budgeted by the District for the remainder of the fiscal year in which the District is dissolved to support crime control activities and programs for residents of the City of Baytown; taxes levied by the District during the current year for crime control purposes; funds established for payment of indebtedness assumed by the District; and any accumulated employee retirement funds. Section 2: This resolution shall take effect immediately from and after its passage by the Board of Directors of the Baytown Crime Control and Prevention District.
