A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN
AREA WATER AUTHORITY AUTHORIZING THE SALE OF A 0.4854-
ACRE ROADWAY EASEMENT TO HARRIS COUNTY FOR ITS
THOMPSON ROAD PROJECT FOR THE SUM OF NINETEEN THOUSAND
FOUR HUNDRED EIGHTY-SEVEN AND NO/100 ($19,487.00);
AUTHORIZING THE INTERIM GENERAL MANAGER TO NEGOTIATE
AND EXECUTE THE APPROPRIATE DOCUMENTS TO FINALIZE THE
SALE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, Harris County has requested that the Board of Directors of the Baytown
Area Water Authority approve and authorize the sale of a 0.4854-acre roadway easement; and
WHEREAS, the requested easement is necessary for Harris County's Thompson Road
Project, which consists of the construction of a 5-lane concrete paved roadway with concrete
curbs and gutters and an underground storm sewer system; and
WHEREAS, based upon an appraisal performed by Scott Stephens & Associates, Inc.,
Harris County has offered to pay the Baytown Area Water Authority the following:
Taking Offer
.4854 acres @ $28,000 per acre $13,591.00
6" Chain Link Fence: 176 LF 1,056.00
Wood sign & Planter Box 2,000.00
Small Sign 200.00
Concrete Driveway: 600 ft2 @ $4.00/ft2 2,400.00
Concrete Curb: 40 LF @ $6.00/LF 240.00
TOTAL $19,487.00
WHEREAS, after reviewing the appraisal and the other documents submitted, the Board
of Directors of the Baytown Area Water Authority finds that offer is reasonable and that it is in
the public interest to sell the roadway easement to Harris County for its Thompson Road Project;
NOW THEREFORE
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA
WATER AUTHORITY:
Section l: That the Board of Directors of the Baytown Area Water Authority hereby
authorizes the sale of a 0.4854-acre roadway easement to Harris County for its Thompson Road
Project, for the sum of NINETEEN THOUSAND FOUR HUNDRED EIGHTY-SEVEN AND
NO/100 ($19,487.00). Said easement area is more particularly described in Exhibit "A," which
is attached hereto and incorporated herein for all intents and purposes.
Section 2: That the Board of Directors of the Baytown Area Water Authority hereby
E authorizes the Interim General Manager to negotiate and execute the appropriate documents to
finalize the sale of the roadway easement authorized in section 1 hereinabove.
Section 3: This resolution shall take effect immediately from and after its passage by
the Board of Directors of the Baytown Area Water Authority.

DESCRIPTION
Description of a 0.4854 acre (21,145 square foot) tract of land located in the Nathaniel Lynch
Survey, Abstract No. 44, Harris County, Texas, being a part of that certain tract of land called
36.7289 acres as described in the deed to Baytown Area Water Authority dated December 27,
1977 and recorded under Harris County Clerk's File (H.C.C.F.) No. F428118 and a part of that
certain tract called 31.4158 acres as described in the deed dated January 24, 1978 and recorded
under H.C.C.F. No. F482048, the subject 0.4854 acre tract being more particularly described by
metes and bounds as follows (with bearings referenced to the North American Datum of 1983
based upon ties to the Hams County Tropical Storm Allison Recovery Project RM 140125 and
RM 070535):
COMMENCING at a capped 5/8-inch iron rod stamped"JNS ENGINEERS"set in the northerly
right-of-way line of Ellis School Road (based on a width of 60 feet as shown on the map of the
Highland Farms recorded under Vol. 7, Pg. 60 of the Harris County Map Records) marking the
southwesterly corner of the said 36.7289 acre tract;
THENCE,N 86°52' 44"E, along the existing northerly right-of-way line of Ellis School Road,a
distance of 2,632.91 feet to a capped 5/8-inch iron rod stamped"JNS ENGINEERS"set marking
the southerly end of the cut back comer with the proposed westerly right-of-way line of
Thompson Road and the POINT OF BEGINNING of the herein described tract and having
Texas State Plane, South Central Zone, surface coordinates of X=3,227,000.04 and
Y=13,861,265.59;
THENCE,N 42°58' 04"E,along the proposed cut back line, a distance of 21.61 feet to a capped
5/8-inch iron rod stamped "JNS ENGINEERS" set in the proposed westerly right-of-way line of
Thompson Road marking the northerly end of the proposed cut back line;
THENCE,N 00°56' 36" W, along the proposed westerly right-of-way line of Thompson Road,a
distance of 355.25 feet to a capped 5/8-inch iron rod stamped"JNS ENGINEERS" set for corner;
THENCE, N 02° 35' 03" W, continuing along the proposed westerly right-of-way line of
Thompson Road, a distance of 583.65 feet to a capped 5/8-inch iron rod stamped "JNS
ENGINEERS"set for comer;
THENCE,N 87°24' 57" E, a distance of 20.00 feet to a capped 5/8-inch iron rod stamped ,INS
ENGINEERS" set in the existing westerly right-of-way line of Thompson Road (based on a
width of 60 feet as shown on the Plat of Elena Fruit and Cotton Farm recorded under Volume 7,
Page 48 of the Hams County Map Records);
THENCE, S 02° 35' 03" E, along the existing westerly right-of--way line of Thompson Road, a
distance of 953.46 feet to the intersection with the aforementioned existing northerly right-of-
way line of Ellis School Road;
