A RESOLUTION OF THE BOARD OF DIRECTORS OF THE;BAYTOWN AREA WATER
AUTHORITY AUTHORIZING SEVENTY-ONE THOUSAND TWO HUNDRED SIXTEEN
AND 43/100 DOLLARS ($71,216.43) OF ADDITIONAL.FUNDING FOR THE RELOCATION
OF THE BAY'.TOWN AREA WATER AUTHORITY'S FACILITIES TO ACCOMMODATE
HARRIS COUNT'Y'S WIDENING OF THOMPSON ROAD; MAKING OTHER PROVISIONS
RELATED THERETOt AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, on December 10. 2009, BAWA authorized an agreement with Harris County for utility
relocations to accommodate Harris County's widening of Thompson Road; and
WHEREAS,pursuant to the agreement; BAWA agreed to pay the Comity an estimated $382,414.25,which
included$24,093,00 for engineering and$17,062.92 for administrative cspcnscs;and
WHEREAS, the County has now opened bids on the project, including BAWA's utility relocations, and has
notified BAWA that the lowest and best bid received exceeded the above-referenced amount by$71,216.43;and
WHEREAS, BAWA now has. the option of tendering payment of this entire increased amount to the
Count} or independently rebidding theproject;.and
WHEREAS,after review of the bid line items and comparison with the bid amounts for similar utility work
for the City of Baytown, BAWA desires to authorize the. additional funds for the relocation work; NOW
THEREFORE.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AULHORITY:
Section L That the Board of Directors of the Baytown Area Water Authority hereby authorizes
SEVENTY-ONE THOUSAND TWO HUNDRED SIXTEEN AND 43/100 DOLLARS ($71,216.43) of additional
funding for the relocation of the Baytown Area Water Authority's facilities to accommodate Harris- County's
widening of Thompson Road pursuant to its contract with Harris County for such project.
Section 2: That the General Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO/100 DOLLARS
($25;000.00) or less, provided that the amount authorized in Section I hereof may not be increased by more than
ten percent (10%) or decreased by more than ten percent.(10%) without the consent of the contractor to such
decrease.
Section 3: This resolution shall take effect immediately from and after its passage by the Board of
Directors of the Baytown Area Water Authority.
