2020 07 15 BAWA MinutesMINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY July 15, 2020 The Board of Directors of the Baytown Area Water Authority (BAWA) met in a Regular Meeting on Wednesday, July 15, 2020, at 4:31 P.M., in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Brenda Bradley Smith Mike Wilson Frank McKay III Brandon Benoit Nick Woolery Karen Horner Leticia Brysch President (In Person) Vice President (Teleconference) Secretary (Teleconference) Director (Teleconference) Presiding Manager Interim General Counsel Assistant Secretary President Bradley Smith convened the July 15, 2020, BAWA Board Regular Meeting with a quorum present at 4:31 A.M., all members were present with the exception of Director Harland Forrest, Jr. who was absent. 1. MINUTES a. Consider approving the minutes of the Baytown Area Water Authority Regular Meeting held on June 17, 2020. A motion was made by Director Brandon Benoit, and seconded by Secretary Frank McKay III to approve the minutes of the Baytown Area Water Authority Regular Meeting held on June 17, 2020, as submitted. The vote was as follows: Ayes: President Brenda Bradley Smith, Vice President Mike Wilson, Secretary Frank McKay III, and Director Brandon Benoit Nays: None Other: Director Harland Forrest, Jr. (Absent) Approved 2. PROPOSED RESOLUTIONS a. Consider a resolution awarding the South Lagoon Sludge Removal Contract to Synagro of Texas -CDR, Inc. Assistant Public Works Director Sterling Beaver presented the item and stated that the proposed resolution awards the South Lagoon Sludge Removal Contract to Synagro of Texas -CDR, Inc., in BAWA Board Regular Meeting Minutes July 15, 2020 Page 2 of 4 the amount of $137,500.00. He noted that during the water treatment process, raw water goes through a sedimentation stage which aids in the removal of solid particles, known as sludge. This sludge is then collected and discharged to an onsite sludge lagoon and over time the sludge lagoon accumulates and requires sludge removal to restore the storage capacity. Mr. Beaver noted that the scope for this project includes the removal of all sludge and vegetation from the South Sludge lagoon; thus, restoring the lagoon to its original condition. He noted that this project was advertised on June 7, 2020, with seven contractors being notified of the opportunity. Staff received only one bid at the bid public opening on June 15, 2020. The bidder, Synagro has performed the work outlined on previous projects for BAWA with good results and staff recommended approval of this item. A motion was made by Vice President Mike Wilson, and seconded by Secretary Frank McKay III to approve Resolution No. 2020-10, related to Item 2.a. The vote was as follows: Ayes: President Brenda Bradley Smith, Vice President Mike Wilson, Secretary Frank McKay III, and Director Brandon Benoit Nays: None Other: Director Harland Forrest, Jr. (Absent) Approved RESOLUTION NO. 2020-10 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY AWARDING THE SOUTH LAGOON SLUDGE REMOVAL PROJECT TO SYNAGRO OF TEXAS -CDR, INC., SUBJECT TO THE APPROVAL OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS; AUTHORIZING PAYMENT IN THE AMOUNT OF ONE HUNDRED THIRTY-SEVEN THOUSAND FIVE HUNDRED AND 00/100 DOLLARS ($137,500.00) TO SYNAGRO OF TEXAS - CDR, INC.; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. Consider a resolution authorizing the closeout, acceptance, and release of retainage to Angel Brothers Enterprises, Ltd, for the Baytown Area Water Authority FM 1405 16-inch Waterline Project. Assistant Director of Public Works and Engineering Andrea Brinkley presented the item and stated that the proposed resolution provided for the closeout, acceptance and final pay estimate for release of retainage in the amount of $65,750.43 to Angel Brothers Enterprises, LLC, for the Baytown Area Water Authority (BAWA) FM 1405 16-inch Waterline Project. BAWA Board Regular Meeting Minutes July 15, 2020 Page 3 of 4 Ms. Brinkley noted that the scope of work for this projected consisted of the construction of a 16- inch waterline along FM 1405 from the south side of the CenterPoint Energy canal to the south side of FM 565; this waterline will serve as a new water transmission line from the BAWA East Surface Water Plant and will connect to the existing water distribution system, to provide future service when the plant comes on line. Ms. Brinkley further noted that the original contract with Angel Brothers was in the amount of $1,344,481.00; there was one change order in the amount of $16,053.51 for a 16-inch x 20-inch tee connection for a future CCID No.1 connection, resulting in the total amount of $1,360,534.51 and returns $45,526 in unused funds to the contractor. A motion was made by Director Brandon Benoit, and seconded by Secretary Frank McKay III to approve Resolution No. 2020-11, related to Item 2.b. The vote was as follows: Ayes: President Brenda Bradley Smith, Vice President Mike Wilson, Secretary Frank McKay III, and Director Brandon Benoit Nays: None Other: Director Harland Forrest, Jr. (Absent) Approved RESOLUTION NO. 2020-11 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY ACCEPTING THE BAYTOWN AREA WATER AUTHORITY FM 1405 16-INCH WATERLINE PROJECT; AUTHORIZING FINAL PAYMENT OF THE SUM OF SIXTY-FIVE THOUSAND SEVEN HUNDRED FIFTY AND 43/100 DOLLARS ($65,750.43) TO ANGEL BROTHERS ENTERPRISES, LLC, FOR SAID PROJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 3. REPORTS a. Receive the Baytown Area Water Authority's Quarterly Financial and Investment Reports for the Quarter Ending June 30, 2020. Finance Director Victor Brownlees presented the Baytown Area Water Authority's Quarterly Investment Report, for the Quarter Ending June 30, 2020, is submitted for review in accordance with the Public Funds Investment Act, Section 2256.023 (a) and (b). He noted that as it relates to revenues, the Authority is right on track where it is expected to be at this time of year and in expenditures, he noted that the Authority is a little below of what was budgeted because of lower than expected maintenance cost. Mr. Brownlees noted that investments continue conservative but is not uncommon in the current COVID disaster. BAWA Board Regular Meeting Minutes July 15, 2020 Page 4 of 4 b. Receive an update regarding the Baytown Area Water Authority East Plant Project. Assistant Director of Public Works and Engineering Andrea Brinkley gave the board an overview of the Baytown Area Water Authority East Plant Project as it relates to its construction, progress and staff training. C. Receive an update regarding the Fritz Lanham Surface Water Plant Chemical Feed Improvements Project. Assistant Director of Public Works and Engineering Andrea Brinkley gave the board an update regarding the construction of the Fritz Lanham Surface Water Plant Chemical Feed Improvements Project. 4. MANAGER'S REPORT a. The next Baytown Area Water Authority meeting is scheduled for Wednesday, August 19, 2020, at 4:30 p.m., in the Council Chamber located at City Hall, 2401 Market Street, Baytown, Texas 77520. Presiding General Manager Nick Woolery presented the item and thanked the staff for all their hard work and dedication to the Authority's many projects and finances, and noted that the next BAWA meeting is scheduled for August 19, 2020, at 4:30 p.m. 5.
