WHEREAS, BAWA conhacted with T&.0 Construction. Inc., for the BAWA Power Distribution
Systc n Project(the"Project'): and
W}-IERFAS,the constriction of the project is complete,except for minor punch list items;rind
WHEREAS, since the completed portion of the Project is operational and acceptable, T&C
Construction, Inc., has requested that the retainape for only the completed portion of the project be
reduced fromr5% to 2.5% and
WIiEREAS, due to the fact that the majority ofthe work.has been completed for some time, the
Board of Directors of the Ba}tomi Area Water Aulhortly believes that such request should he granted;
