A RESOLUTION OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT ORDERING A REFERENDUM BE HELD ON THE 2ND DAY OF FEBRUARY, 2002, ON THE QUESTION OF WHETHER TO CONTINUE
THE BAYTOWN CRIME CONTROL AND THE CRIME CONTROL AND PREVENTION DISTRICT SALES AND USE TAX; DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS; ESTABLISHING
THE CENTRAL COUNTING STATION; PROVIDING FOR AN EARLY BALLOT BOARD FOR EARLY BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE.

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT:
Section 1: That a special election, pursuant to Sections 41.001
and 41.031 of the Texas Election Code, shall be held between the hours of seven o'clock a.m. and seven o'clock p.m. on the 2nd day of February, 2002, in the territory of the Baytown
Crime Control and Prevention District, which is the corporate limits of the City of Baytown, Texas, for the purpose of considering the following proposition:
PROPOSITION NO. 1
WHETHER
THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT SHOULD BE CONTINUED FOR 10 YEARS AND THE CRIME CONTROL AND PREVENTION DISTRICT SALES TAX SHOULD BE CONTINUED FOR 10 YEARS.
Section
2: That the proposition specified in Section 1 hereof shall be presented to the citizens of the District at large and the propositions shall be submitted in accordance with law. If
a majority of the votes cast at the special election favor the continuation of the Baytown Crime Control and Prevention District, the district and the associated sales and use tax shall
be continued.
Section 3: That the form of the ballot for this special election shall be substantially as follows:

Section 5: Each qualified voter who desires to cast an early vote shall be entitled to an official ballot
and the right to cast such ballot in accordance with the provisions of the Texas Election Code. Early voting will be conducted in the City Council Chamber of the City Hall of
the City of Baytown, located at 2401 Market Street, Baytown, Texas. Gary W. Smith is hereby appointed the early voting clerk.
Section 6: That the special election shall be held in
accordance with, and shall be governed by, the election laws of the State of Texas. The President and the Secretary of the Board of Directors of the Baytown Crime Control and Prevention
District shall do and perform each act as required to be done and performed respectively by the County Judge and the County Clerk of the Commissioners' Court. The notice of proclamation
of these elections shall be issued and posted on the bulletin board used for posting notices of meetings not later than the twenty first (21st) day before the date of the elections ordered
herein.
Section 7: The City Council Chamber and Conference Room area of the City Hall of the City of Baytown, located at 2401 Market Street, are hereby established as the Central Counting
Station to receive and tabulate voted ballots. The Secretary of the District is hereby appointed Manager of the Central Counting Station and also Tabulation Supervisor. Judy Craig
is hereby appointed Presiding Judge for the Central Counting Station.
Section 8: There is hereby created an Early Voting Ballot Board which shall process early voting results. Judy
Craig is hereby appointed Presiding Judge of the Early Voting Ballot Board.
Section 9: The President is hereby directed to give notice of said elections by publishing a copy of the
Election Proclamation and Notice in a newspaper of general circulation within the City of Baytown, Texas, said publication to be made no earlier than the 30th day or later than the tenth
day prior to the date of said elections.
Section 10: In addition to the notice requirements specified hereinabove, notice of the special election shall be given by posting a substantial
copy of this election resolution, in English and Spanish, at the City Hall and at three other places in the City, not less than 14 days nor more than 30 days prior to the date set for
the election; and a substantial copy of this election resolution, in English and Spanish, also shall be published on the same day in each of two successive weeks in a newspaper of general
circulation published in the City, the date of the first publication to be not more than 30 days and not less than 14 days prior to the date set for the election.
Section 11: In all
matters relating to the ordering, giving notice, and holding the elections, the District shall comply with the applicable parts of the Texas Election Code, including particularly Chapter
272 of the Texas Election Code pertaining to bilingual requirements and the Federal Voting Rights Act of 1965, as amended.
Section 12: This resolution shall take effect immediately
from and after its passage by the Board of Directors of the Baytown Crime Control and Prevention District.
INTRODUCED, READ and PASSED by the affirmative vote of the Board of Directors
of the Baytown Crime Control and Prevention District on this the 20th day of November, 2001.
